While the restorative justice movement has risen in recent years, the idea of circle sentencing, or peacemaking circles has been practiced in indigenous cultures for quite some time. As we look at implementing traditional indigenous culture practices as alternative dispute resolutions, we need to realize the effectiveness and also whether we are ready to use them. The Yukon and other communities reintroduced circles in 1991 as a practice of the restorative justice movement (Bazemore, 1997, p.27). Around that same time, Minnesota made the breakthrough in borrowing the practices with each band of Native Americans having their own political communications. Because Minnesota has seven Anishinaabe tribes and four Dakota communities, it has been one of the first states to lead the way for this new program. A circle sentencing program has also been implemented in North Minneapolis for African-American juvenile problems (Ulrich, 1999, p. 425).

The purpose of this paper is to examine why the justice system fails for First Nations persons and alternative rehabilitation methods used by Aboriginal people, comprised of Aboriginal people, for Aboriginal people, in hopes to rehabilitate offenders and prevent criminal behavior in the Aboriginal community from precontact to today. Through the attempts of Aboriginal people to take control of their own destiny’s in the ever going struggle to attain self-government I will examine the aims and structure of one of these alternative rehabilitation methods, the Sentencing Circle used today to address the need to return to community based “Restorative Justice Programs” in the Aboriginal community
The criminal justice system has been evolving since the first colonists came to America. At first, the colonists used a criminal justice system that mirrored those in England, France, and Holland. Slowly the French and Dutch influences faded away leaving what was considered the English common law system. The common law system was nothing more than a set of rules used to solve problems within the communities. This system was not based on laws or codes, but simply that of previous decisions handed down by judges. Although rudimentary, this common law system did make the distinction between misdemeanors and the more serious crimes known as felonies.
With matted hair and a battered body, the creature looked at the heartless man outside the cage. Through the dark shadows you could only see a pair of eyes, but those eyes said it all. The stream of tears being fought off, the glazed look of sheer suffering and despair screamed from the center of her soul, but no one cared. In this day in age I am ashamed to think that this is someone's reality, that this is an accurate description of a human being inside a Canadian women's prison . The classes I have previously taken at LSU forced me to view the criminal justice system as a failed institution and Eric Holder’s interview in VICE - Fixing The System solidified that ideology. We as Americans live in a country where the Justice Department has failed to collect on $7 billion in fines and restitutions from thirty-seven thousand corporations and individuals convicted of white collar crime. That same Justice Department while instead spending more than 350% since 1980 on total incarceration expenditures totaling $80 billion dollars. America has become a place where a 71-year-old man will get 150 years in prison for stealing $68 billion dollars from nearly everyone in the country and a five-time petty offender in Dallas was sentenced to one thousand years in prison for stealing $73.

I don’t know what people thought of when they saw JH’s family before their involvement with the criminal justice (CJ) system. However, I am sure they did not suspect the horrors that went on behind closed doors. JH, now about fifteen years old, was being sexually abused by his older brother and father. They both even recorded the acts. The criminal justice system is composed of three parts – Police, Courts and Corrections – and all three work together to protect an individual’s rights and the rights of society to live without fear of being a victim of crime. According to merriam-webster.com, crime is defined as “an act that is forbidden or omission of a duty that is commanded by public law and that makes the offender liable to punishment by that law.” When all the three parts work together, it makes the criminal justice system function like a well tuned machine.
Another reason that the criminal justice system hurts the prisoners communities is because police treat people unfairly in their arresting method. In an article called “New Yorkers Speak Out on Stop, Question and Frisk Policy”, different people discuss their experiences with Stop and Frisk. An African American medical assistant student from Brooklyn, Lashonda Jackson states “ I don’t think I should be stopped based on how I look”. A student from Bronx name Jorge Torres states “The police treat people as savages, with no respect.” This evidence shows that police are treating people bad based on how they look. Police talk to people in a rude way because they think they could do whatever they want. This evidence is important because is making
