Parallels in Washington Irving's Rip Van Winkle and America's War of Independence
The story of Rip Van Winkle is well known throughout American culture. As one of America's most popular short stories, few school children have not heard of Rip Van Winkle's twenty-year slumber or imagined his long, gray beard. In the telling and re-telling of this mysterious tale, the original context of the story itself has, for the most part, been forgotten. Few Americans are aware of how the story originated, and in what context it was first presented to the public. "Rip Van Winkle" first appeared as a part of Washington Irving's The Sketch Book. This was a collection of various short works, ideas, thoughts, and pictures. "Rip van Winkle" was only a part of this collection, but eventually gained a great deal of popularity in its own right. When considering this story, it is important to keep in mind the original context and its relation to other works within The Sketch Book. However, as "Rip Van Winkle" has stood on its own in American culture, there is also a place for examining the story apart from The Sketch Book. When doing this, certain symbolism becomes apparent. Washington Irving uses symbolism in "Rip Van Winkle" to relate Rip's life and experiences to the situation of the American colonies in relation to Great Britain and the War of Independence.
In this interpretation of the symbolism in "Rip Van Winkle", the marriage between Rip Van Winkle and Dame Van Winkle represents the union between the American colonies and Great Britain. The Juvenile Justice system, since its conception over a century ago, has been one at conflict with itself. Originally conceived as a fatherly entity intervening into the lives of the troubled urban youths, it has since been transformed into a rigid and adversarial arena restrained by the demands of personal liberty and due process. The nature of a juvenile's experience within the juvenile justice system has come almost full circle from being treated as an adult, then as an unaccountable child, now almost as an adult once more.

The focus of the juvenile justice system is to rehabilitate juvenile offenders, rather than to imprison and punish like the systems adult counterpart. According to Caldwell (1961) the juvenile justice system is based on the principle that youth are developmentally and fundamentally different from adults. This has lead to the development of a separate justice system for juveniles that was initially designed to assist troubled juveniles providing them with protection, treatment, and guidance. When performing as it is designed and up to the initial intentions, the juvenile court balances rehabilitation (treatment) of the offender with suitable sanctions when necessary such as incarceration. According to Mack (1909) the focus of the juvenile justice system has shifted from “how can we help the child”, “why did the child commit the crime” to “was the crime committed”. According to Griffin (2008) in some cases juveniles may be required to be “transferred” to adult court. The prerequisites for transfer to adult court are the duty to protect the public from violent youths, serious crime, and the lack of rehabilitation chance from the juvenile court. According to Flesch (2004) many jurisdictions handle the issue of serious juvenile crime by charging juveniles as adults. Charging a juvenile as an adult is done by a method which is called waiver to adult court. This waiver allows adult criminal court to have the power to exercise jurisdiction over juveniles and handle the juvenile’s case as an adult’s case would be tried. In Irving’s story, Dame Van Winkle was depicted negatively by Rip. Her concerned were primarily in the wellbeing of the family and in the absence of Rip, she was forced to take on more responsibilities at home raising and providing for her family which in turn led her to become bitter towards Rip, who seemed to busy helping everyone else. Her constant nagging resulted in Rip voyaging off to the mountains
When our thoughts turn to the criminal justice system it is only a natural instinct to assume everyone associated with policing, courts, and corrections will have to deal with juveniles sometime in their career. Irving composed the story in light of the American individuals at time when society has changed drastically due to American Revolution. The analogies of Irving's Rip Van Winkle cover an array of Revolutionary encounters: America before English enforcement, early American provinces under English principle, and after the American Revolution. He suggests that there is an immense contrast which leads Rip astonished, to know he is in some other time. This could symbolize the American's perspective on their new home.
