IDEA (Individuals with Disabilities Education Act) states, a child, who’s educational performance is unfavorably affected by hearing loss, whether it is perpetual or inconsistent, is eligible for assistance under the law (Heward, 2013). The loss must be so severe that it affects the ability to process linguistics by hearing, with or without the use of aids. Not only does Michael suffer from hearing loss, he also suffers from a language or speech disorder associated with the hearing loss. He is eligible for assistance through IDEA due to the inability to hear, speak, and interact socially and educationally at proper developmental levels for his age. According to Heward, as stated by IDEA, “to be eligible for special education services, a child’s communication disorder must have an adverse effect on learning. The Individuals with Disabilities Education Act (IDEA) defines speech or language impairment as “a communication disorder, such as stuttering, impaired articulation, a language impairment, or a voice impairment that adversely affects a child’s educational performance” (34 CFR, Part 300 §300.8[c] ) (page 283).
