Overcrowding: a crisis in California
“Without health life is not life; it is only a state of languor and suffer – an image of death”, the eminent sage Buddha once said. Whether or not we want to accept it, he was right. This is a quote that reflects the system of imprisonment that currently resides in our society. Prison overcrowding is a conflict in our world today that has been going on for a few decades and no significant solutions have been successful in showing any remarkable effect on the numbers. Take a look at Figure A. We can see that more than half of the countries listed are operating at over capacity while the remaining portion is operating at under capacity. Even these select countries running at under capacities are still relatively high. Personally, it seems ironic that many of these countries are quite fully developed and still running at over capacities (e.g. Britain and France). This reflects our society today: the criminal justice system finds ways to put people not suited or illegitimately reasoned to be sentenced to prison and behind bars.
History of overcrowding dates back to the Civil War, when former African American slaves, many of whom were deemed as criminals in the South, were kept in prisons. During the time, the motive was to hold and gain the possession of a convict in order to give the state the opportunity to make money (yet, who’s to say that the current prison system isn’t operating under the same motive – but I digress). Majority of the crimes that gave these former slaves the status of “convict” were often minor charges such as public drunkenness or alleged theft, but still was considered enough to put them behind bars. Officially known as Habitual offender laws; “Three Strikes” laws have become common place in 29 states(Chern) within the United States and the Federal Court system; these laws have been designed to counter criminal recidivism by incapacitation through the prison system. The idea behind the laws were to maximize the criminal justice systems deterrent and selective incapacitation effect, under this deterrence theory individuals would be dissuaded from committing criminal activity by the threat of state imposed incarceration. Californians voted in the “three strikes” law (proposition 184) on March 7 1994 by a 72% vote with the intention of reducing crime by targeting serious repeat offenders with long term incarceration thereby eliminating the ability to commit another offense.

The majority of prisoners incarcerated in America are non-violent offenders. This is due mainly to mandatory minimum sentencing laws, which is a method of prosecution that gives offenders a set amount of prison time for a crime they commit if it falls under one of these laws, regardless of their individual case analysis. These laws began in the 1980s, when the use of illegal drugs was hitting an all time high (Conyers 379). The United States began enacting legislature that called for minimum sentencing in an effort to combat this “war on drugs.” Many of these laws give long sentences to first time offenders (Conyers). The “three strikes” law states that people convicted of drug crimes on three separate occasions can face life in prison. These laws were passed for political gain, as the American public was swept into the belief that the laws would do nothing other than help end the rampant drug crimes in the country. California has one of the most dysfunctional and problematic prison system in US. Over the last 30 years, California prison increased eightfolds (201). California Department of Correctional and Rehabilitation (CDCR) does little to reform prisoners and serve as human warehouse rather than a correction institution. California's prison system fails the people it imprisons and society it tries to protect. In many cases, California's prison system exacerbates the pre-existing problems and aids in the formation of new problems for prisoners. This paper discuses the criminogenic effects of overcrowding, and reduction/elimination of programs and how it negatively affects California and the ballooning prison population and possible remedies.
“It is said that no one truly knows a nation until one has been inside its jails. A nation should not be judged by how it treats its highest citizens, but its lowest ones” (Nelson Mandela, 1994). The United States of America has more people behind bars than any other country on the planet. The prisons are at over double capacity. It cost a lot of money to house prisoners each year. A large number of the prisoners are there because of drug related offenses. There are prisoners who have been sent to prison for life for marijuana related drug offenses. Many prisoners have been exonerated after spending many years behind bars due to the corruption in our legal system. 32 States in United States of America still execute prisoners even though there is no evidence to suggest that capital punishment is a deterrent. Prison reform is needed in America starting at the legal system and then ending the death penalty.

Today there is a growing awareness of repeat offenders among society in reference to crime. Starting around 1980 there was noticeable increase in crime rates in the U.S.. In many of these cases it was noted that these individuals were in fact repeat offenders. So, on March 7, 1994 California enacted the Three-Strikes and You’re Out Law. This laws and other laws like it are currently being utilized today all around the Untied States. This law was first backed by victim’s rights advocates in the state to target habitual offenders. The reason California holds the most importance on this law is due to the fact that it has the largest criminal justice system in America, and it has the most controversy surrounding this law in particular.(Auerhahn, p.55)
Overcrowding is one of the predominate reasons that Western prisons are viewed as inhumane. Chapman’s article has factual information showing that some prisons have as many as three times the amount of prisoners as allowed by maximum space standards. Prison cells are packed with four to five prisoners in a limited six-foot-by-six-foot space, which then, leads to unsanitary conditions. Prisons with overcrowding are exposed to outbreaks of infectious diseases such as, tuberculosis and hepatitis.
Overcrowding in our state and federal jails today has become a big issue. Back in the 20th century, prison rates in the U.S were fairly low. During the years later due to economic and political factors, that rate began to rise. According to the Bureau of justice statistics, the amount of people in prison went from 139 per 100,000 inmates to 502 per 100,000 inmates from 1980 to 2009. That is nearly 261%. Over 2.1 million Americans are incarcerated and 7.2 million are either incarcerated or under parole. According to these statistics, the U.S has 25% of the world’s prisoners. (Rick Wilson pg.1) Our prison systems simply have too many people. To try and help fix this problem, there needs to be shorter sentences for smaller crimes. Based on the many people in jail at the moment, funding for prison has dropped tremendously.
America locks up five times more of its' population than any other nation in the world. Due to prison overcrowding, prisoners are currently sleeping on floors, in tents, in converted broom closets and gymnasiums, or even in double or triple bunks in cells, which were designed for one inmate. Why is this happening? The U.S. Judicial System has become so succumbed to the ideal that Imprisonment is the most visibly form of punishment. The current structure of this system is failing terribly. To take people, strip them of their possessions and privacy, expose them to violence on a daily basis, restrict their quality of life to a 5x7ft cell, and deprive them of any meaning to live. This scenario is a standard form of punishment for violent offenders, although not suitable for nonviolent offenders.

Americans believe that the more serious a crime is, the longer a person should spend in a prison. In reality it means that a law at discretion can sometimes just set a number of years that a person should spend in the jail, regardless of the situation. The time in the prison is often very long (Randall, Brown, Miller& Fritzler, p.216) because some states have definite sentence or mandatory sentences which leave little room for the judge to decide on the merits of the person. For example, California favors “Three Strikes and You’re Out”(Randall & et al., p.216) stance on the laws which means after third felony crime, a person must spend 25-year-to-life sentence in the prison. They believe that the deprivations of basic needs, isolation from the society, and in extreme cases, death are consequences of committing a crime.
