Same Sex Marriage Should Be Legal

In this paper, I argue that same-sex marriage should be maintained legal in Florida. Furthermore, same-sex couples should have the ability to adopt children and have parenthood privileges. I argue that marriage is a civil right reflected in the United States Constitution and that the quality of parenting should not be determined according to sexual orientation.
Same-sex marriage critics claim that SSM is against Christian religious beliefs and should be maintained as the union between a man and a woman. They argue that procreation is a biological nature only heterosexual couples have and because of that, married same-sex couples should not be allowed to have children. Likewise, critics believe that married same-sex couples raising children will also affect the child’s behavior and mental health.
Same Sex marriage advocates support the legal union of homosexual and their partnership privileges. Same sex marriage is a debating issue at the Supreme Court; however, advocates claim that the Unites States Constitution and the Bill of Rights protect people from choosing their partnership freely. They argue that marriage is the union between two people in love, regardless of their gender, color or religion. The Supreme Court decision in 1857 prohibited African Americans from being recognized citizens, which deprived them of their rights. Similarly, denying same-sex couples the right to marriage eliminates their civil rights. The Fourteenth Amendment explicitly protects people’s rights to life, liberty and the pursuit of happiness. Justice Anthony Kennedy explains that “the reasons marriage is fundamental under the Constitution apply with equal force to same-sex couples” (Bier). Nonetheless, a comprehensive, organized and responsible person does not necessarily need to be heterosexual. The quality of a parent should be measured by how well are the parents prepared to take care of the child and the social environment in which they will be raised.
In conclusion, sexual orientation should not be a constraint for the person to be married or form a family. Children benefit from unions in which the parents are loving and care to provide for them a safe environment. The parents’ sexual orientation does not interfere with these parameters and society should not restrict or discriminate them for being different. As Alex Neil said: “Marriage is about love, not gender.”
