In recent years, due to the related news increasingly appear in popular media, women offending are getting more and more attention from readers. In fact, the statistics from Ministry of Justice Statistics bulletin showed that the rate of women conviction was increasing. In the early criminology, the explanation of women’s offending was more likely domination on some internal reason, such as the focus on the biological and psychological ground. Lombroso (1895) suggested that those women commit the crime were ‘’born criminal’’, it because of physical defects. He also suggested criminal women were atavistic, that not fully evolved and underdeveloped intelligence. In the early study on female criminality, women offending was defined as a mental illness, and were not affected by environmental issues. But the theories of feminist criminology on explaining the variation of female criminality can conduct an explanation of the rising trend of female criminality, and it considered the environmental issues. There had many studies found that the defendant’s gender was influenced the outcome of criminal court, the society may think that female are more amenable to rehabilitation and less dangerous, that may affect the probability of being jailed or imprisoned of the female. Therefore, to probe the criminal sentencing are also important in this article, because of the sentencing outcome may influence the rate of reoffending. There has five type of sentencing outcome of all court, immediate custody, suspended sentence, community sentences, fines and other disposals.
