According to Congress, Indian Gaming Regulation Act (IGRA) was created in 1988 as a way of helping tribes from falling below the poverty level. The goal of IGRA is to use gaming as a mean of “[promoting] tribal economic development, self-sufficiency, and strong tribal government,” while ensuring that gaming is conducted fairly and honestly. Since its establishment, hundreds of tribes are able to negotiate an agreement with the governments to operate casinos on reservation lands (“Gaming Tax Law and Bank Secrecy Act Issues for Indian Tribal Government”). Although Congress says that the real purpose of IGRA is to allow Indians to open casinos, it is merely a set of laws that limits the tribe’s right on gaming.
The views of IGRA are differed among the Native Americans and the non-natives. To many American, IGRA is a compromise between the American government and the tribal government because it enables tribes to support themselves, while it meets the Congress’ intention of opening more jobs to control poverty-related crimes. According to a survey by the National Indian Gaming Association (NIGA) in 2006, as much as 75% of Americans believe that Indian benefits from gaming (The Economic Impact of Indian Gaming in 2006). “The federal National Indian Gaming Commission (NIGC) reported that the Indian gaming industry generated $16.7 billion in revenue in 2003,” and has created over 550,000 jobs (Light and Rand, 85). Even though there is only a small change in the number of crimes as a result of casinos, it is enough to conclude that “crime rates were reduced, but not in an overwhelming way” (Light and Rand, 97). Tribes may spend gaming revenues only for five general purposes: to fund tribal government services, operations and programs, to promote tribal general welfare, to promote tribal economic development, to make charitable donations, and to help fund local government agencies (The Economic Impact of Indian Gaming in 2006). They are also required to pay tax as a condition of the tribal-state compact. Most of the payments are based on the percentage of gaming revenue. From silver and money capitalism to piracy, slavery and the birth of corporations, the food revolution, agricultural technology, the culinary revolution, drugs, architecture and urban planning our debt to the indigenous peoples of America is tremendous. With indigenous populations mining the gold and silver made capitalism possible. Working in the mines and mints and in the plantations with the African slaves, they started the industrial revolution that then spread to Europe and on around the world. They supplied the cotton, rubber, dyes, and related chemicals that fed this new system of production. They domesticated and developed the hundreds of varieties of corn, potatoes, cassava, and peanuts that now feed much of the world. They discovered the curative powers of quinine, the anesthetizing ability of coca, and the potency of a thousand other drugs with made possible modern medicine and pharmacology. The drugs together with their improved agriculture made possible the population explosion of the last several centuries. They developed and refined a form of democracy that has been haphazardly and inadequately adopted in many parts of the world. They were the true colonizers of America who cut the trails through the jungles and deserts, made the roads, and built the cities upon which modern America is based.

By allowing the Indians to self govern it encouraged an economic foundation for the inhabitants of Indian reservations. Unfortunately only a few tribes have fully taken advantage of this act, while others continue to struggle for survival.
While the restorative justice movement has risen in recent years, the idea of circle sentencing, or peacemaking circles has been practiced in indigenous cultures for quite some time. As we look at implementing traditional indigenous culture practices as alternative dispute resolutions, we need to realize the effectiveness and also whether we are ready to use them. The Yukon and other communities reintroduced circles in 1991 as a practice of the restorative justice movement (Bazemore, 1997, p.27). Around that same time, Minnesota made the breakthrough in borrowing the practices with each band of Native Americans having their own political communications. Because Minnesota has seven Anishinaabe tribes and four Dakota communities, it has been one of the first states to lead the way for this new program. A circle sentencing program has also been implemented in North Minneapolis for African-American juvenile problems (Ulrich, 1999, p. 425).

The US government’s official role in Indian affairs began as far back as the Continental Congress (1786) when the Indian tribes were still considered independent nations with whom the settlers had to make treaties (Jackson 1). The purposes for these interactions were to buy land and to keep peace between encroaching settlers and natives.
Historical trauma has brought psychological effects on the Native American community. Many suffer from alcohol and drug abuse, depression, and poverty. I wondered why they do not get help from the government and after watching the documentary California’s “Lost” Tribes I began to understand that in any reservation the tribe is the government, so they do not have the same rights as a city outside the reservation. Many of the the reservations were placed in areas where they could not do any form of agriculture, so they did not have a source of income. Many of this reservations have to find ways to get themselves out of poverty and many of the reservations within California have found a way to get out of their poverty by creating casinos
Although poverty rates on some reservations are getting better because of gambling enterprises and natural resources, most reservations have unusually high poverty rates. In 2000, the poverty rate of the entire United States was about 11.3%. Compare that to a 25.9% poverty rate for Native Americans living on reservations. The poverty rate of Native Americans in 2000 was higher than the peak of the poverty rate of the Great Depression, which was 21.7% (Native American Statistics”). This statistic alone shows that Native Americans are not doing well financially.

With the exception of a few tribes who were fortunate enough to retain allotments rich with natural resources, the reservation system did nothing but hurt Native Americans. It not only stripped them of their traditional ways of life but it also separated many people from their families.
