On April 4th, 2016 at approximately 9:00 am, I, Investigator James Poffel was contacted by my investigations lieutenant, Lieutenant John Person. Lt. Pearson informed me that he received a phone call from the Weld County Sheriff’s Office investigators, who are conducting a homicide investigation that coincides with subjects in our jurisdiction and needing their phone to be downloaded in reference to the investigation. Lt. Pearson contacted me, because I and one other officer are the only officers certified to download and analyze cell phones at our department by using a phone download system called Oxygen Forensic Analysis. The subject’s whose phone needed to be downloaded is a Dianne Garrett, who is the mother of one of the victims.
Mrs. Garrett and her husband Roy Garrett arrived at the Muskogee Police Department requesting to speak with me about the investigation. I brought Mr. and Mrs. Garrett back to the Criminal Investigations Office, where I spoke with Mrs. Garrett about the information she needed to share.
The following is a summary of the informal interview with Mrs. Garrett, not an exact transcript. Before Mrs. Garrett begin the interview, I could see that Mrs. Garrett was visibly distraught. Mrs. Garrett said she got on Facebook under her son’s name or account that was created. The account was titled Zachary Moore’s Alter Ego. I am still unsure at this point who created this account. Nevertheless, Mrs. Garrett stated she got onto this Facebook account to try and conduct her own investigation to elicit information from some of the people she believes might be involved in the killing of her son. Mrs. Garrett said she saw on one of the women’s Facebook a picture of a baby. Mrs. Garrett stated she had to talk like them ...

...d a mental breakdown and doesn’t know if she has just imagined everything or what, but that she believes I won’t find anything on her phone. I took this opportunity to speak with Mrs. Garrett about seeing a councilor for the grief she was experiencing, if she wasn’t already. Mrs. Garrett said she does see a councilor for depression once every two weeks or so. I asked if that seemed to be helpful to her. She told me it was, but when she is alone for long periods of time that her mind with run free. I encouraged Mrs. Garrett to continue her seeing her councilor and told her if she needed anything else to contact me.
Attached to this report is the PDF document regarding Mrs. Garrett’s phone download and the content retrieved, a copy of the search warrant consent, and her voluntary statement.
