c) Changing – for better or for worse
The institution of traditional leadership is considered an organ of state , which implies that they therefore have to comply with the Constitution. This entails that “certain customs will have to change and certain specific customary powers are now superseded or limited.” Yet, there seems to be a trend of throwing out the baby with the bathwater when we attempt to modernise customary law and traditional leadership. The recent laws that were introduced with regards to traditional leadership introduces a fair amount of stiffness, rather then allowing for the active development of traditional leadership. Two of these new laws that are at the centre of the government’s attempts to align traditional leadership with our new democratic values is the Traditional Leadership and Governance Framework Act and the Communal Land Rights Act . These Acts remain a challenging predicament, as they do not allow or provide for the transformation of traditional leadership to serve the new democracy.
CHAPTER 6 – SECURING THE FUTURE
a) The future of Traditional Leadership and the responsibility of securing it
In accordance with the traditional way of life, people are custodians of traditions and customs. Historically, these customs were not written down, but passed down from generation to generation, by word of mouth and mostly incorporated in stories told by the elders. Traditional leaders have an enormous role to play in being custodians of these customs and traditions, as they play an important role in the lives of the members of their communities.

At an undetermined point in the history of man, a people, while still in the state of nature, allowed one person to become their leader and judge over controversies. This was first the patriarch of a family, then the wisest or fittest militarily of a tribe. These leaders ruled by wisdom and discretion, though neither they nor their followers were subject to any ratified laws. It is true of Africa that women constitute a treasure that remains largely hidden. (Moleketi 10) African women grow 90% of all African produce, and contribute about 70% of Africa’s agricultural labor every year. (Salmon 16) Both the labor and food that are provided by African women go towards the increase in Africa’s Gross Domestic Product (GDP). (Moleketi 10) Although African women are feeding the majority of Africa’s inhabitants, the constricting ropes of gender inequality are still holding them back from being appreciated and living up to their full potential. Outstandingly, women such as President Ellen Johnson Sirleaf, of Liberia, have gladly accepted the challenge of breaking free of these ropes. The history of women’s rights in Africa, the glass ceiling, and the modern aspects of women’s rights, all play prominent roles in the overall condition of women’s rights in Africa. Until the day arrives that these discriminatory injustices are corrected, individuals in African nations will continue to struggle.
Many people associate leadership with a specific job title or form of power within an organization. However, through personal experience, I have concluded that leadership can come in many forms and position as well as from multiple sources of roles and job titles both with and without power.
