Civil Rights and Atticus Finch Relation To Kill a Mockingbird by Harper Lee shows the struggles of a defense lawyer, Atticus Finch, and the difficulties of cases pertaining to African Americans. Atticus Finch is a great example of how some civil rights defenders such as Rosa Parks, Martin Luther King Jr, John F. Kennedy, and Lyndon B Johnson experienced struggles and difficulties when supporting and defending civil rights. From reading this paper, one can understand key historical figures in the actual Civil Rights movement, understand historical accounts of white defenders being discriminated against by African Americans, and decipher how African Americans have looked at white lawyers through history. A great example of discrimination “was the 1964 murder in Philadelphia, Mississippi, where three young activists who were helping to organize a voter registration drive… At about 5:00p.m. their car was stopped by country deputy, Cecil Price. Chaney was arrested for allegedly speeding and his passengers were detained “for investigation” ” (“The Civil Rights Movement”). The murders of the three men lead to a movie made, twenty years after the murder called the Mississippi Burning. The three young men were arrested for allegedly speeding in Neshoba County (“The Civil Rights Movement”). Two of the three men were detained for “investigation” even though they were white, then found murdered”, their bodies beaten and shot, after their release from jail at a farm. These events were one of many that led to light being shined upon the discrimination that blacks, and those who fought for them, endured. “[T]here is one way in this country in which all men are created equal- there is one human institution that makes a pauper the equal of a Rockefeller; the stupid man the equal of an Einstein, and the ignorant man the equal of any college president. That institution, gentlemen, is a court” (Lee 233). These are the words uttered by Atticus Finch, an important character in Harper Lee’s To Kill a Mockingbird. Atticus is a lawyer, and at this point in the novel, he is trying to defend Tom Robinson, a black man who was accused of raping a white woman. This reflects upon how society was in the 1930’s, when the color of your skin affected your chances of winning a trial. In fact, it is speculated that To Kill a Mockingbird is loosely based off of the trials of the Scottsboro Boys, a famous case from this time period. Most of the main characters associated with both trials share similar traits, experiences, and backgrounds.
The purpose of this essay is to compare three very similar cases, the Scottsboro Trials, Brown v. Mississippi, and the fictional trial of Tom Robinson in Harper Lee’s To Kill a Mockingbird; and to prove why the defendant of the third trial never had a chance. Each took place in the rural South in the 1920’s and 30’s and involved the unfair conviction of young black males by all-white juries pressured by the threat of mob violence. Each lacked the evidence sufficient for conviction, most especially for the death penalty. Last, heroes emerged from each trial and made small but solid steps towards equal justice for all.
In To Kill A Mockingbird, Atticus Finch is a lawyer who defends Tom Robinson, an African American man, against the Ewell family in court. Malcolm Gladwell is the writer of “The Courthouse Ring: Atticus Finch and the limits of Southern Liberalism”, where he discusses that Atticus Finch is an activist. Lance McMillian responds to Malcolm Gladwell’s critique of Atticus in “Atticus Finch as Racial Accommodator: Answering Gladwell’s Critique”, where overall he says that Atticus is not an accommodator but an activist. Lance McMillan's view of Atticus Finch is incorrect compared to Malcolm Gladwell because Atticus is an accommodator by not fighting against institutional racism.
Atticus Finch from, To Kill a Mockingbird, is characterized as a wise man that is an exceptional father to his children and always teaches them the right perspective about life and the people around them. Jem and Scout the son and daughter of a lawyer named Atticus Finch get a taste of what the real world is like when, Tom Robinson a poor black man who is married and has kids is falsely accused of raping and assaulting a white woman named Mayella. Mayella Ewell is a young girl considered to be “white trash” who is all by herself to take on the role raising her little siblings while her father Bob Ewell, who is an alcoholic, abuses her. The question arises, is Mayella Ewell Powerful? Mayella Ewell is powerful in this discrimination case because of her race as white woman, her higher class than Tom Robinson, and her gender as a female.
One's identity is a very valuable part of their life, it affects the Day to day treatment others give them which can lead to how the individual feels emotionally. Atticus, defending Tom Robinson, who is an african american man from the plaintiff of the case, Mayella Ewell, who is a caucasian woman, accusing that Tom raped her is supposivly a lob sided case. To begin, parallel and conflicting characteristics can be realized by exploring the judges of the two cases. Judge Horton and Judge Taylor both presided over the cases. Judge Horton was the second of three judges in the Scottsboro cases, and Judge Taylor was the fictional judge in To Kill a Mockingbird. The two both exhibited undeniable sympathy to the defendants in the cases. Judge Horton sympathizes with the nine Scottsboro boys by declaring, “You are not trying whether or not the defendant is white or black … you are trying whether or not this defendant forcibly ravished a woman” (People and Events). It is obvious that Judge Horton was unprejudiced and believed the boys should be treated with equality. The first “mockingbird” that is featured in the novel is a man named Atticus Finch. Not only is Atticus Finch the sole representative of Maycomb in the legislature, but also he is a brilliant lawyer. In addition, he has a good reputation in both Maycomb’s black and white communities because of his exceptional character. However, his reputation is soon shattered when he is faced with a case in court that affects him personally: he must defend an African American man in court in Maycomb’s segregated society.
