The Savings and Loans Crisis of the 1980’s and early 90’s created the greatest banking collapse since the Great Depression in 1929. Over half the S & L’s failed, along with the FSLIC fund that was created to insure their deposits. From 1986 to 1989, the Federal Savings and Loan Insurance Corp. (FSLIC) closed 296 institutions with assets totaling $125 billion. With the creation of the Resolution Trust Corp. (RTC) in 1989 an additional 747 thrifts with assets totaling $394 billion were closed. That is a combined total of $519 billions in assets that contributed to a massive restructuring of the number of firms in the industry as stated by Curry & Shibut (2000). A resolution passed by Congress was the Financing Corp. (FICO), created in 1987 to provide funding to the FSLIC. FICO contributed $8.2 billion in financing. Then came the enactment of FIRREA, The Financial Institutions Reform, Recovery and Enforcement Act by Congress in 1989, which began the taxpayer’s involvement. The large number of failures overwhelmed the resources of the FSLIC, so US taxpayers were required to back up the commitment extended to insured depositors of the failed institutions. As of Dec. 31, 1999, the thrift crisis had cost taxpayers approximately $124 billion. ( Curry et al. 2000) FIRREA abolished the FSLIC and transferred its assets, liabilities and operations to the newly created FRF, Federal Resolution Fund, to be administered by the FDIC. The remainders of the monies were from the US Treasury and the Federal Home Loan Banks. In the world of money, firms including banks and nonbank financial companies face adversaries and often fail. When they do, most failures do not result in extreme externalities. In other words, loss of the firm does not place its counterparties into a troubled position. Ergo, the firm would go through a usual resolution process provided by the government. But, some large firms undergo a “special” treatment because of the government’s fear that its losses may have disproportionately big adverse externalities on the economy thus threaten the financial stability. These are the firms to which “too big to fail”, also known as “TBTF” apply. They are also referred to “too important to fail”, “too big to liquidate”, “too big to unwind and, most recently “too big to jail”. (Kaufman, 2013) Because of their capability to melt down the entire economy in the case of crisis, they are showered with public funding along with continuous bailouts. These unconditional supports have fostered generations and generations of controversy. The controversy dealt with in what extend should the government intervene with the financial firms, has it derived the economy to the desired result and flaws of this ironic concept.
The Dodd-Frank Wall Street Reform and Consumer Protection Act brought the most significant changes to financial regulation in the United States since the reform that followed the Great Depression. It made changes in the American financial regulatory environment that affect all federal financial regulatory agencies and almost every part of the nation’s financial services industry. Like Glass-Steagall, the legislation passed after the Great Depression, it sought to regulate the financial markets and make another economic crisis less likely. Banks were deregulated in 1999 by the Gramm-Leach-Biley Act, which repealed the Glass-Steagall Act and essentially allowed for the excessive risk taken on by banks that caused the most recent financial crisis. The Financial Stability Oversight Council was established through the Dodd-Frank Wall Street Reform and Consumer Protection Act and was created to address the systemic risks in the United States financial system and to improve coordination among financial regulators.

It all started with what became known as the first 100 days during which congress passed an unprecedented amount of legislation. First up was a banking holiday, for two days, every bank across the country was shut down and investigated. The well behaved banks were allowed to be reopened while the rest were put under government control. The government then put some broad restrictions over the banks while also creating the (Federal Deposit Insurance Corporation) FDIC which would act as insurance for banking deposits. As researchers look into the crisis more and more, they keep finding scary results, such as the predicted debt in 2035 being 185 percent of the country’s (GDP). One of the major unintended impacts of the Dodd-Frank Act has been on credit unions and community banks. These banks weathered the credit crisis and lost only 6% of their share of banking assets between 2006 and mid-2010. A recent Harvard study indicates that this decline accelerated to 12% since the passage of the Dodd-Frank in July 2010. [a] While the community banks’ earnings increased by 12% to $5.3 billion by mid 2015 the number of these banks had declined according to Federal Deposit Insurance Corporation. The number of banks with assets under $1 billion has declined from around 7500 in 2010 to less than 6000 since Dodd-Frank came into effect. [b] Increased compliance costs due hiring of new personnel to interpret the new regulations compelled these banks to cut down on customer service amongst other things. The "subprime crises" was one of the most significant financial events since the Great Depression and definitely left a mark upon the country as we remain upon a steady path towards recovering fully. The financial crisis of 2008, became a defining moment within the infrastructure of the US financial system and its need for restructuring. One of the main moments that alerted the global economy of our declining state was the bankruptcy of Lehman Brothers on Sunday, September 14, 2008 and after this the economy began spreading as companies and individuals were struggling to find a way around this crisis. (Murphy, 2008) The US banking sector was first hit with a crisis amongst liquidity and declining world stock markets as well. The subprime mortgage crisis was characterized by a decrease within the housing market due to excessive individuals and corporate debt along with risky lending and borrowing practices. Over time, the market apparently began displaying more weaknesses as the global financial system was being affected. With this being said, this brings into question about who is actually to assume blame for this financial fiasco. It is extremely hard to just assign blame to one individual party as there were many different factors at work here. This paper will analyze how the stakeholders created a financial disaster and did nothing to prevent it as the credit rating agencies created an amount of turmoil due to their unethical decisions and costly mistakes.
