Mexico is well known for its more than powerful executive branch and for giving its Presidents a more ample variety of “meta-constitutional powers. Fundamentally, it is important to recognize what powers are actually legally and constitutionally given to the Mexican President. Mexican Presidents have often times overstepped their constitutional boundaries and exerted some executive privileges that are well within questions, of these, some powers have managed to become a “norm” and others have simply faded away over time. The United States has no more important foreign relation ship than that of which it enjoys with Mexico, and vice versa. These two countries share interwoven societies and economies. Although there have been disagreements and turbulence between the two countries, which partnership is without these? The Strength of each country’s democracy is fundamental to the other’s. This relationship that the two countries share directly affects that lives of millions of Mexican and United States citizens everyday. Recently these two countries have become even more unified than ever before. Tackling issues such as Border Control, Countering Narcotics, Dealing with multiple Law enforcement agencies, Human Rights laws, trade and development, etc. There are many issues that they are mutually interested in and must deal with. Yet, there are some vast differences in which these two countries are run. There are also many similarities, which we must take into account. Both Democratic Governments have similar structures, containing a legislative, judicial, and executive branch. Yet, these structures are very different internally, containing specific duties that the other country’s branch may not have.

In this excerpt from Democracy in America Alexis Tocqueville expresses his sentiments about the United States democratic government. Tocqueville believes the government's nature exists in the absolute supremacy of the majority, meaning that those citizens of the United States who are of legal age control legislation passed by the government. However, the power of the majority can exceed its limits. Tocqueville believed that the United States was a land of equality, liberty, and political wisdom. He considered it be a land where the government only served as the voice of the its citizens. He compares the government of the US to that of European systems. To him, European governments were still constricted by aristocratic privilege, the people had no hand in the formation of their government, let alone, there every day lives. He held up the American system as a successful model of what aristocratic European systems would inevitably become, systems of democracy and social equality. Although he held the American democratic system in high regards, he did have his concerns about the systems shortcomings. Tocqueville feared that the virtues he honored, such as creativity, freedom, civic participation, and taste, would be endangered by "the tyranny of the majority." In the United States the majority rules, but whose their to rule the majority. Tocqueville believed that the majority, with its unlimited power, would unavoidably turn into a tyranny. He felt that the moral beliefs of the majority would interfere with the quality of the elected legislators. The idea was that in a great number of men there was more intelligence, than in one individual, thus lacking quality in legislation. Another disadvantage of the majority was that the interests of the majority always were preferred to that of the minority. Therefore, giving the minority no chance to voice concerns.
The Government of the United States, going against Mr.Padilla’s Constitutional rights and not providing him an opportunity to contest the legality of his detention, comprises the value of the Government’s accountability as a law-abiding state. In this particular case, it appears that government officers, including the president, believe that they should be able to do what is against pre-existing laws, if it is necessary to the preservation of the state and its citizens. However, this view raises some serious problems. If committed to a principle Rule of Law, one should never expect the government to act in an illegal way. The Rule of Law refers to “an end state in which all individuals and institutions, public and private, and the state itself are held accountable to the law, which is supreme” (Rule, n.d.). Therefore, the Rule of Law states, that every citizen is subject to the law, including the lawmakers themselves. All government officers of the States, including the president, the Justice of the Supreme Court, and all members of Congress, pledge to uphold the Constitution; affirming that the Rule of Law is superior to the rule of any human leader (Vile, 2006).
The document I chose to write about is the United States Constitution. When the thirteen British colonies in North America declared their independence in 1776, they laid down that “governments are instituted among Men, deriving their just powers from the consent of the governed.” The “colonies” had to establish a government, which would be the framework for the United States. The purpose of a written constitution is to define and therefore more specifically limit government powers. After the Articles of Confederation failed to work in the 13 colonies, the U.S. Constitution was created in 1787.
The Mexican Revolution began November 20th, 1910. It is disputable that it extended up to two decades and seized more than 900,000 lives. This revolution, however, also ended dictatorship in Mexico and restored the rights of farm workers, or peons, and its citizens. Revolutions are often started because a large group of individuals want to see a change. These beings decided to be the change that they wanted to see and risked many things, including their lives. Francisco “Pancho” Villa and Emiliano Zapata are the main revolutionaries remembered. These figures of the revolution took on the responsibility that came with the title. Their main goal was to regain the rights the people deserved. The peons believed that they deserved the land that they labored on. These workers rose up in a vehement conflict against those opposing and oppressing them. The United States was also significantly affected by this war because anybody who did not want to fight left the country and migrated north. While the end of the revolution may be considered to be in the year of 1917 with the draft of a new constitution, the fighting did not culminate until the 1930’s.
A revolution occurs when a need for drastic change is necessary to alter ones way of living. The change they are fighting for would end up to be a positive impact once victory prevails, but of course with every battle there are disagreements and violent quarrels. Revolution may seem to be a negative connotation, but there are always two sides to every story. Just like many other countries around the world a Latin American country called Mexico went through a revolution of their own. Although the Mexican Revolution was mainly fought for the distribution of land, it opened a gateway for the women. One of their main issues during the Mexican revolution dealt with women and their struggled determination for equality. Having many roles in society with restrictions placed upon them, an urge for mobilization, and a wonderfully strong woman role model named Hermila Galindo, it gave them all a reason for the extra push they needed for the change they wanted for the future. Being able to finally put their voice in action the women of Mexico fought proudly for what they believed was right.
The Constitution of the United States is an intricate document, that has influenced and shaped many newly formed Democratic nations. Many people believe that the ideas in the American Constitution are all novel and original, but that is untrue. The roots of American Constitutionalism are found in the historical paradigms of Western tradition. The fact is, constitutional doctrines were long developed and put into use long before the birth of America. The Greeks, the Romans, the English, and even the Colonialist in the New World all formed constitutional doctrines that would later influence the Founding Fathers of the American Constitution.

Tyranny refers to when a person has a lot of power, and has a lot on their hands, having complete control, and total control. Linz supports the fusion of the executive and legislative branches because it forces a sense of cooperation. He points out that “presidential systems may be more or less dependent on the cooperation of the legislature; the balance between executive and legislative power in such systems can thus vary considerably” Linz admits that “presidential elections do offer the indisputable advantage of allowing the people to choose their chief executive openly, directly, and for a predictable span rather than leaving that decision to the backstage maneuvering of the politicians.” but qualifies it by stating that it is only and beneficial if the majority of the people of spoken. In Scott Mainwaring and Matthew Shugart’s critical appraisal of “The Perils of Presidentialism” they offer counter arguments when they suggest that a bicameral parliament can just as easily have dual legitimacy issues as a President and legislative body. It should be recognized that Linz does not address the checks and balances that allows for a more regulated government ensuring that power is not concentrated in the hands of one group.
