In the article written by The Economists titled “Too many laws, too many prisoners” it talks about the prison system today and the flaws the system contains. Personally I do not believe prisons help those who commit crimes 100 percent. Yes, it allows them to think about what they have done and go back and question that decision. But people are not always sorry for what they have done and would do it again. Allowing them this time to do nothing is not good for the American society as a whole. By having so many people locked up it creates an unequal balance of society. Criminologists say basically too many people are away for too long, the system is unpredictable, and laws are not written clearly, and it criminalizes acts that should not be criminalized. When reading this I wondered why these problems are not fixed; if those who are criminologists see a problem with something that they know very well and study something needs to be changed in the system. Everything stated by the criminologists I believe is true people are being put in jail for a very extensive time that does not fit the crime. Such as the case of Mr. Norris the man who sold flowers, he could have gotten a potential of 10 years because some of his paperwork was not correct. To think a man would lose 10 years of life because of a piece of paper truly shows the problem with the justice system. I also did not like how he was housed with others whose crimes were far worse than his he could have been harmed. The second problem about laws not being written clearly is a huge issue because it leaves room for generalization and every case is different. A judge should view these things case by case rather than attempting to generalize them because the law says they have to have a minimum amount of years. Even though these theories have added to societies understanding of criminal behaviour, all have been unable to explain why punishment or treatment of offenders is unable to prevent deviancy, and thus are ineffective methods of control. The new penology is a contemporary response that favours the management of criminals by predicting future harm on society. However, all criminological theories are linked as they are a product of the historical time and place, and because of their contextual history, they will continue to reappear depending on the current state of the world, and may even be reinvented.
Over the past several decades, the number of prison inmates has grown exponentially. In 1980, prison population had numbers around half a million inmates. A graph of statistics gathered from the U.S. Bureau of Justice shows that between 1980 and 2010, the prison population grew almost five times, topping out at nearly 2.5 million. According to an article in The New York Times, the average time spent in jail by prisoners released in 2009 increased by 36% compared to prisoners released in 1990. Many people, such as those at Human Rights Watch, believe that the increase of these numbers has been because of tough-on-crime laws, causing prisons to be filled with non-violent offenders. This rise in crime rates, prison population, and recidivism, has led politicians as well as ordinary citizens to call for prison reform.
The number of Americans that are in prison has elevated to levels that have never been seen before. Prisons in the US have always been crowded ever since the first prison was invented (Jacobs and Angelos 101). The first prison in the US was the Walnut Street Jail that was built in Philadelphia in 1773, and later closed in the 1830’s due to overcrowding and dirty conditions (Jacobs and Angelos 101). According to Mark Early, president of the Prison Fellowship International, the Bureau of Justice Statistics report shows that there are 19 states that have prisons operating at 100 percent capacity and another 20 are falling right behind them. There is no wonder why the overcrowding of prisons is being discussed everywhere. Not to mention how serious this predicament is and how serious it can get. Many of the United States citizens don’t understand why this is such a serious matter due to the fact that some of them believe it’s not their problem. Therefore they just don’t care about it. Also, some Americans may say that they don’t care about what could happen to the inmates due to repercussions of overcrowding, because it’s their own fault. In order to cure this growing problem people have to start caring about what’s going on, even if it’s to people who might deserve it.
Today, half of state prisoners are serving time for nonviolent crimes. Over half of federal prisoners are serving time for drug crimes. Mass incarceration seems to be extremely expensive and a waste of money. It is believed to be a massive failure. Increased punishments and jailing have been declining in effectiveness for more than thirty years. Violent crime rates fell by more than fifty percent between 1991 and 2013, while property crime declined by forty-six percent, according to FBI statistics. Yet between 1990 and 2009, the prison population in the U.S. more than doubled, jumping from 771,243 to over 1.6 million (Nadia Prupis, 2015). While jailing may have at first had a positive result on the crime rate, it has reached a point of being less and less worth all the effort. Income growth and an aging population each had a greater effect on the decline in national crime rates than jailing. There are several fundamental problems within America’s penal system. First, the name “penal” system indicates that the main focus is punishment. Punishment is meant to “teach them a lesson,” i.e. deter the convicts from future crime. Reasonable or unreasonable, punishment often results in the punished resenting and holding negative feelings for the punisher. If society is the punisher, inmates will not be motivated to go back into the general populace as a valued and productive member of society. Furthermore, prison has been commonly known to be both a training ground for more sophisticated crime as well as psychologically hardening nonviolent or innocent inmates that were falsely accused.
The Criminal Justice system was established to achieve justice. Incarceration and rehabilitation are two operations our government practices to achieve justice over criminal behavior. Incarceration is the punishment for infraction of the law and in result being confined in prison. It is more popular than rehabilitation because it associates with a desire for retribution. However, retribution is different than punishment. Rehabilitation, on the other hand is the act of restoring the destruction caused by a crime rather than simply punishing offenders. This may be the least popular out of the two and seen as “soft on crime” however it is the only way to heal ruptured communities and obtain justice instead of punishing and dispatching criminals
Since crime keeps occurring, more and more prisons need to be built and kept running for the increasing numbers of inmates that are pouring into prisons. Prison may be part of the solution, but there are other alternatives to help criminals. If we were to incorporate facilities like drug rehabilitation and job training into the criminal justice system, then crime would be greatly reduced. Prisoners would commit fewer crimes after the experience of these facilities, therefore reducing the cost of building and maintaining prisons. The end result will be that the American taxpayer's dollars will be available to go to more productive things than prisons.
Overcrowding in our state and federal jails today has become a big issue. Back in the 20th century, prison rates in the U.S were fairly low. During the years later due to economic and political factors, that rate began to rise. According to the Bureau of justice statistics, the amount of people in prison went from 139 per 100,000 inmates to 502 per 100,000 inmates from 1980 to 2009. That is nearly 261%. Over 2.1 million Americans are incarcerated and 7.2 million are either incarcerated or under parole. According to these statistics, the U.S has 25% of the world’s prisoners. (Rick Wilson pg.1) Our prison systems simply have too many people. To try and help fix this problem, there needs to be shorter sentences for smaller crimes. Based on the many people in jail at the moment, funding for prison has dropped tremendously.

Both the medical model and the community model were great attempts to better our system of corrections. There major problems were that they did not consider all of the options and the problems that may occur. Combing these three systems seems like it would work because it gives people the opportunities they need while still satisfying the public’s safety in incarcerating them to pay for their crime. Crime will never be completely abolished because people have a free will to act as they wish and some people are just evil. Even though crime will probably never be fully ended, we should may every attempt possible to rehabilitate those who have previously offended to prevent them from re-offending.

Crime is a major social problem in the United States. While the correctional system was designed to protect society from offenders it also serves two specific functions. First it can serve as a tool for punishing the offender. This involves making the offender pay for his/her crime while serving time in a correctional facility. On the other hand it can serve as a place to rehabilitate the offender as preparation to be successful as they renter society. The U.S correctional system is a quite controversial subject that leads to questions such as how does our correctional system punish offenders? How does our correctional system rehabilitate offenders? Which method is more effective in reducing crime punishment or rehabilitation? There are many different aspects of criminal justice policy. One in particular is the different theories of crime and how they affect the criminal justice system. The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists. The last theory is about Critical criminology. Their goal was to transform society in a way that would liberate and empower subordinate groups of individuals.

The contributions of these philosophers regarding punishment still influence modern corrections today. The Classical School of Criminology advocated for better methods of punishment and the reform of criminal behaviour. The belief was that for a criminal justice system to be effective, punishment must be certain, swift and in proportion to the crime committed.
