The Bill of Rights Essay “Rightful liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others.I do not add ‘within the limits of the law because law is often but the tyrant's’ will,and always so when it violates the rights of the individual” -Thomas Jefferson. The Constitution was created because of the ineffectiveness of the Articles of Confederation did not simply protecting the rights of the people which the Founding Fathers was concerned about. The Constitution was a social contract was an agreement among the people in society which the people give up part of their freedom to the government for protection of their natural rights by the government. Then the Constitution was created many citizens were concerned about the new government being too powerful. Citizens was fearing that their rights were being limited. This fear led to a demand that a Bill of rights was to be added to the Constitution and once the government went ot action the first item on the agenda was the Bill of Rights to be made. The Bill of Rights purpose was to clearly state the individual rights of American citizens. All ten Amendments in the Bill of rights are significant for protecting the right of the citizens but Amendment One the freedom of speech, religion, press, and petition, the Fourth Amendment gives the protection of unreasonable search and seizure without a search warrant, and Fifth protects the accused by protecting them from self incrimination, double jeopardy, and from depriving their life, liberty, or property without due process of law. The First Amendment gives citizens many freedoms like religion and petition from the government. The fourth amendment gives privacy and freedom to citizens by protecting citizens from unreasonable searches and seizures. Amendment five gives the privilege for self incrimination and protects a citizen from double jeopardy. The Bill of Rights along with other amendments not included in the Bill of Rights has served as a social contract. The contract makes people connect to the government to prevent the government from committing and abuses towards the citizens. George Washington, the first president of the United States of America and leader of the Continental Army, said “ The constitution is the guide which I will never will abandon”- George Washington. Since the US has been living by the constitution they have been able to work effectively from time to time.
The Bill of Rights is the first ten amendments in the constitution. Both the Senate and the House of Representatives use the Bill of Rights as a benchmark for all laws. It has to do with freedom of religion, speech, assembly, and press. It also secures the right to carry a gun, protection against housing soldiers in civilian homes, and more. The Bill of Rights protects various aspects of a free life. Americans live under the protection of the Bill of Rights on a daily basis. Without it, everyone in the U.S. would live restricted lives; no one would be able to petition the government, have a speedy trials, or even be informed of charges. There would also be unreasonable
There was a short time where all was calm right after the civil war. king charles the second and his father were both dead so Charles brother took over. this is king James the secondf and he was a Catholic sao he appointed many high positions in the government. Most of his sibjects were protestant and did not like the idea of Catholicism being the religion theyd have to abide by. like his father and brother king james the second ignored the peoples wishes and ruled without Parliament and relied on royal power. an English Protestant leader wanted to take the power away from james and give it to his daughter Mary and Her husband William from the Netherlands. William saled out to the south of england with his troops but sent them away soon after they landed
After the American Revolution, America had earned it’s freedom from Britain. In order to govern this new country the Articles of Confederation was created. This document was flawed by the colonists fear of putting too much power into a central government. Knowing the document needed to be fixed a constitutional convention was called. The document created at this convention has been our constitution ever since. But even the Constitution was meet with criticism. One major concern when writing the constitution was how to protect the citizens rights. The Constitution did this through the preamble, the legislative process, the limit of presidential terms, the judicial branch, and the bill of rights.
After the Constitution was written, the new born nation was immediately split into two political sides, the federalists and the anti-federalists, over the ratification. Federalists, southern planters or people that tended to hold interest in trade, advocated a strong executive. On the other hand, anti-federalists, back country people or people involved in business but not in the mercantile economy, opposed the ratification of the constitution. The two sides, after much debate, were able to come to a compromise after the Bill of Rights was included into the Constitution.
On December 15, 1791, the Bill of Rights was ratified effective by Congress. These first ten amendments to the Constitution of the United States of America promised the states certain rights and freedoms which could not be infringed by the government. After all, the founding fathers knew from experience that men in their weakness were often tempted by power. They had become all too familiar with this when under the control of King George in England. Therefore, in order to protect the future people of their beautiful country, they promised certain liberties which could not be taken away. Every single one of these freedoms is important for the United States of America. However, the second amendment is especially important to our nation because it allows the people to protect their freedom and defend themselves and the common good against an overreaching government.
