A former Jimmy Choo employee, John Ornelas, claims that after enduring harassment and discrimination at the hands of his supervisor for being gay, he reported the problem and was fired from the Beverly Hills store in retaliation. The suit was filed in Los Angeles Superior Court on April 15th against the former employer, Jimmy Choo, and the former boss, Nikki Raffasha. The suit listed allegations of both wrongful termination and discrimination based on sexual orientation and race and seeks unspecified damages. According to the suit, Ornelas was hired in 2011 as a Jimmy Choo sales associate. The next year he started work at the Beverly Hills store located on Via Rodeo Drive. After completing a month on the job, Ornelas claims that Raffasha
started to insult and mock him regularly – often using derogatory terms describing both his race and sexual orientation. Ornelas further claims that the derogatory terms were flippantly used - even after the death of Ornelas’ partner of 12 years. Ornelas claims that multiple reports submitted regarding the alleged harassment and discrimination had no results. He saw no improvement to the situation. In October 2015, the problem escalated when Raffasha took one of Ornelas’ sales and reported as her own. Ornelas states that he confronted his boss regarding the sale and that her response was to indicate that anyone would choose her over him – referring to him as “gay, Mexican trash.” In response to this incident, management credited the disputed sale to Ornelas, but two days later he was fired from his job at Jimmy Choo. The license agreement was to expire in the year 2034 making it a 44 year term, but that all change on May 30, 2000 after Calvin Klein, Inc. filed a law suit against Warnaco Group, Inc. “for breaching its Jeanswear licensing and distribution contract and, in so doing, diluting the equity of CKI’s brand.” On this law suit the Calvin Klein company stated that the Warnaco Group, Inc. has affected the company negatively which has “including unauthorized adaptations of designs, failure to follow designer guidelines, and use of cheaper materials in production,” and they also stated that the Warnaco Group, Inc. used distribution channels that that are not in the licensing agreement, and/or that are a whole lot different price point than the retailer that Calvin Klein merchandises are usually in. Calvin Klein believed that all of these practices corrupted his brand image.

There is a scene noted by the author I found very impressive, which a black man wanted to refund two CD players, but he had been driven away and the CD players were confiscated because the manager deemed him as a thief! Our final case study features the very grey area of workplace cultural discrimination providing a scenario in which there is possible evidence of several counselors who, during lunch break, are singling out clients of a certain minority and speaking in a highly derogatory fashion about them. In this scenario we are part of the supervisory staff and the counselor who brings us this information has been in the field for half a decade and is the same race as one of the main counselors he has concerns about. He notices that he doesn’t want to work at A & P anymore. The manager at A & P comes out to address the girls for obvious reasons. He tells them that the store “isn’t the beach” and so on. They have a small disagreement where the manager tells them that they need to be decently dressed when they come in the store, but the girls feel like they are decent. The manager lets Sammy check them out so that they can hurry and get out of the store, but no one was in as much as a hurry as them. They were rushing to get out because they were embarrassed. This is when Sammy realizes he doesn’t want to work there anymore. He want to be their “unsuspected hero” and he tries to quit fast enough so that they could hear him, but they were already out walking hurrying to get out as fast as they could. Sammy quits because he could feel their embarrassment and he tells his manager that he didn’t have to embarrass them like that. The manager explains himself by saying that they were the ones who embarrassed him. I think Sammy quit because he felt that the girls shouldn’t be looked at sexually in the way they were. He thinks that the manager saw the girls as inappropriate because women are not supposed to wear these types of things outside of where they are acceptable like at home and at the pool. This had totally changed the world in creating division, such as the terms of “black white” or “wealthy poor”. Racist behaviour may be direct (overt) or indirect (covert) in particular. Direct racial discrimination is the unfair or unequal treatment of a person or a group on racial grounds. Blacks considered the N-word to be one of if not the the absolute worst and most offensive word throughout history. Why should that suddenly change because the last two letters are changed to an a? The meaning and history of the word is something of which many members of the younger generation are completely oblivious. Why should this dehumanizing, demeaning word be used freely in songs and everyday speech? In the words of Martin Luther King Jr: “We hold these truths to be self-evident: that all men are created equal.” If all men are created equal, then why should blacks be discriminated against in everyday language and in popular songs?
Title VII of the Civil Rights Act and various other federal and state laws prohibit intentional discrimination based on ancestry or ethnicity. Some employers practice blatant forms of minority discrimination by paying lower salaries and other compensation to blacks and Hispanics. Others engage in quota systems by denying promotions and jobs to individuals on the basis of race or color. Federal laws prohibit employers of 15 or more employees from discriminating on the basis of race or color. Abstract- Racial discrimination happens all the time and most of us are unaware of it. The most common place for this to happen is in the workplace. Now people can be discriminated against because of their race, religion, or any other numerous things. Also, discrimination can occur during the job interview or even after you got the job. This paper will shoe the effects of racial discrimination and how it can be prevented. In addition there are some very important laws that deal specifically with discrimination, like the NAACP or Affirmative Action. These both will be discussed.
