Explanation of Issue: On June 7th employee John Schmidt seriously injured has hand in the production shop while pushing a large piece of wood through a table saw. There is a need to determine who is responsible for the accident. Is the workplace accident a result of employee carelessness or employer negligence?
Analysis of information: The occupation safety and health act of 1970(OSHA) was passed to prevent workers from being killed or seriously injured at work. The law requires employers to provide their employees with working conditions that are free of known dangers (OSHA). In the case report the employees state that the safety guard to the table saw was poorly designed. The shop manager, David Donald was informed about the concerns that the employees had. Mr. Donald did not address, nor did he pass the information on to the foreman Harry Hiller.
In the case report it states that Mr. Hiller maintained written maintenance record for the table saw, which is required by OSH law. Maintenance logs are extremely useful for troubleshooting recurring or obscure problems, as they provide a record of all work performed on the system and may shed light on hard-to-spot interactions between seemingly unrelated symptoms(What are Maintenance Logs?). Conclusion: Both parties have a crucial role to play in workplace safety, employees are responsible for protect themselves from any harm that may occur to them by taken extra precautions and using sound judgment. Employers must maintain a safe work environment and there for they are responsibly for injuries that occur at the workplace. The system to protect the employees broke down due to the lack of communication from both parties. But it is the employer that must enforce the policies and producers and give continually give refresher safety trainings for their employees.