The Constitution provides the basic framework of our American Government. The Constitution established the structure of the Government and a written set of rules to stabilizes the conduct of the government . The Constitution was ratified in 1788 in Philadelphia. After long diatribe and political battle between the Federalists and the Anti-Federalists, they finally came to and Agreement. The Constitution divided the national government into three branches; Legislative, Executive, and Judicial. The government is based upon the principles of separation of powers and checks and balances even though in practice many powers and functions interchanged and are shared. In 1791 the states ratified the Bill of Rights in order to protect individuals from the power of the federal government. The 1st Ten Amendments to the Constitution involve provisions for freedom is religion, speech,, press, assembly, and petition. Through the year 2000 the Constitution has been amended twenty seven times due to interminable needs by the people.
The Bill of Rights was created as a listing of the rights granted to citizens, the Bill of Rights serves to protect the people from a powerful government. These civil rights granted to U.S. Citizens are included in the first 10 amendments to the U.S. Constitution. Additionally, Locke’s ideas about checks and balances and the division of church and state were later embodied in the U.S. Constitution as well. The Constitution replaced a more weakly organized system of government as outlined under the Articles of Confederation. John Locke was an English philosopher who lived during 1632-1704.
The Bill of Rights and Declaration of the Rights of Man and Citizen are based on the same principles of natural rights; therefore each document is similar in protecting the people's natural rights. However, despite their similarities, their differences are apparent due to the social situations in which they were adopted. The Bill of Rights stood to protect the freedoms of each individual by establishing a democratic government. The French Revolution eliminated the hierarchy of class and established equality among men with the Declaration of Rights of Man and Citizen. Several influences from past philosophers and documents assisted the frame work of the Bill of Rights and Declaration of Rights and Citizen.
The first amendment is the cornerstone of our American society founded years ago by our forefathers. Without the first amendment many ideas, beliefs, and groups could not exist today. The first amendment guaranteed the people of the United States the freedom of speech, freedom of the press, and freedom of religion, freedom of assembly, and freedom of petition. Although the first amendment guarantees us, Americans the freedom of speech, we cannot use it to cause others harm. This amendment has helped shaped Americans into what we are today, because of our right to assemble, speak freely, and worship as we please.
When the Second Constitutional Convention wrote the Constitution in 1787, there was a controversy between the federalists and the anti-federalists surrounding whether or not to have a Bill of Rights. The anti-federalists claimed that a bill of rights was needed that listed the guaranteed rights that the government could never take away from a person i.e. “inalienable rights.” A Bill of Rights was eventually deemed necessary, and has worked for over 210 years. There are many reasons why the ten amendments are still valid to this day, and the best examples are the First Amendment, concerning the freedom of religion, the Fifth Amendment, and the Sixth Amendment.

The First Amendment and the Sixth Amendment protects the individual by allowing religious and political freedom, and by promising a public and speedy trial. The Fourth Amendment protects the individual’s privacy and limits the reach of the government into people’s homes and personal belongings. The three essential Amendments from the Bill of Rights are: the First Amendment- Religious and Political freedom: the Fourth Amendment- Search and Seizure: and the Sixth Amendment-Criminal Court Procedures.

The Bill of Rights was created because the states believed that the federal government would have too much power and they wanted to have more individual rights. Around this time the colonies had just been under the British rule, which oppressed the people and give them very limited freedoms. The states or the colonies were kind of afraid that this would happen all over again within this new government forming in the form of the Constitution. Most of the state at this time believed that the Constitution alone was enough but others felt that they needed more assurances. In the end, the federal government complied with these states and gave them the Bill of Rights.
The first amendment states every United States citizen has the right to press, petition, assembly freedom of religion, and freedom of speech. Also, the amendment states the government is not allowed to make any law that breaks the rights of a citizen. In the case, Tinker v. Des Moines School District (1969), the argument was if the students’ first amendment was violated, but the public schools are not an appropriate place to express freedom of speech.
While we have a constitution that lays out our clear cut civil liberties and all the rights we possess, other countries chose to restrict those freedoms. Due to the many advantages the Constitution gives each American citizen, the US has been able to keep this document intact as long as they have while other countries have to constantly restructure their government principles. This stability leads to greater efficiency in our legislative process and a strong sense of national pride. For a nation filled with differences and mixed opinions, the Constitution is a perfect fit. It was written as unbiased as possible to ensure that it was not limiting anyone or anything, instead, giving each citizen the ability to keep their government in check and grant freedom to everyone. During the time the document was written was when the Colonist knew exactly what it felt like to live in a world of oppression and unjust government. As a result, Madison and the other leaders at the time made it a goal to put the power in the hands of the people and make freedom an utmost priority. With an Unbiased approach to government that gives no advantage to one group or another, and with amendments that only help citizens take control, the Constitution is what the early colonist left Europe and died
