After the 2nd World War, Japan was under the supervision of US which lasted for seven years from 1945-1952 (Kumano, 2007). Within the period of US occupation there were some political changes in Japan including the formation of New Constitution drafted and prepared by the US occupation forces. In the Constitution, Article 9 is the main focus where it imposed restrictions on Japan’s use of force. It is written in Article 9 that Japan forever renounce the use of force to settle international disputes and the right to maintain land, sea, and air forces or any war potential (The American Occupation of Japan, 1945-1952, 2009). In other words, Japan is not allowed to launch military attack and send troops to protect and assist their allies.

According to 1947 Japan Constitution, Article 9 clearly mentioned that Japan would forever renounce war to resolve international dispute and they will never maintain any war potential regardless of air, ground or maritime. Engaging in collective self-defence indicated Japan would need to engage in foreign war to support its ally even though they are not under direct attack. Expanding military capacity is a must if Japan engages in collective self-defence. Therefore, these are said to be violating the Article 9. Besides, it is written in Japanese Constitution under Article 96 that any amendment of article need to have majority support, making the amendment process complicated. In this issue, Abe’s government did not gain public support and he ignored the public opinion. A survey was done based on the reaction towards the issue and it showed 90% of scholars were disagreed with it (Soble, 2015). Despite the fact that this issue received a majority disagree, Abe continued to with his intention to revise Article 9. Therefore, Abe’s New Security Law is unconstitutional.

Besides, Philippines brought the case concerning the legality of China’s claim over the nine-dotted line increased the tension between both countries. Therefore, Philippines decided to join Japan in balancing China’s power in South China Sea.
In 2015, Philippines and Japan have had established closer defence ties and held a series of joint naval exercises in the South China Sea (Tatsumi, 2015). The Philippines has also collaborate in other maritime exercises with both the United States and Japan (Panda,
2015). In addition, Japan also promised to provide logistic support and help Philippines to build their capacity by transferring defence equipment to Philippines (Panda, 2015).
However, there is no formal alliance between Japan and Philippines and this indicates that
Japan will not directly assist Philippines when it is in conflict but Japan’s SDF will be aiding US which in turn come as the aid to Philippines (Panda, 2015).
