Section one: The Process of Criminal Mediation: Criminal mediation is one way of solving criminal disputes in the unified states of America, and has been used a bunch in this field, so the main example is the (victim –offender) mediation, which brings up the query of how does this scheme work? And what are its effects? So in this section, we will discourse in (part one) how the VOM works, and what are its effects in (part two). Part One: How Does The Victim-Offender Mediation (VOM) Work? In general, mediation is guided by a neutral third party who can buy what he had of skills and abilities focus on guiding the behaviors of the parties towards discussing the topics that need to be confronted, while having separate and confidential communications from the parties until he gained a certain point of understanding with them that the dispute can be solved. So in my view, the mediator’s function is to attempt to achieve a balance between the two parties of the conflict to encourage the exchange, and to facilitate the negotiations between them to make a common solution that will hold reciprocal satisfaction. Nonetheless, the Victim-Offender Mediation (VOM) programs have concentrated on a restorative justice approach, which determines the genuine victim of the crime as the party to be made whole, and the offender is deemed responsible for his or her activities. So it can be stated that the VOM programs focus on the relationship, and mending the hurt caused to the dupe. This type of programs takes place before trial, and involves the victim, the offender, the community in order to rebuild the trust, and to resolve the criminal conflict in a way that is fair to the parties. They analyzed “a sample consisted of 1,298 juvenile offenders (619 participated in VOM and 679 did not). The results of the logistic regression showed that VOM youth recidivated at a statistically significant rate, 32 percent lower than non-VOM youth. In addition, when VOM youth did re-offend they did so for less serious offenses than non-VOM youth.” This study shows the effectiveness of VOM in reducing juvenile recidivism. Now , after studying the process of criminal mediation especially how the victim – offender programs work , and after knowing its different effects there is a particular behavior practiced in it that has a huge impact on the whole process which is apology .
