In the constitution we the people are guaranteed certain rights. Those rights include life liberty and the pursuit of happiness. These are guaranteed to the people as long as we follow the laws of the land. There are twenty-seven amendments to the United States constitution. The most important one in my opinion, is the first one. It states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.” (Constitutional Topic: Student Rights - The U.S. Constitution Online - USConstitution.net). Although these rights apply to everyone, they seem to lack in public schools. Some questions regarding this topic are why don’t these rights apply to students, is the reasons for limited rights to secure the rights for students to learn in a safe environment. I intend to prove that some students’ rights are being violated and suppressed my administration in public schools. There are exactly ten rights that are guaranteed to us, the people. Yet I believe that freedom of speech is one of the most important rights guaranteed to us. It allows us to say things about the government that we disapprove of and it should be allowed in schools. I understand the administration has to be able to create a safe learning environment for students, but what if the obscenities are not disrupting class, like in the hallways, or at lunch. These are places where students are allowed to vent and speak in way that allows them to relax for the time that they have. In December 1965, a group of students from Des Moines, Iowa met at Christopher Eckhardt’s home in order to plan a protest. During the meeting, the students planned to wear black armbands throughout the holiday season to show public support for a truce in the Vietnam War. However, the principal of the school got word of the planned protest and quickly established a policy that stated any student wearing an armband would be asked to remove it. If they refused to do so, it would result in suspension. On December 16, 1965, the protest began and students Mary Beth Tinker and Christopher Eckhardt wore their armbands to school and were sent home. The following day John Tinker experienced the same result by wearing his armband as well. All three students
Total freedom does not exist. Being American has made some people believe that they have the freedom to do whatever they want, but this isn’t the case. In this day and age students are free to use texting, social media, and they also have access to various other things on the internet. Some students use these resources responsibly and do not abuse these methods, but on the other hand some students use these resources immaturely and usually cause great dilemmas that can extend to their school life. Consequently, schools should be allowed to limit students’ online speech because cyberbullying can cause widespread problems among both students and teachers, it disrupts learning, and it violates students’ civil rights.
While students have First Amendment rights, there are still some things that the school is allowed to control. Censorship in school is important because it can minimize distractions and other behavioral problems. It also gives parents peace of mind and students the feeling of security. It is also important for a student to be able to express themselves. People express themselves in different ways, and they have the constitutional right to do so whether they’re on school grounds or not. Censorship is a very controversial issue and should not be taken lightly. There are many things to consider when censoring, and it’s important to have balance between censorship and freedom in schools.
The Fourth Amendment to the constitution protects United States citizens from unreasonable searches and seizures. Our forefathers recognized the harm and abuses that occurred in the colonies to innocent people by the British, and they made sure to write protections into the U.S. Constitution. Fearing the police state that any nation has the potential to become and recognizing that freedom and liberty is meaningless when victimization by the police is a real and foreboding threat the Fourth Amendment was created. The Fourth Amendment has gone through many challenges and controversies in the past, and currently the issue of how the Fourth Amendment applies to students in public schools has come to be contended in the courts. While it is apparent to me that the Fourth Amendment should be no less applicable in schools than in the general society these essential Constitutional protections have been under fire in recent years and many rights have been taken away from students.
Benjamin Franklin once said, “Without freedom of thought, there can be no such thing as wisdom; and no such thing as public liberty, without freedom of speech.” Indeed, free speech is a large block upon which this nation was first constructed, and remains a hard staple of America today; and in few places is that freedom more often utilized than on a college campus. However, there are limitations to our constitutional liberties on campus and they, most frequently, manifest themselves in the form of free speech zones, hate speech and poor university policy. Most school codes are designed to protect students, protect educators and to promote a stable, non-disruptive and non-threatening learning environment. However, students’ verbal freedom becomes limited via “free speech zones.” Free Speech Zones are areas allocated for the purpose of free speech on campus. These zones bypass our constitutional right to freedom of speech by dictating where and when something can be said, but not what can be said.
Since this country was founded, we have had a set of unalienable rights that our constitution guarantees us to as Americans. One reason why schools shouldn't limit students' online speech is that students have the freedom of speech which says that they can express themselves and have their own opinion.
In December 1965, an issue was caused by teachers’ in violating students’ freedom of speech. In December some students from Des Moines Independent Community School District, in Iowa were suspended for wearing black armbands to protest against the American Government’s war policy in support Vietnam (Richard, Clayton, and Patrick).The school district pressed a complaint about it, although the students caused no harm to anyone. Students should be able to voice their opinions without the consequences of the school district.

Earlier this month in April, student protestors rioted at Berkley University because they did not want certain Conservative guest speakers to be able to give speeches at the university due to some of the speakers comments being inappropriate. According to the nonprofit organization committed to defending civil liberties named The Foundation for Individual Rights in Education (FIRE), "One worrisome trend undermining open discourse in the academy is the increased push by some students and faculty to 'disinvite' speakers with whom they disagree from campus appearances" (The Foundation for Individual Rights in Education). While the protesters were practicing their first amendment right to petition, the students were infringing upon the Conservative speakers freedom of speech which is unconstitutional. Just because the protesters may have disagreed with the speakers comments, does not mean that theys hould have prevented them from being able to express them. In the United States, free speech is protected by the First Amendment in which it states, “Congress shall make no laws respecting an establishment of religion … or abridging the freedom of speech.” Now, nearly 250 years into the future, the exact thing that the Founding Fathers were afraid of is starting to happen. Students’ rights in schools are limited or just taken away. Kids are forced to do whatever the officials at their school, either the principal or the teachers, tell the students to do. One of the main right that gets taken away or limited is students’ first amendment rights, which is the freedom of expression. Students can gets suspended by just doing things the staff at the school does not like, including saying things that they don 't like or supporting a religion that the school does not support. No argument shall take place against amendment one, amendment two, and amendment four because they apply in daily lives of all citizens. All citizens should freely speak their mind without disturbing public education. Citizens should remember about the National Firearms act before buying any firearms and getting a militia type gun or a shotgun with an eighteen inch barrel. Officers are required to have a search warrant before entering a citizens home, but school officials need a reasonable reason before searching a student’s belongings. School officials and students also should remember the exclusionary rule. The Bill of Rights and all other amendments served every citizen like a forever helping friend. The Supreme court plays its role to make decisions for cases that act as role models for other citizens and in the future.
Education is a elemental human right and essential for all other human rights. It is a powerful tool by which socially and economically marginalized children and adults can lift themselves out of poverty. It also consists of the right to freedom of education. Freedom of education is the right given to human beings to have access to the education of their preference without any constrictions. Right to education is a human right recognized by the United Nations. It includes the entire compulsion to eliminate inequity at all levels of the educational system.
