In the summer of 1972, five burglars broke into the Watergate hotel where the Democratic Convention was being held. The burglars were eventually captured and arrested, but one of the burglars implicated then-President of the United States of America, Richard Nixon, in the planning of the break-in. After weeks of subpoenas from Congress, demanding tapes that were used to record the activities in the White House. It was then that Richard Nixon would irrevocably change America’s future by doing something that every President had done before him, he would use executive privilege to block the investigation into the White House’s role into the Watergate break-in. By invoking executive privilege, Richard Nixon proved his guilt and permanently changed American history.
Of course, this was not the first time executive privilege had been invoked. In 1776, George Washington used an offshoot version of executive privilege to withhold documents relating to a failed military expedition. Although Washington did hand over the documents to Congress, it would be forever noted that this would be the first example of executive privilege. Despite not actually using executive privilege, it is still seen as the first use of executive privilege in American history.
When George Washington wrote his letter to Congress regarding executive privilege, it was assumed that he intended executive privilege to be used for America’s well-being and not for personal gain. Despite popular opinion, most Presidents have followed George Washington’s precedent. The thesis of Williams “The Ruling That Changed America” is that the Brown decision changed America for the better, but it wasn’t exactly accepted like it is today. Williams says “The real impact of the legal, political, and cultural eruption that changed America is not exactly what it first appeared to be.” (Williams 387) Furthermore, in the article, Williams validated the thesis by saying “Today, it is even hard to remember America before brown because the ruling completely changed the nation.”(Williams 389)
When Nixon was inaugurated, he took a sworn oath to protect the people and the country. He lied to his people. He states, “The major problem on the Watergate is simply to clean the thing up by having whoever was responsible admit what happened. Certainly I am satisfied that nobody in the White House had any knowledge or approved any such activity.” (Memoirs 646).
Presidential power has increased all the time. Compared to the first U.S. president George Washington, the modern presidency has more power and departments (Patterson, 2014). The expansion of presidential power increases the ability of the Executive branch to regulate and protect our society. On the other hand, the president may abuse his presidential power. Like in this case, the President Nixon monitored his staff’s conversation at the Oval Office, and he let some people to set up the recording device in the Watergate complex (“teachingamericanhistory.org”, n.d.). In my opinion, the president Nixon abused his presidential power to set up these recording devices. Even though he had the excuse that the conversations he recorded may contain the national security issue, the method that he get information was not appropriate. He cannot just record everything without other people’s permission to achieve his goal. These recording conversations might have other people’s privacy. Even though the U.S. constitution does not state the word privacy, it can be derived from the Bill of Rights (Patterson, 2014). The people’s privacy is protected now, and any other person cannot invade their privacy without permission. Therefore, the president Nixon violates other people’s privacy, which was against the Constitution. Because the Constitution is the Supreme law of the U.S., the President Nixon had to follow it (Patterson, 2014). Nixon only released some of the tapes required in the subpoena and asserted that he was immune from this subpoena filing a motion to quash it based on executive privilege. He said because it demands "confidential conversations between a President and his close advisors that would be inconsistent with the public interest to produce. 4. The District Court rejected Nixon's motion saying that the judiciary, not the President, was the final arbiter of a claim of executive privilege. The case was appealed to the Supreme Court by the President.
The Watergate Scandal and the resignation of President Nixon was the beginning of American’s mistrust of politicians. This can be viewed as a positive effect. This can be accomplished by viewing the circumstances in which a President takes office, the manner in which he carries himself during his term, and the way in which the President leaves as Commander in Chief. Conclusion: The President has neither gained nor lost power. There exists the same balance between Executive and Congress as there was when Washington was sworn in as America's first President. The only difference between then and now, is the fact that today we must wade through the layers of insignificance and precedents that history has forged against us, the political thinker and historian.
