In this paper, I argue that same-sex marriage should be maintained legal in Florida. Furthermore, same-sex couples should have the ability to adopt children and have parenthood privileges. I argue that marriage is a civil right reflected in the United States Constitution and that the quality of parenting should not be determined according to sexual orientation.
Same-sex marriage critics claim that SSM is against Christian religious beliefs and should be maintained as the union between a man and a woman. They argue that procreation is a biological nature only heterosexual couples have and because of that, married same-sex couples should not be allowed to have children. Likewise, critics believe that married same-sex couples raising children will also affect the child’s behavior and mental health.
Same Sex marriage advocates support the legal union of homosexual and their partnership privileges. Same sex marriage is a debating issue at the Supreme Court; however, advocates claim that the Unites States Constitution and the Bill of Rights protect people from choosing their partnership freely. They argue that marriage is the union between two people in love, regardless of their gender, color or religion. The Supreme Court decision in 1857 prohibited African Americans from being recognized citizens, which deprived them of their rights. Similarly, denying same-sex couples the right to marriage eliminates their civil rights. The Fourteenth Amendment explicitly protects people’s rights to life, liberty and the pursuit of happiness. Justice Anthony Kennedy explains that “the reasons marriage is fundamental under the Constitution apply with equal force to same-sex couples” (Bier). Nonetheless, a comprehensive, organized and responsible person does not necessarily need to be heterosexual. The quality of a parent should be measured by how well are the parents prepared to take care of the child and the social environment in which they will be raised.
In conclusion, sexual orientation should not be a constraint for the person to be married or form a family. Children benefit from unions in which the parents are loving and care to provide for them a safe environment. The parents’ sexual orientation does not interfere with these parameters and society should not restrict or discriminate them for being different. As Alex Neil said: “Marriage is about love, not gender.”
Gay marriage further damages the connection between marriage and parenthood by causing people to not consider marriagement just to be a parent. The constitutional right of gay marriage is a hot topic for debate in the United States. Currently, 37 states have legal gay marriage, while 13 states have banned gay marriage. The two essays, "What’s Wrong with Gay Marriage?" by Katha Pollitt and "Gay "Marriage": Societal Suicide" by Charles Colson provide a compare and contrast view of why gay marriage should be legal or not. Pollitt argues that gay marriage is a constitutional human right and that it should be legal, while Colson believes that gay marriage is sacrilegious act that should not be legal in the United States and that “it provides a backdrop for broken families and increases crime rates” (Colson, pg535). Both authors provide examples to support their thesis. Katha Pollitt provides more relevant data to support that gay marriage is a constitutional right and should be enacted as law in our entire country, she has a true libertarian mindset.
Nontraditional gender socialisation can help the child develop a more complete understanding of their personality, that takes both their feminine traits and masculine traits into consideration. This can be illustrated by Jeremy telling his mother that he got to be “a complete person” (Bem, 1998, p. 190), when asked how his upbringing enhanced his life. Further this type of parenting allows the child to be more analytical of traditional gender roles and how they might be present and potentially affect their lives. This can make them more aware of them, and could help them avoid or fight against negative effects that might arise from their presents. This can often be advantageous. For some background, this case escalated to the Supreme Court since several groups of same-sex couples from different states, sued state agencies when their marriage was refused to be recognized. As it escalated through appeals, the plaintiffs argued that the states were violating the Equal Protection clause and the Due Process Clause of the Fourteenth Amendment. Equal Protection, according to the Constitution refers to the fact that, “any State [shall not] deprive any person of life, liberty, or property, without due process of law…” (23). The opposition of this case was that, 1) The Constitution does not address same-sex marriage as a policy, and 2) The sovereignty of states regarding the decision. Ultimately, and according to the Oyez project, the Court held that “[the Amendment] guarantees the right to marry as one of the fundamental liberties it protects, and that analysis applies to same-sex couples,” and therefore, same-sex marriage is a fundamental liberty.
In recent years, same-sex relationships have become more encompassing in US society. State legislation is changing such as accepting gay marriages, enforcing anti-discrimination laws, and legal gay adoptions; the lesbian, gay, bisexual, and transgender community is becoming public. Gay-headed families, like heterosexuals, are diverse and varying in different forms. Whether a created family is from previous heterosexual relationships, artificial insemination, or adoption, it deserves the same legal rights heterosexual families enjoy. Full adoption rights needs to be legalized in all states to provide a stable family life for children because sexual orientation does not determine parenting skills, children placed with homosexual parents have better well-being than those in foster care, and there are thousands of children waiting for good homes.
This problem or issue is one that is proving to be a bigger one than many people most likely expected. In Today’s more liberal society, homosexuality seeing more acceptance than ever before. Homosexuals and heterosexuals alike have parental instincts and are as interested in beginning families and raising children. A family should be based on love and trust, if these two elements are present in a relationship, homosexual or heterosexual, there would be no reason that the environment the couple creates for a child would be bad. Some say the homosexual lifestyle revolves only around sex, which of course is the most inappropriate subject for a child. (White) For the most part, parents and adults keep what happens behind closed doors, private, therefore, there would be no reason for a homosexual person to flaunt their sex life, especially in front of a child.

There are news reports from across America telling about how a gay person was beaten or killed just because they were looked at as different. Some of these people would end up the target of verbal abuse and maybe even physical abuse, just because some heterosexual people see them as different.
