This case is all about facts and incidents about the harsh truths that lie behind the discrimination and harassment against women in the workplace. Males have predominately rules the workplace on Wall Street and had the perception of having no women take their glory. For years women were filling suits with the EEOC (Equal Employment Opportunity Commission) about the way men were treating them. Women were getting mistreated, demoted, harassed or even fired in some incidents for reasons beyond their control.
Robert Thomann is a good example of the mistreatment that was being laid on the female brokers. Thomann was out on 8 weeks maternity leave and when she came back, her branch manager which was known as the tyrant demoted her. Cueno, her branch manager, said that any sexual harassment charges would be deliberated in the Boom, Boom Room which was located in the basement of the firms building. Income is drastically different when it comes to men and women and only gets worse for women who are minorities. When developing a cultural diversity training program, one has to manage diversity with a new approach of inclusion and recognition. Managing diversity enables people to perform up to their maximum potential (Kinicki p. 111). As we analyze diversity, we will evaluate some common barriers and challenges in managing diversity. In developing a diversity program, we will analyze methods and procedures that will be apart of the program. Kinicki (p.*) says an important first step in overcoming these obstacles is for leaders to convey to their employees why the organization values diversity.
The Equal Employment Opportunity Commission (EEOC) can file lawsuits on behalf of victims of sexual harassment, women who take their accusations to court face even bigger obstacles than mere public disapproval. The legal process is long and cumbersome - it can be years from the first complaint to the final verdict and in the meanwhile, the woman is in a legal, professional and often financial limbo. Women are not entitled to collect damages under the Civil Rights Act - just back pay; so many women don't see this process as worth the trouble. Even those, however, who do file a complaint and win a harassment case, may feel lost. Though, Title VII offers reinstatement to previous job, the individual may be shunned or harassed by co-worker thus making conditions even more uncomfortable than they were beforehand. Common law tort lawsuits, such as intentional infliction of emotional distress and assault and battery, provide a remedy in certain types of sexual harassment cases that is totally dependent of any of the statutes and governmental agencies. However, the solutions proposed might seem comprehensive in plans to lessen sexual harassment in the workplace and punishment of harassers, women still face formidable obstacles in preventing harassment from continuing. The proposed measures fail to cover all aspects of harassment, though the truth is, it is virtually impossible to formulate a plan to do so.
Although these examples could prove a case in the corporate world some may take defense by balancing with further statistics. It is stated in Clayton Collin's article, "Why Girls May Still Need an Edge," that women in America may not be at the top of the corporate ladder, but they do hold around forty percent of all privately owned businesses in the United States. (11) So, even though women haven't quite proven themselves to the corporate world, they have most certainly conquered a portion in the entrepreneur world and in a big way. That is definitely a positive point for America's look on gender equality in the workplace.
Despite the passage of protective federal legislation in the forms of the Equal Pay Act in 1963 and Title VII of the Civil Acts of 1964, there still exists prominent gender discrimination in the workplace that negatively impacts career advancement for women. This is best seen through the case example of Ann Hopkins. Hopkins was denied a career advancement to partner status within Price Waterhouse solely based on her perceived femininity and not the quality of her previous work for the company. This incident occurred in 1982, roughly 20 years after the passage of the Equal Pay Act and Title VII. Although the Equal Pay Act and Title VII have made great strides towards economic gender equality in the United States, they are by no means complete. The United States needs additional legislation in order to guarantee equal pay for equal work.
Sexism is a major factor in the workforce.Today male and female have a hard time breaking into the opposite gender dominated fields. This has happened because of the media, it has showed us that male have certain “right” jobs, as well as female. Female still dominate traditional female professions like cosmetology jobs are 92.9 percent women working them(Wolfe). If a man were to get into cosmetology they would most likely be judged for having that job, because we stereotype that they can't have a feminine job. Women have a harder time getting into high level positions. “Women make up only 21 of the S&P’s 500 CEOs,” (Berman). This has happened because the media has set in place stereotypes that it is wrong for women to have high level positions. It is getting better, in 2013 women chief financial officers increased 35 percent at large U.S. companies from 2012 (Frier and Hymowitz). The job market for men and women is still unfair but it is starting to get equal.
Discrimination against women in the workplace is an unfortunate reality even in this day and age. It has a significant negative impact not only economically but also on women 's confidence, sense of self worth, and can also cause them to lose motivation and morale which is required to perform their jobs. Although there are a number of laws in place to protect women in the workplace in the United States, such as the Equal Pay Act and the Civil Rights Act, discrimination still occurs. It can take many forms such as sexual harassment, age discrimination and gender discrimination.
