Throughout the years kids have been committing terrible crimes that are just as bad as the crimes an adult would commit, sometimes even worse. These children have received life sentences with the possibility of no parole along with counseling and even rehabilitation. Many believe that putting an adolescent in jail with a life sentences is a cruel and unfair punishment. In the past couple of years the law has changed to those under 18 will not be sent to jail, only to a rehabilitation center or juvenile hall for no more than a year. People believe that is much more suitable for a teenager rather than keeping them locked away in jail for more than what they’ve lived. These teenagers are getting the opportunity to get away with murder, breaking and entering and many more other crimes just because they are not 18. “ They are young and their brains are not fully developed” is one of the most common plea for committing the crime allowing them to only get a 6 month sentence in a juvenile hall will counseling. Murdering someone’s parents or child that they’ll never see again or beating someone after breaking and entering their house leaving them traumatized and never being able to be alone again. Brain development is not a factor for their actions, being influenced by movies and games shouldn’t be a reason to want to do so many crimes. The same way adults are treated and despised for killing an innocent person, adolescents should be too no matter if they’re 16 with no role model or 14 high off computer cleaner. Heinous crimes are considered brutal and common among adults who commit these crimes, but among children with a young age, it is something that is now being counted for an adult trial and punishable with life sentencing. Although some people agree with this decision being made by judges, It is my foremost belief that juveniles don’t deserve to be given life sentencing without being given a chance at rehabilitation. If this goes on there’s no point in even having a juvenile system if children are not being rehabilitated and just being sent off to prison for the rest of their lives and having no chance getting an education or future. Gail Garinger’s article “ juveniles Don’t deserve Life sentence”, written March 14, 2012 and published by New york Times, mentions that “ Nationwide, 79 adolescents have been sentenced to die in prison-a sentence not imposed on children anywhere else in the world. These children were told that they could never change and that no one cared what became of them. They were denied access to education and rehabilitation programs and left without help or hope”. I myself know what it’s like to be in a situation like that, and i also know that people are capable of changing even children when they are young and still growing.

Juvenile Detention Centers are supposed to help minors get on the right track for the rest of their life ahead of them. While these landmark cases made great strides for the rights of minors passing through the criminal justice system, they are just the first steps in creating a juvenile justice system that takes into consideration the vast differences between adolescents and adults. Using sociological (Butler, 2010) and legal (Harvard Law Review, 2010) documents, this essay will explicate why the next such step to be taken is entirely eliminating the use of the life without parole sentence for juveniles, regardless of the nature of the crime being charged.
According to international standards, sentencing an individual who is below 18 years of age is against the law (Steinberg and Scott 56). According to International standards, children who are still developing do not have the same level of culpability as adults. In the last 42 years little to no changes have been made to correct the standards that govern punitive measures towards juvenile delinquency. Today juvenile law is governed by state and many states have enacted a juvenile code. However, in numerous cases, juveniles are transferred to adult court when juvenile courts waive or relinquish jurisdiction. Adolescents should not be tried in the adult court system or sentenced to adult penitentiary's on account of: teen brains are not mature which causes a lack of understanding towards the system, incarceration in an adult facility increases juvenile crime, and children that are sentenced to adult prison are vulnerable to abuse and rape.
Age is a factor in why Juveniles should not be sentenced to life in prison. As Paul Thompson states in his article Startling Finds on Teenage Brains from the Sacramento Bee, published on May 25, 2001 “ ...These frontal lobes,which inhibit our violent passions, rash action and regulate our emotions are vastly immature throughout the teenage years.” he also says that “The loss[of brain tissue] was like a wildfire, and you see it in every teenager.”. This loss of brain tissue plays a role in the erratic behavior of teens, they cannot properly assess their emotions and thoughts. During this period of brain tissue loss teens are unpredictable, adults do not know what their teen’s next move will be, teens themselves do not even know what their next move will be. As we grow our brains develop, therefore teen brains are not fully developed, so they cannot be held to the same standards as adults.

Being charged with adult sentences is a very harsh punishment considering their age. Andrew Medina was fifteen when he got sentenced to life without parole because of a murder that he possibly did not commit. Officers also alleged that he was part of a gang and sent him to spend the rest of his life in a very strict prison. Trevor Jones also got sentenced to life without parole at the age of seventeen because of reckless manslaughter. Even though it was an accident, the victim’s death occurred while Trevor intended armed robbery and was accused of felony murder and will spend the rest of his life in prison. Jacob Ind was sentenced to life without parole. At the age of fifteen, he killed his mother and stepfather in order to put an end to the all kinds of abuse they were putting him through. With the number of children in adult prisons and jails rising rapidly, questions are being asked as to why children have been committing such heinous crimes and how will they be stopped.
