Gideon v. Wainwright What most people don't know is that in the past those arrested for a crime did not really have "the right to an attorney" unless they had money. This became a right because Clarence Gideon, a prison inmate who did not have the money for a lawyer, took a pencil in his hand and wrote his own petition to the United States Supreme Court. Clarence Gideon, without a lawyer, took his case to the highest court in the country and won important rights for all of us. In 1961, Clarence Gideon was arrested in Florida on a charge of breaking and entering into a pool hall. Gideon was a likely suspect for the police to arrest: he was a 51-year old drifter who had been in and out of jail many times since he ran away from home to be a “hobo” at age 16.
Although he barely finished the eighth-grade, when Gideon was arrested he knew two things: one of which was that he had not committed this crime and the second is he would not have a chance to convince a jury that he was not guilty if he did not have a lawyer. Because Gideon could not afford a lawyer, he asked a judge to appoint a lawyer to represent him. The judge refused and Gideon was convicted. He was sentenced to five years in jail, which gave him a lot of time on his hands. He put that time to good use.

Although this case was very influential on the way police forces carry out their duties, I think the case was mostly important in that it forced all courts in the U.S. to have a greater recognition of the Sixth Amendment of the Constitution and the story of the victim involved in this case. Clarence Earl Gideon was born on August 30, 1910 in the state of Hannibal, Missouri. His father’s name was Charles Gideon and his mother’s was Virginia Gideon. In 1913, Charles Gideon died just a few days after the third birthday of Clarence. Virginia remarried Marion Frances Anderson when he was five.
The case of Ford V. Wainwright is a Supreme court case of the United Stated argued in 1986. Alvin Bernard Ford is the plaintiff in this case, In 1974 he was convicted of murder in Florida and sentenced to death. In 1982 Ford began to show signs of a serious mental disorder. The Governor of Florida then appointed a panel of three psychiatrist to determine if Ford was component to understand the nature of the death penalty and the crime he had committed. All three psychiatrist disagreed on his exact diagnosis but agreed that he was sane and knew the nature of the death penalty. Ford’s attorney unsuccessfully sought a hearing in the state court for determination of his competency and then filed a hebeas corpus petition, which is a writ requiring a person to be brought before a judge or court especially for investigation of a restraint of the person’s liberty. The Florida courts denied his petition and signed a death warrant for Ford in 1984. Ford then sued Louie L. Wainwright, the defendant, who at the time of the case was the Secretary of the Florida Division of Correction.

Concussions are an injury that falls under the Traumatic Brain Injury category. A concussion occurs when a force causes the brain to rock back and forth inside the skull, and hit the interior walls of the skull. When this happens it can result in bruising on two parts of the brain, the Coup and the Countercoup. This may result in Loss of consciousness, confusion, headaches, nausea or vomiting, blurred vision, and loss of short-term memory. I know from experience the nausea and blurred vision. The first witness was simply just a misguided fellow named Heck Tate who it seems didn’t have much to offer to the case. Next, Atticus Finch called Bob Ewell to the stand. When I saw Ewell take the stand such a fierce hatred rose within me that I began to shake and tremble. Ewell wrongfully accused Tom of raping his daughter Mayella, however, with the grace of God, Atticus Finch had shown that it was very possible that it was Bob Ewell who because he was a lefty could have beat Mayella. If it were not for great men like Atticus Finch I would have lost all hope for this world. As I watched Mayella take the stand I wondered how such a kind looking person could be someone of such poor character. Her words seemed to paint a picture of a sad life; one where a father neglects her and she has fallen under hard times. Atticus, after pointing out it was probably Bob who beat her, asked Mayella who it really was that beat her. Mayella made it clear it was Tom Robinson, upon which Atticus asked Tom to stand. To the astonishment of the court Tom was handicapped! Tom was then called to the stand where he laid open for all to see the truth, explaining that it was Mayella who came on to him (that treacherous woman!). Soon enough the trial ended and every one awaited the verdict of the jury. The next few hours were the most nerve wracking of my life.