The president has a significant amount of power; however, this power is not unlimited, as it is kept in check by both the judicial and legislative branches. The president is held responsible for passing legislation that will improve the lives of everyday Americans, even though he shares his legislative powers with Congress. The sharing of power acts as an impediment to the president’s ability to pass legislation quickly and in the form it was originally conceived. However, Americans do not take this into account when judging a president, as they fully expect him to fulfill all of the promises he makes during his campaign. By making promises to pass monumental legislation once elected without mentioning that Congress stands as an obstacle that must be hurdled first, the president creates unrealistic expectations of what he can fulfill during his time in office (Jenkins-Smith, Silva, and Waterman, 2005). A president is expected to have the characteristics that will allow him to efficiently and effectively lead the nation and to accomplish the goals he set during his campaign (Jenkins-Smith et al., 2005). There have been a handful of presidents that have been immortalized as the ideal person to lead the United States and if a president does not live up to these lofty expectations the American public will inevitably be disappointed. Since every president is expected to accomplish great things during his presidency, he is forced to created and project a favorable image through unrealistic promises. The combination of preconceived ideas of the perfect president and the various promises made by presidential candidates during their campaign create unrealistic expectations of the president by the American public.
In early June 2013, Edward Snowden, a 29-year-old former defense contractor who had access to NSA database while working for an intelligence consulting company, leaked classified documents reports that the National Security Agency (NSA) is recording phone calls of millions of Americans along with gathering private data and spying foreign Internet activity. The Washington Post later broke the news disclosed PRISM, a program can collect data on Internet users. The leaked documents publicly stated a vast objection. Many people were shocked by the scale of the programs, even elected representatives were unaware of the surveillance range. A nationwide debate over privacy rights have been sparked. Despite the national attention the Watergate scandal had gained President Nixon, he won the second term presidency. The major problem for Nixon would come later. The investigations of the Watergate scandal lead to the discovery of other criminal acts by officials including Nixon. During the investigation many things begin to surface. It was discovered that documents had been destroyed that may have made a link between Nixon and the Watergate scandal. These documents may have shown that he had some acknowledgement in what had happened. The years leading up to the 1972 election were filled with new political tactics. Going into the election year, President Nixon seemed like he could never lose the second term election after successfully negotiating with Vietnam, Beijing, and Russia to improve international relations (Emery 4). Raising international toughness made Nixon seem like the most worthy person to stay president. The American Presidency is undoubtedly one of the most widely recognized popular icons throughout the world. Although to most foreigners or those who have never resided in the United States or know little of its history, the executive branch of government may seem to be as dull and unyielding as the rest of the American politics, for those few rare individuals who have taken the time to examine and closely scrutinize this office of the American political system and its recent history, quite the opposite will be said. Unlike Congressional or local elections where typically a number of individuals of the same ideological background must be elected in order for a particular issue to be addressed by the government, when it comes to the presidency, one person, although checked by various other divisions of the same government, has the power and responsibility to literally, as history has proven, change the world. The American people, "like all people everywhere, want to have our (political) cake and eat it too. We want a lot of leadership, but we are notoriously lousy followers" (Genovese). In other words the expectations the public has of the executive office are ever-changing since we demand that our leaders keep up with the evolving world around us and them. Throughout the past seventy eventful years alone, the American people's views, perceptions and demands of the Executive Office of American government have evolved simultaneously with the political and social events of that same time period.
Howell defies unilateral powers as “…instruments by which the presidents set all sorts of consequential domestic and foreign policy (Paige 1977)” (Howell 242). To explain, Howell argues unilateral actions allow for presidents to bypass Congress in attempt to create domestic and foreign policy. Howell also brings to light “The U.S. Constitution does not explicitly recognize any of these policy vehicles (executive agreements, executive orders, executive memoranda, proclamations, etc.)”, but the president uses them as justifications for his actions. Howell provides his audience historical examples of such unilateral actions.
It is reasonable to argue that, governmental institutions or people with authority are subject to withhold a great deal of information from society. Many may argue that secrets are kept to ensure the safety of the nation. Thus, upholding the governmental duty of protecting the nation against possible threats. On the other hand, many believe that secrets may exist which violate our constitutional rights. Over the last year, Edward Snowden, has made headline news for leaking sensitive governmental information to the press. Edward Snowden is a 29-year-old high school drop-out, who was a tech specialist for the National Security Association. Snowden had discovered and later exposed the NSA for monitoring the nations e-mails, phone calls, and internet searches. As the allegations spread like wild fire, Edward Snowden sought asylum in Russia for one year. Snowden had a valid and justifiable reason to expose the NSA to the world because they were in violation of our fourth Amendment rights to unreasonable searches and seizures. The government called him a traitor, while others viewed him as a hero for exposing the government. Edward Snowden is a whistle blower because he felt that it is up to society to decide if governmental practices are just or unjust. Snowden does “express the highest respect for the law”, and he wanted to protect the right of privacy for American citizens.
