As stated in the first paper; The Constitution of the United States was designed to be a framework for the organization of our country’s government. Many foreign countries also have constitutions, which outline the rights of individuals and the powers of the law; such as the Iraqi Constitution of 2005. I will compare the similarities and differences of the US and Iraqi Constitutions and discuss Articles 2, 36, 39, & 90 and women’s rights of the Iraqi Constitution.
Some similarities of the two Constitutions are evident in the laws of the legal system. Religion is only mentioned in the first amendment of the United States Constitution and simply states that government and religion will be kept separate; “Congress make no law respecting an establishment of religion or prohibiting its free exercise.” On the contrary, religion is mentioned several times in the Iraqi Constitution and there is not much separation between the governing law and religion. I will further discuss the prevalence of religion in the Iraqi Constitution later in the paper. Another transparent difference is the declaration of official languages of the country. Article 4 of the Iraqi Constitution states, “The Arabic language and Kurdish language are the two official languages of Iraq.” In addition, there are several clauses within Article 4, which states that, the official publications will be written in the two languages and that speech, conversation and expression in the official government setting will be in either language. Even with the declaration of an official language the people are also given an option to adopt another language in a follow-up clause that states, “Each region or governorate may adopt any other local language as an additional official language if the majority of its population so decide in a general referendum.” Another difference are Articles 31 and 34 of the Iraqi Constitution, which states that each citizen has the right to healthcare and …show more content…

In addition, Article 29 states, “The State guarantees the protection of motherhood, childhood, and old age and shall care for children and youth and provides them with the appropriate conditions to further their talents and abilities.” This is a unique, because it specifically mentions motherhood, which is a right that is only reserved for women. I think that it show much respect to women and their imperative role in reproduction and nurturer of life. In addition, Article 30 states, “The state guarantee to the individual and the family—especially children and women—social and health security and the basic requirements for leading a free and dignified life. The state also ensures the above a suitable income and appropriate housing.” This again specifically states the rights of women and how there are specific laws that meant to provide and protect on several
