A Critical Analysis of Racism in Canadian Law and the “Unmapping” of the White Settler Society in “When Place Becomes Race” by Sherene H. Razack This article study will define the important aspects of space and racial identity that are defined through Canadian Constitutional law in “When Place Becomes Race” by Sherene H. Razack. Razack (2002) the historical premise of a “white settler society” as the foundation for spatial hierarchies in the Canadian society, which reflect a racial divide in the community. The white settler society was based on the Anti-Terrorism Act, within Canadian law, which reflects the post-9/11 culture of the Canadian government that has become racialized in the early portion of the 21st century. Razack (20020 defines the historical legacy of the “white settler society” that has dominated the legal and historical rights to land usage in relation to indigenous peoples and people of color. In addition to this problem, Razack (2002) also defines the problem of “mapping” that has allowed a primarily racist Canadian government to marginalize or remove people of color from land ownership and placement in the white hegemonic community. In the first Chapter of the book ‘A Different Mirror’ by (Takaki, 1993) the author embarks on a descriptive narrative that tries to elaborate the concept of a multiracial America. The chapter begins with the author taking a taxi ride in which he is subjected to racial discrimination. The taxi driver questions the author’s origin owing to the fact that his English is perfect and eloquent. This incident prompts a discussion that transpires throughout the chapter as the author tries to explain to his audience that America is a multiracial country with different ethnic groups that moved from their homelands to settle in the United States. The chapter discusses the settlement of various racial groups such as; English immigrants, African Americans, Asian Americans, Chicanos and the Irish.
Canada is perceived by other nations as a peace-loving and good-natured nation that values the rights of the individual above all else. This commonly held belief is a perception that has only come around as of late, and upon digging through Canadian history it quickly becomes obvious that this is not the truth. Canadian history is polluted with numerous events upon which the idea that Canada is a role model for Human Rights shows to be false. An extreme example of this disregard for Human Rights takes place at the beginning of the twentieth-century, which is the excessive prejudice and preconceived notions that were held as truths against immigrants attempting to enter Canada. Another prime example of these prejudices and improper Human Rights is the Internment of those of Japanese descent or origin during the Second World War. Also the White Paper that was published by the government continues the theme of Human Rights being violated to the utmost extreme. All these events, as well as many others in history, give foundation to the idea that “Canada as a champion for Human Rights is a myth”.
Harold Cardinal made a bold statement in his book, The Unjust Society, in 1969 about the history of Canada’s relationship with Aboriginal peoples. His entire book is, in fact, a jab at Pierre Elliott Trudeau’s idea of ‘the just society’. Pierre Elliott Trudeau made great assumptions about First Nations people by declaring that Aboriginal people should be happy about no longer being described as Indian. His goal was to rid Canada of Indians by assimilating them into the Canadian framework. Considered by many as a progressive policy, Trudeau’s white paper demonstrates just how accurate the following statement made by Harold Cardinal at the beginning of his book is : “The history of Canada’s Indians is a shameful chronicle of the white man’s disinterest,
David Garneau’s article on “Imaginary Spaces of Conciliation and Reconciliation” offers a refreshing outlook on the term and implantation of reconciliation in post-colonial culture. He argues that conciliation would evoke an individual transformation of the settler if Aboriginal history was accepted as independent yet in union with the history of Canada. Garneau’s vison of conciliation is centered on this idea of an imaginary space between the settlers and Aboriginals and, within this space, settlers are separated from Aboriginals to naturally reflect on the Aboriginal’s experiences of colonialism. However, the implications of this space also created a void in society because the residential schools are the imaginary spaces in which settlers are reconciling. The direction of Garneau’s article is insightful to understanding how reconciliation has failed in countries and how it’s practice, in accordance with religious connotations, has created an underlying tone of “charity” and “pardon” opposed to restorative justice (35).
Generations of native people in Canada have faced suffering and cultural loss as a result of European colonization of their land. Government legislation has impacted the lives of five generations of First Nations people and as a result the fifth generation (from 1980 to present) is working to recover from their crippled cultural identity (Deiter-McArthur 379-380). This current generation is living with the fallout of previous government policies and societal prejudices that linger from four generations previous. Unrepentant, Canada’s ‘Genocide’, and Saskatchewan’s Indian People – Five Generations highlight issues that negatively influence First Nations people. The fifth generation of native people struggle against tremendous adversity in regard to assimilation, integration, separation, and recovering their cultural identity with inadequate assistance from our great nation.
Systemic discrimination has been a part of Canada’s past. Women, racial and ethnic minorities as well as First Nations people have all faced discrimination in Canada. Policies such as, Charter of Rights and Freedoms, provincial and federal Human Rights Codes, as well has various employment equity programs have been placed in Canada’s constitution to fight and address discrimination issues. Despite these key documents placed for universal rights and freedoms Aboriginal and other minority populations in Canada continue to be discriminated against. Many believe there is no discrimination in Canada, and suggest any lack of success of these groups is a result of personal decisions and not systemic discrimination. While others feel that the legislation and equality policies have yet resulted in an equal society for all minorities. Racism is immersed in Canadian society; this is clearly shown by stories of racial profiling in law enforcement.

Martha Hodes’ article, “The mercurial Nature and Abiding Power of Race: A Transnational Family Story,” offers a narrative based examination of the malleable terms on which race was defined. To accomplish this she examines the story of Eunice Connolly and her family and social life as a window into understanding the changing dimensions of race in nineteenth-century America and the Caribbean, specifically New England and Grand Cayman. While Hodes’ article examines the construction of race in the Americas, Ali A. Mazrui’s piece, “The Re-Invention of Africa: Edward Sai, V. Y. Mudimbe, and Beyond,” looks at the construction of African identity. Although different in geographic loci, the two articles similarly examine the shaping influences of race and identity and the power held in ‘the Other’ to those ends.
