Political philosopher John Rawls believed that in order for society to function properly, there needs to be a social contract, which defines ‘justice as fairness’. Rawls believed that the social contract be created from an original position in which everyone decides on the rules for society behind a veil of ignorance. In this essay, it will be argued that the veil of ignorance is an important feature of the original position. First, the essay will describe what the veil of ignorance is. Secondly, it will look at what Rawls means by the original position. Thirdly, it will look at why the veil of ignorance is an important feature of the original position. Finally, the essay will present a criticism to the veil of ignorance and the original position and Rawls’ potential response to this.
What is The Veil of Ignorance?
Rawls’ primary goal in designing the original position is to describe a situation that he believes would achieve the most extensive liberty and fairness possible to all the parties involved in his hypothetical social contract (Rawls, 1971). Rawls believes that in order to achieve this level of fairness, it must be assumed that the parties involved are situated behind a ‘veil of ignorance’ (Rawls, 1971). This veil of ignorance deprives all of the parties of all knowledge of arbitrary facts about themselves, about other citizens, from influencing the agreement among the representatives (Rawls, 1971). Without the veil of ignorance, there would be little chance of an outcome that is unbiased and based on equality of all. If societies were to be constructed without the veil of ignorance or the original position, everyone in the society would be motivated by fear of power and threat. These individuals would be living in a society that is unjust and unfair because most people would be looking to further their own individual goals at the expense of others. Therefore, living with the veil and the original position is better than living without it because people will be all given an equal opportunity in life, be treated fairly and live in a society that encourages cooperation and prevents conflict.
Imagine that rational actor X has been charged with the responsibility of developing the guiding principles for a totaly new type of social contract for today’s society. Is there a way for actor X to perform this task in a truly equitable manner? Consider that “with respect to any complex mater of deep human importance there is n o ‘innocent eye’ —no way of seeing the world that is entirely neutral and free of cultural shaping.” 1 As an entrenched member of a particular culture the complete removal of personal biases and prejudices from within the human psyche is not possible; nonetheless, it would of course be necessary to take steps to at least minimize their effects. In his 1971 book, A Theory of Justice , John Rawls suggests that exactly this type of reduction is possible by figuratively stepping behind a ‘veil of ignorance’ int o what he labels the ‘original position’ —this paper is an introduction to the contractarian thinking of John Rawls and its relation to the original position as expressed in his 1971 book, A Theory of Justice.
In “A Theory of Justice” we are confronted with the position of “justice as fairness” and Rawls’s argument toward a more just society where everyone has equal opportunity. However, Rawls has difficulty realizing in his argument that the modern liberal society, to which he is applying his principles are in fashion gender-structured. Rawls has taken this tradition of sexism for granted, and fails to consider how his theory of justice is to apply to women, and the ‘family’. In this essay I will critique John Rawls on gender and the family, I will look at aspects of Rawls’s theory, and the difficulties that arise in regard to gender and family, because of his ambiguous language, and why they must be corrected.
Merriam-Webster Dictionary has a two-fold definition for the word “contract”. A contract is “a binding agreement between two or more persons or parties, especially one legally enforceable” (Merriam-Webster). It is also a business agreement for the supply of goods or services at a fixed price” (Merriam-Webster). John Rawls argues that “an agreement is not necessarily fair even if it is voluntary. To be fair, an agreement must also be made against a background of equality. It is unfair if one of the contracting parties is able to take advantage of the other party because they are stronger, richer, better informed, or simply more powerful” (Sandel 30). The purpose of this essay is to affirm Rawls’ argument because I do agree that entrance into a contract does not mean that the contract is just, especially if one party is perceived to have an advantage over the terms of the contract. To do so, I will use a scenario to prove that if an agreement was made voluntarily, this is not enough to ensure that the terms agreed to are fair. I will also provide possible counterarguments for oppositions that provide criticism on Rawls’ grounds.
Both Thomas Hobbes and John Rawls propose an idea of a social contract, for society. Hobbes' account gives us the Leviathan, and Rawls gives us his Theory of Justice. For Rawls a social contract is hypothetical, in other words people would agree to it if they were to choose it.1 He creates a thought experiment, to show what people would choose if they were to decide on a social contract. This exists in what he calls the "original position, which is similar to a state of nature.2 The thought experiment then begins with a group of people, behind what he calls a "veil of ignorance". By doing this they do not know their social class, wealth, natural abilities, the distribution of assets in society, or anything else about themselves or the society.3 They must then must decide how society would be set up.4 Since none of them know details about what would benefit them, they will then advocate for a society that abides by Rawls' two principles of justice.5 First there is the liberty principle, which advocates basic liberty for everyone. Second, there is the difference principle favor economic equality, with inequalities that benefit the worst off.6 The veil of ignorance, ideally creates an egalitarian society with equal rights, and inequalities only exist if they redistribute wealth equally.7 Rawls then uses Kantian reasoning to say that since a rational being would choose these principles, these are the principles that should be adopted.8 Unlike the original position of Rawls, the state of nature for Hobbes is violent, and anarchic.9 Man has the right to use his own power, but he can transfer that right and enter into a social contract to escape the state of nature.10 Hobbes also states that making and keeping contrac...
Throughout his work, Rawl’s argues for a philosophical basis for a realistic utopia that would balance liberty and equality through a social contract where a well-ordered democratic society, made up of free and equal citizens, would agree together on what constitutes a fair society. By entering in Original Position and under the veil of ignorance, the parties would come to his two basic principles of justice.
Rawls’ thinks that the modern liberty is the kind of freedom modern individuals are able to enjoy. He states that there are two things that are appropriate to democratic society, and they are justice and tolerance. Rawls presents us with two principles of justice that the citizens have to follow in order to be truly free; they are equality of rights and inequality benefits least advantaged member of society. Two advantages of the difference principle will be discussed and analyzed; the first advantage is that it is morally right or fair. Liberal philosopher, John Rawls, has been credited as being one of the largest contributors to the field of social justice of the twentieth century. In his book `Justice as Fairness', Rawls describes his views on the issue of justice in a social sense and outlines the major features of his theory of justice. From his discussions on this topic, one could derive a legitimate assumption of how Rawls' would apply his views on justice to the question of how we should respond to poverty, this I have done in the final segment of my essay.
One strength is the inherent compulsion to look after the interests of the entire society through the Veil of Ignorance. One is unable to look after the interests of a single particular ethnic, political or social grouping because of uncertainty regarding which groups they will belong to within society, so they grant all individuals “freedom of thought, [religion], personal and political liberties” . This establishes a precedent of equality for all and ensures a fair standard of living. One might argue that behind the Veil of Ignorance, society will be able to develop such fundamental rights and equalities naturally. Considering that modern society can be seen to have developed laws and cultural rules without the Veil of ignorance, it stands to reason that Rawls’ suggested principles are unnecessary.