Washington Irving and Edgar Allan Poe were both writers who exemplified the writing style of the Romantic era. Both writers used their great talents to take the reader into the story. For example, Irving, in “Rip Van Winkle”, starts the story by saying, “Whoever has made a courage up the Hudson must remember the Kaatskill Mountains.” He also involves the reader in the story by taking us into the everyday lives of the Van Winkles and goes into some detail describing Rip’s “business”. Poe also demonstrates his ability to pull the reader into the story. In “The Fall of the House Usher” he uses extensive descriptions of the settings to give the reader the feeling of being there while the story is developing around them. The writers are also similar in the use of tone in their works. Irving’s use of tone in his stories is typically lighthearted, yet dramatic. This is demonstrated in “Rip Van Winkle” when Rip comes back from the “Kaatskills” and is talking to all the people in the town. There, he finds his son and daughter and asks, “Where’s your mother?” By asking this question, Irving implies both curiosity and even fear if Dame Van Winkle is still around. Simply defined, happiness is the state of being happy. But, what exactly does it mean to “be happy?” Repeatedly, many philosophers and ideologists have proposed ideas about what happiness means and how one attains happiness. In this paper, I will argue that Aristotle’s conception of happiness is driven more in the eye of ethics than John Stuart Mill. First, looking at Mill’s unprincipled version of happiness, I will criticize the imperfections of his definition in relation to ethics. Next, I plan to identify Aristotle’s core values for happiness. According to Aristotle, happiness comes from virtue, whereas Mill believes happiness comes from pleasure and the absence of pain. Ethics are the moral principles that govern a person’s behavior which are driven by virtues - good traits of character. Thus, Aristotle focuses on three things, which I will outline in order to answer the question, “what does it mean to live a good life?” The first of which is the number one good in life is happiness. Secondly, there is a difference between moral virtues and intellectual virtues and lastly, leading a good life is a state of character. Personally and widely accepted, happiness is believed to be a true defining factor on leading a well intentioned, rational, and satisfactory life. However, it is important to note the ways in which one achieves their happiness, through the people and experiences to reach that state of being. In consequence, Aristotle’s focus on happiness presents a more arguable notion of “good character” and “rational.”
In “Rip Van Winkle” by Washington Irving he writes about a simple man, Rip Van Winkle, who does just enough to get by in life. He lives in a village by the catskill mountains, and is loved by everyone in the village. He is an easy going man, who spends most of his days at the village inn talking with his neighbors, fishing all day, and wandering the mountains with his dog to refuge from his wife the thorn on his side. On one of his trips to the mountains Rip Van Winkle stumbles upon a group of men who offer him a drink, and that drink changes everything for Van Winkle. This paper will discuss the history of the juvenile justice system and how it has come to be what it is today. When a juvenile offender commits a crime and is sentenced to jail or reform school, the offender goes to a separate jail or reforming place than an adult. It hasn’t always been this way. Until the early 1800’s juveniles were tried just like everyone else. Today, that is not the case. This paper will explain the reforms that have taken place within the criminal justice system that developed the juvenile justice system.
In Washington Irving’s “Rip Van Winkle,” an allegorical reading can be seen. The genius of Irving shines through, in not only his representation in the story, but also in his ability to represent both sides of the hot political issues of the day. Because it was written during the revolutionary times, Irving had to cater to a mixed audience of Colonists and Tories. The reader’s political interest, whether British or Colonial, is mutually represented allegorically in “Rip Van Winkle,” depending on who is reading it. Irving uses Rip, Dame, and his setting to relate these allegorical images on both sides. Irving would achieve success in both England and America, in large part because his political satires had individual allegorical meanings.
What is important to understand in terms at the difference between the juvenile and adult system is that there is a level of dependency that is created tween the two and the juvenile system focuses on how to help rather than in prison individuals at such a young age. However, it usually depends on the type of crimes that have been committed and what those crimes me for the families and how they impact of the greater society. The adult system distinguishes between dependence and delinquency mainly because there was a psychological transition that occurs with juveniles that is not always a predictor of a cyclical life of crime. However, if an adult is committed to the justice system there can be a dependency of delinquency and a cycle of crime that is more likely to be sustained at that age and level of cognitive ability then in comparison to a juvenile. Rip Van Winkle tells the story of a man who, on a trek into the Kaatskill mountains, mysteriously sleeps away twenty years of his life during the Revolutionary War. When he returns home, he finds that things have dramatically changed; King George no longer has control over the colonies, and many of his friends have either died or left town. At this point, the story reaches its climax, where Van Winkle realizes that his life may be forever changed.
