Classicism and positivism do have some similarities, however they do dispute each other to a certain area. Classicism Criminology is an access which regards the idea of national action and freedom. This was found in the eighteenth and early nineteenth century with an intention of producing a criminal justice system which was clear and stationed on everyone 's equality. Positivist Criminology, is found by the notion of scientific empathetic of crime and criminality. The key concept is positioned on the idea of human behavior being settled for the society. There are two types of positivism that try to seek the explanation of crime and deviance which is biological and psychological positivism.

People with mental disorder and non-mental disorder should get equal punishment, every person should be treated same under the law. People with psychological issues or mental disorder get less punishment when proven, because those kind of illness 's pushes people to commit a crime. If you look at it psychologically you don 't know how the person is feeling or what made them feel like. If a person doesn 't believe what they did was wrong this shows they have a serious psychological issue. What causes them to have a psychological issue? Sigmund Freud was the first to use the term psychoanalysis in 1896, he researched about humans behavior and what makes humans cause a criminal behavior. In “Studies in Hysteria” (1895) Freud proposed that physical symptoms are often the surface manifestations of deeply repressed conflicts. Mental illness affects one in four adults every year ("NAMI: National Alliance on Mental Illness | Mental Illnesses"). Mental illness effects thousands who may not even be aware of it. Many who are aware do not receive treatment until something bad happens in result of not receiving treatment. These illnesses affect all aspects of the person’s life. They often do things without the knowledge of what they are doing. Many people who do have these illness commit crimes without the knowledge of the fact that they are doing wrong. People often do not believe that having a mental illness gives people the right to commit a crime, and it doesn’t. It merely suggests that the person who committed said crime was not aware of their actions therefore cannot be held accountable for the wrongdoing. Families of the victims usually are oblivious to what mental illness is and own they do end up educating themselves wondering why these people never got help so their loved one may have been spared. Mentally ill persons should be exempt from the death penalty because they are in a questionable state of mind, they will become low risk if they receive treatment, and the families of the victims do not want them to receive the death penalty.
Criminological theories interpret the competing paradigms of Human Nature, Social Order, Definition of Crime, Extent and Distribution of Crime, Causes of Crime, and Policy, differently. Even though these theories have added to societies understanding of criminal behaviour, all have been unable to explain why punishment or treatment of offenders is unable to prevent deviancy, and thus are ineffective methods of control. The new penology is a contemporary response that favours the management of criminals by predicting future harm on society. However, all criminological theories are linked as they are a product of the historical time and place, and because of their contextual history, they will continue to reappear depending on the current state of the world, and may even be reinvented.
Wouldn’t it be completely irrational to sentence every mentally ill individual to jail purely because they suffered from a mental illness? Often, mentally ill people behave in an eccentric manner and allure the attention of police officers who do not differentiate the mentally ill from mentally stable people and immediately charge them with misdemeanors. There are approximately 300,000 inmates, with the number increasing every year, which suffer from a mental illness and do not receive proper treatment. Jails are not adequately equipped to care for mentally ill inmates, which can lead to an escalation of an inmate’s illness. Society has failed to provide enough social resources for citizens suffering from psychiatric illnesses in its community, transferring mentally unstable individuals between mental institutions and jails, when in fact adequate aid such as providing proper medication, rehabilitation opportunities, and more psychiatric hospitals in communities is a necessity to reconstitute these individuals.
Up until the 19th century, Classicist ideas dominated the way in which people looked at crime. However during the late 19th century a new form of “scientific criminology” emerged, called Positivism (Newburn, 2007). Positivism looked at the biological factors on why someone would commit a crime, this involved looking at the physical attributes of a person, looking at their genetic make-up and their biochemical factors.
Criminology theories are Conflict Theory which is based upon the view that the fundamental causes of crime are the social and economic forces operating within society. Critical Theory approaches to culture, and esp. to literature, that seeks to confront the social, historical, and ideological forces and structures that produce and constrain it. Labeling Theory is how the self-identity and behavior of individuals may be determined or influenced by the terms used to describe or classify them. Life Course Theory focuses on the stage of life that exposure to health promoting or harmful influences occurs and the duration of exposure to these influences. Positivist Theory concerns with positive facts and phenomena, and excluding speculation upon ultimate causes or origins.
The classical school is not concerned with why criminals are criminals, but seeks to reduce crime by using punishment as a means of deterrent, on the basis that individuals will choose to exercise their own free will and will employ rational decision making. By contrast, Ceasare Lombrosso (1835 – 1909) and the positivist school dismissed such ideas and theorised that criminality is a personality trait that one is born with and can be diagnosed by certain physical appearances, and is thus a more scientific method of establishing the reasons for criminal behaviour. However, this essay will concentrate on the strengths and weaknesses of the classical school.
During the 1970’s to the early 1990’s there had emerged two new approaches to the study of crime and deviance. The discipline of criminology had expanded further introducing right and left realism, both believe in different areas and came together in order to try and get a better understanding on crime and prevention. There were many theorists that had influenced the realism approaches such as; Jock Young (Left Wing) and James Wilson (Right Wing).
To start of the first short essay I will start to compare and contrast the criminological theory that evaluates six differences between Radical and Orthodox. “Radical criminology is defined as a method that has been described of the meaning of the effects of the behavior of the individual that may or may not resolve in criminal behavior due to the effect of social identities”(Lynch &Michalowski,p.26). “Radical criminology has the various effects of economic influence that may possibly lead to an increase of crime such as property crimes due to the fact individuals are seeking to invest money”(Lynch & Michalowski, p.109).

The two theoretical approaches I have chosen to compare to the study of crime are Functionalism and Marxism. I have done so, as I believe both theories are important/ significant to the study of crime and differentiate from each other. I will do this by writing a critique the advantages and disadvantages of both of the theories and thus, resulting in my own personal opinion in the conclusion.
Toward the end of the eiteenth-century, Romanticism emerged as a response to Classicism. Even though this change was gradual, it transformed everything from art and philosophy to education and science. While the Classicsts thought of the world as having a rigid and stern structure, the romanticists thought of the world as a place to express their ideas and believes. The Romaniticists and Classicsts differed in their views of the relationship between an individual and society, their views of nature and the relationship between reason and imagination.
There are many different aspects of criminal justice policy. One in particular is the different theories of crime and how they affect the criminal justice system. The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists. The last theory is about Critical criminology. Their goal was to transform society in a way that would liberate and empower subordinate groups of individuals.
The Classical School of Criminology generally refers to the work of social contract and utilitarian philosophers Cesare Beccaria and Jeremy Bentham during the enlightenment in the 18th century. The contributions of these philosophers regarding punishment still influence modern corrections today. The Classical School of Criminology advocated for better methods of punishment and the reform of criminal behaviour. The belief was that for a criminal justice system to be effective, punishment must be certain, swift and in proportion to the crime committed. While Cesare Lombroso was the first to apply positivism to criminology, it was made possible by the efforts of Auguste Comte, who was the first person to suggest trying to solve problems using scientific reasoning (Adler et al 2012). Also the work of Charles Darwin was able to make society more receptive to the idea of science being an acceptable way to answer questions and solve problems in society. Those three men were able to make criminology a more legitimate and respected field.
