Superior Corporation is growing and more space is needed to accommodate the growing workforce. Previously, the company leased an entire floor of a shared office building to house its Research and Development operations. Now, Verne Jacobs, CEO of Superior Corporation, has decided to lease additional office space in the same building. A two-year lease has been signed for the new space while Superior Corp builds more office space at the corporate headquarters. The new remote campus is about 35 miles from the main campus and is located in a large commercial office complex. The theft of company trade secrets and other confidential information is a problem faced by every company. Trade secrets can include, sales methods, customer lists, new product development plans, price and cost lists, proprietary software, and a host of other valuable intellectual properties (Bush & Moye, 2015). By locating the R&D facility at a remote campus, along with other business functions, Superior Corporation is now at a greater risk due to the potential loss of intellectual property. In addition to being located remotely, this new campus is shared with a competitor, further compounding these problems. Superior Corp. is responsible for providing its own security at the remote site. The CEO of Superior Corp. has elected to lease office space in a building which is shared by a competitor. This is a highly risky decision, especially considering the CEO has also elected to locate the Research and Development operations within the same building. There are many communal spaces within the leased building including a cafeteria, smoking areas, restrooms and parking area. This poses serious new security concerns facing security management team. Providing security at this location for intellectual property is now a major concern, especially for the R&D

The major complication introduced if economic espionage or misappropriation of a trade secret involves a foreign entity is prosecuting the person responsible for the theft. These cases often go unreported due to the low success rate of the court cases. It is extremely difficult to find enough evidence to convict the culprit. “Often, the greatest challenge in prosecuting economic espionage, as opposed to trade secret theft, is being able to prove that the theft was intended to benefit a foreign government or foreign instrumentality (Coleman, 2014)”. “The beneficiary of the stolen trade secrets may be traced to an overseas entity, but obtaining evidence that proves the entity’s relationship with a foreign government can be difficult (Coleman, 2014)”. Spokane Industries has contracted Franklin Electronics for an 18 month product development contract. Franklin Electronics is new to using project management methodologies and has not been exposed to earned value management methodologies. Even though Franklin and Spokane have worked together in the past, they have mainly used fixed-price contracts with little to no stipulations. For this project, Spokane Industries is requiring Franklin Electronics to use formalized project management methodologies, earned value cost schedules, and schedules for reports and meetings. Since Franklin Electronics had no experience with earned value management, the cost accounting group was trained in the methodology in order to bid for the project.
In addition to the value these two trade secrets hold for Cyclops, their misappropriation brings in major legal implications and consequences. Such negligence and failure on Cyclops’s part to protect its client confidentiality as well as its IP will result in dire consequences including business losses, legal liability, loss of company goodwill and customer faith, and in general embarrassment in the business world.
