Daniel Zwerdling stated “If a fifteen year old and thirty year old commit the same, awful rape and murder, why shouldn’t society treat them the same?”. (“Should Juveniles Be Tried As Adults?”) The effect of a juvenile committing a murder and an adult committing a murder is the same. Juveniles committing high crimes should be judged as an adult and treated rightfully so with longer, more strict sentencings. When deciding whether or not a child should be tried as an adult one should look at the circumstances, the pros and the cons of convicting a minor as an adult.
There are a few circumstances to look at before trying a minor as an adult, it can be age, severity of the crime and even just looking at state laws. Firstly, the age where a child can be held responsible for committing a heinous crime has been debated throughout history. Laws state that children under seven were considered incapable of criminal intent. (“Adult time for adult crime.”). Later on it was determined that twelve year olds are too immature to be fully responsible for their actions (Brink.). Secondly, children who commit severe crimes should be judged as adults. Youths who commit high profile crimes such as second degree murder, first degree manslaughter, rape or attempted rape should be prosecuted rightfully so (Jones). Lastly, depending on the state there can be five ways a juvenile can be tried. The first way adolescents can be tried is by using a “once an adult, always an adult” mandate. This mandate states that any juvenile who was once convicted as an adult must now be tried in adult court even if the crime was low profile (Tang). If a juvenile commits a higher crime, they should be tried as an adult. The face of an american criminal is changing. Nowadays, it bears the face of a young, assumed innocent child. The faces are five Brooklyn boys, aged 14 to 18, charged with the brutal rape and assault of a 43-year-old jogger. It is two 12 year old girls who brought their friend into the woods to sacrifice her to “Slenderman”. It is two seven year old from Indianapolis who dragged a first-grade girl into a restroom and raped her. The face of the American criminal is transforming from a 50 year old to the gentle faces of the nation’s youth (LaVelle). A serious crime deserves a serious punishment.
