The school has stripped us of parts of Amendment 1, and all of Amendment 5, and changed Amendment 6. With Amendment 6, they reverse it completely. The Bill of Rights was crafted in 1791 by James Madison. It was put in place to protect the rights of all people within the borders of the United States when it is applied by the government. It is a very important document that means a lot in the hearts of Americans.
Over five years have passed since high school senior Joseph Frederick was suspended for 10 days by school principal Deborah Morse after refusing her request to take down a 14-foot banner he was displaying at a school-sanctioned event which read “BONG HiTS 4 JESUS.” Born as a seemingly trivial civil lawsuit in which Frederick sued the school for violating his First Amendment rights to free speech, the case made its way up to the U.S. Supreme Court, and the long-awaited ruling of Morse v. Frederick has finally been released. In a 5-4 split decision, the court ruled in favor of Morse and upheld the school board’s original ruling that Morse was acting within her rights and did not violate Frederick’s First Amendment rights by taking away his banner and suspending him for 10 days. The controversial decision has led followers of the case to question the future of student speech rights.
The case also states “A prohibition against expression of opinion, without any evidence that the rule is necessary to avoid substantial interference with school discipline or the rights of others, is not permissible under the First and Fourteenth Amendments” (Tinker v. Des Moines Independent Community School District). Because the students didn 't necessarily disrupt the education process, their First Amendment freedom of speech should not have been violated by the school officials.

The First Amendment of the United States gives citizens the five main rights to freedom. Freedom of speech is one of the rights. If people did not have the freedom of speech there would be no way of expressing one’s self and no way to show individuality between beliefs. This Amendment becomes one of the issues in the Tinker v. Des Moines Independent Community School District Supreme Court case that happened in December of 1969. In the case of Tinker v. Des Moines there were five students that got suspended for wearing armbands to protest the Government’s policy in Vietnam. Wearing these armbands was letting the students express their beliefs peacefully. Many people would consider that the school did not have the authority to suspend these petitioners because of the First and Fourteenth Amendments of the United States Constitution.

We live in the 21st century, where most Americans mind their own business but take for granted our God given rights. Not only God given rights but also those established by our founding forefathers. Through using case laws, the First Amendment, and previous cases, Justice Abe Fortas explains the reasoning behind why the principal was not permissible. In the first two paragraphs, Fortas provides a brief summary stating how the policy banning armbands go against the First Amendment. Today schools are changing to integrate the 21st century. Therefore, it is imperative that educational administrators are aware of the legal framework facing the issues in schools. There are many issues the administrators will face and they must know the constitutional rights of individuals and the school. The Constitution contains the laws of the United States.
At the beginning of each day in many public and private schools around the country, students stand and recite the Pledge of Allegiance. In fact, 35 states have passed laws mandating that the Pledge be recited on a daily basis. This issue has been a source of controversy for years. On one side of the argument exists families and educators who believe in the citizenship and patriotism that reciting the Pledge brings (Chiodo, 2011). On the opposing side, families and educators argue the possible threat to an individual’s First Amendment freedoms.
Teacher and Student rights have been evolving ever since the 60’s and 70’s. Prior to this, teachers substituted as the students’ parents while they at school, “en loco parentis”. Now, teachers have been restricted from laying a single hand on students or even saying anything that may offend them. In addition to strict regulations for teachers, they also implemented more limitations on students. Although I don’t think that teachers or students should be allowed to say and do whatever they please, there are some laws that need to be changed. The success of the students have a lot to do with the environment of the classroom and allowing the students and teachers to have freedom of speech, a healthy relationship, and getting rid of the zero tolerance rule will create an environment that is best for student learning and prosper.
