Wild Life (Protection) Act, 1972 Legislation and scope:- In the year 1991, Parliament extended the Act to the whole of India except the state of Jammu and Kashmir, which has its own Wild Life (Protection) Act, 1972 similar to the national law. The Act lists not only endangered flora and fauna but also vermin. Prohibition on hunting:- section 9 of the Act provide that no person shall hunt any wild animal specified in Schedules I,II,III and IV except as provided under section 11 and 12. B. Authorities Constituted Under The Act Establishment and duties of National Board for wild life:- The Central Government must constitute a National Board for wildlife, within three months from the date of commencement of the Wild Life (Protection) Amendment Act 2002. It is the duty of the National Board for Wild Life to promote the conservation and development of wildlife and forests by such measures as it thinks fit. These measures include:- Framing policies, advising the Central Government and the State Governments on the ways and means of promoting wild life conservation and effectively controlling poaching and illegal trade of wild life and its products; Making recommendations on the setting up of and managements of national parks, sanctuaries and other protected areas and on matters relating to restriction of activities in those areas; Carrying out or causing to be carried but impact assessment of various projects and activities on wild life or its habitat; Reviewing from time to time, the progress in the field of wild life conservation in the country and suggesting measures for improvement thereto; and Preparing and publishing a status report at least once in two years on wild life in the …show more content…

Section 12 authorises the Chief Wild Life Warden to permit hunting of any wild animal for the purpose of – Education; Scientific research; (bb)Scientific management which includes (i)trans-location of any wild animals to an alternative suitable habitat; or (ii)population management of wildlife, without killing or poisoning or destroying any wild animals. Collection of specimens for recognized zoos or for museums and similar institutions; and Derivation, collection or preparation of snake-venom for the manufacture of life-saving drugs. In “State of Rajasthan vs. Salman Khan & Others”, the Rajasthan High Court held that unlawful assemblies formed for the purpose of committing crimes under the Act can be prosecuted under Section 141 of the Indian Penal Code, read with Section 425 and 429 of the Indian Penal Code.
