Standard form of contracts
As Simister (2009, p. 3a-16) pointed out, the construction industry has a wide selection of standard forms of contract. To protect the client needs and fully address the project requirements, ATCO and Siemens formed a CCDC 5A - 2010 (a form of contract for construction management and services).
The civil work of both the Newell and Heathfield site was given to Elis Don by Siemens based on a CCDC 18 – 2001 (a form of contract for civil works). Ellis Don as the main contractor has different types of contracts that will best suit their need to comply with Siemens goals. They contract suppliers, sub-contractors, and plant hires in order to implement the project aspects.
Siemens also needed a domestic consulting sub-contractor

The procurement approach for this project was chosen based on the project management. The process of selecting the (construction) project management contractor (Siemens) as well as its team was significant as the key in producing an effective project with regards to quality and cost in this approach relies on the management team’s experience and knowledge in all aspects.
By choosing the (construction) project management approach, ATCO was responsible for all the overall risks associated with project. From ATCO’s prospective it was a disadvantage, however Siemens as the construction project manager had the advantage of not having the direct deal with the risks of

Advantages:
• The client was working with only one firm, which assists them to improve coordination and collaboration between designers and constructors
• The overlap between design and construction activities resulted into saving time over the life span of the project
• The obligation for the integration of the design team with the construction team was accepted by the construction management contractor (Siemens) which helped to improve the quality.
• Work and trade packages were competitively purchased.
• Improved constructability through sub-contractor input into the design progress.
• Roles, risks and responsibilities were clear for all parties involved by accommodating this approach to project.
• Changes in design were more flexible due to having a single key contact between design and construction.
• The design was fully integrated in the construction
I got a wonderful opportunity to work for one of the best construction companies, which is Hathaway Dinwiddie. Hathaway Dinwiddie has been in construction industry for over 100 years. Back then they started as Dinwiddie construction and been a part of a lot of historic buildings in California. Hathaway Dinwiddie has an expertise in Building information modeling (BIM), Partnered delivery and lean construction, Design-Build, Quality Control, Best Value exploration, Sustainability and safety. Hathaway Dinwiddie has a history of using BIM back in 1998 and now they are using it at every stage of their projects. They use BIM to summarize quantity surveys, develop preliminary construction strategies and maintain coordination between their team and their partners. Hathaway Dinwiddie provides services like General Construction, Preconstruction, Design Build, Construction Management and Interior and special projects. Hathaway also believes in being one step ahead of its competitor and has been investing in the research and development field also.
We often focus on the many different materials and products needed to make that special architectural structure. We tend to undermine and dilute the cost and time it takes to be able to follow through and complete such a task. However, the most important thing when
With a variety of procurement routes to choose from, how can one facilitate the selection of the most appropriate construction contract and avoid situations where the owner insists on using a less appropriate one? How do we begin to focus the conversation on training, and updating efforts to create a reduced number of documents (Construction Canada, 2014)? In the next chapter this dissertation will further analyse the trends and investigate how different procurement routes naturally align themselves in certain asset classes in
The case presented is that of Sam Stevens who resides in an apartment. He has been working on an alarm system that makes barking sounds to scare off intruders, and has made a verbal agreement with a chain store to ship them 1,000 units. He had verbally told his landlord, Quinn, about his new invention and Quinn wished him luck. However, he recently received an eviction notice for the violation of his lease due to the fact that his new invention was too loud and interrupting the covenant of quiet of enjoyment of the neighbors and for conducting business from his apartment unit.
Tender documentation usually includes the Bill of Quantities, a works schedule and plan and any drawings made up by the consultants. At this stage tenders can be submitted by contractors. These tenders are submitted on a single-stage, competitive basis in order to determine a main contractor for the project. The main contractors are not responsible for the design in this case instead the client will keep the design consultants during the construction of the project as they are required to solve any design flaws that arise during the building
One of the main reasons this is such an important endeavor is due to the fact that contractor

In a highly changing environment, selecting the correct construction contract has become an essential aspect of having a prosperous project. Contracts have developed into a tool that project owners use to protect their resources and control costs. The failure of proper contract agreements in construction projects can lead the concerning parties to pay some unforeseen costs as they are needed to devote some significant amount of time, cost and efforts. Due to this reason, it becomes quite essential for management of projects to undertake some cautious consideration with the type of contract. The correct construction contract for a project can be critical to its success.

There are 25 major specialties in engineering that are recognized by professional societies. In any one of those 25 specialties, the goal of the engineer is the same. The goal is to be able to come up with a cost effective design that aids people in the tasks they face each day. Whether it be the coffee machine in the morning or the roads and highways we travel, or even the cars we travel in, it was all an idea that started with an engineer. Someone engineered each idea to make it the best solution to a problem. Even though engineer’s goals are similar, there are many different things that engineers do within their selected field of engineering. This paper will focus on the architectural field of engineering.
However, there are some disadvantages in the processes. First, it is very consume time in the pre contract process due to the strategy is sequential and construction cannot be started before the completion of design. Also, the contractor is not appointed in the design stage, so the contractor and supply chain are no input into the design or planning of the project. Mo...
Here we will discuss risk management in the construction sector and in execution of construction project, project risk management is one of the most critical phase for successful completion of the construction project. Risk can be both negative and positive for the project. Negative risks are considered as threats and positive risks are taken as opportunities.
employs the paperwork system, faxing proposals, contracts, revisions, agreements and lists of preferred suppliers, and, finally, invoices. The key to successful project management relies on procurement quality, acquiring the right materials in a timely manner, delivered to the right place with teamwork between the client and project management team. Using a variety of web-based and conventional methods, the agile process may be used to employ a matrix of responsibility to assign home office and site responsibilities, as well as matrixes for consent, oversight and approvals, request for quotes, the definitive project specifications, and contract award dates based on installation sequence of events. Integrating this information into a schedule, guarantees that nothing is handled twice. The next phase of procurement is solicitation planning, where the Internet can be used to implement the project (Wayne Hall, Procurement Online, PM Network, March 2001...
This paper examines the legal aspects of procurement management and specifically how procurement management can be used as an effective tool for the overall management of a project. This paper focuses on the basics of common contract laws, the basics of agency law, the Uniform Commercial Code (UCC), and some aspects of that pertaining to the Federal Acquisition Regulations (FAR). A summation of the company’s position in relation to a given supplier (provided the company decides not to procure all of the material in a contract) will be examined along with how that position is strengthened by understanding the legal aspects of procurement management. Finally, the paper will analyze how the project manager is supported by the contract management function. Fleming (2003) posited that there is a clear and important distinction that should be made that delineates the work of the project from the inside work of the company.
