Since arriving in America, African Americans have experienced racial discrimination in virtually every single area of their lives. America has come a long way since the 1800’s when slavery was common, but that road certainly hasn’t been easy or short for Black American. Not long after the Civil War ended, African Americans experienced a form of racial segregation called Jim Crow. The name "Jim Crow" originated from a character in an early nineteenth-century minstrel show song. A white minstrel blackened his face and jigged around while singing. The "Jim Crow" character regularly appeared in minstrel shows touring the South. Eventually, Jim Crow became the name of the racial caste system which operated primarily, but not exclusively, in southern and Border States. These laws legalized segregation from the 1860’s through 1967. The most widespread laws mandated racial segregation in schools and public places such as railroads, restaurants, and streetcars. Since segregation laws typically excluded African Americans from services, Jim Crow laws began as an attempt to move forward by providing separate services for blacks. These laws were adopted earliest in most southern towns and municipalities where diverse crowds lived. These communities passed vagrancy laws that controlled the influx of black homeless migrants. Many southern states during the 1880s and 1890s passed laws which required segregation. The Supreme Court held up the southern laws in Plessy v. Ferguson (1896), accepting guarantees from these states that the segregated areas would be equal. This case created the “separate but equal” doctrine and would not be challenged for some time. Some southern cities and states went on to mandated even the use of separate drinking fountains, restrooms, entrances to public buildings, and even Bibles for use in court. The south also alienated a majority of African Americans through literacy tests and poll taxes discriminating against blacks who could not pass such tests by restricting their right to vote. Almost every southern state approved laws controlling voting rights in the years from 1871 to 1889. These limiting laws were launched in Georgia in 1871 and 1877, in Virginia in 1877 and 1884, in Mississippi in 1876, in South Carolina in 1882, and in Florida in 1888. The effects were devastating. More than half the African Americans who voted in Georgia and South Carolina in 1880 disappeared from the polling places in 1888. Florida’s black voting population decreased by 27 percent.
Blacks were left at the mercy of ex-slaveholders and former Confederates, as the United States government adopted a laissez-faire policy regarding the “Negro problem” in the South. The era of Jim Crow brought to the American Negro disfranchisement, social, educational, and occupational discrimination, mass mob violence, murder, and lynching. Under a sort of peonage, black people were deprived of their civil and human rights and reduced to a status of quasi-slavery or “second-class” citizenship. Strict legal segregation of public facilities in the southern states was strengthened in 1896 by the Supreme Court’s decision in the Plessy vs. Ferguson case. Racists, northern and southern, proclaimed that the Negro was subhuman, barbaric, immoral, and innately inferior, physically and intellectually, to whites—totally incapable of functioning as an equal in white civilization.
Jim Crow Laws, enforced in 1877 in the south, were still being imposed during the 1930s and throughout. These laws created segregation between the two races and created a barrier for the Blacks. For example, even though African Americans were allowed to vote, southern states created a literary test exclusively for them that was quite difficult to pass, since most Blacks were uneducated. However, if they passed the reading test, they were threatened with death. Also, they had to pay a special tax to vote, which many African Americans could not afford.
Following the victory of the North over the South in the civil war, Black Americans were given independence. This led to court rulings such as the 13th, 14th and 15th Amendment, which granted all citizens equality before the law and stated that, the ‘right to vote should not be denied ... on account of race’. However, in practice these Amendments were not upheld, there were no measures in place to implement these rulings and no prevention of the ill treatment of Black Americans. Due to these new rulings, De Facto segregation increased especially with the establishment of the Ku Klux Klan (KKK). Also, in the South although the 15th Amendment gave everyone the right to vote, Jim Crow laws were put in place to deliberately prevent Black Americans from voting. Black Americans had differing views on how to deal with their situation, while some felt it was best to accept the status quo, others wanted to fight for equal rights but disagreed on whether they should integrate with whites or remain separate.
In 1863 to 1877 Reconstruction brought an end to slavery, it paved the way for the former slaves to become citizens. The African Americans wanted complete freedom. However, that right became a setback and were seen as second class citizens. Before the end of the Reconstruction, a legislation was passed called the Jim Crow law. The law enforced the segregation of people of African descent. The legislation was a system to ensure the exclusion of racial groups in the Southern States. For example, separate transportation law, school division, different waiting rooms both at the bus terminals and hospitals, separate accommodations, marriage law and voting rights. Separate but Equal doctrine existed long before the Supreme Court accepted it into law, and on multiple occasions it arose as an issue before then. In 1865, southern states passed laws called “Black Codes,” which created restrictions on the freed African Americans in the South. This became the start of legal segregation as juries couldn’t have African Americans, public schools became segregated, and African Americans had restrictions on testifying against majorities. In 1887, Jim Crow Laws started to arise, and segregation becomes rooted into the way of life of southerners (“Timeline”). Then in 1890, Louisiana passed the “Separate Car Act.” This forced rail companies to provide separate rail cars for minorities and majorities. Although the Fourteenth Amendment, when adopted in 1868, gave certain rights to blacks, including citizenship, equal protection of law and other freedoms, African-Americans were considered inferior by whites in this country. In 1896, Plessy v. Ferguson officially made segregation legal, and put “separate but equal” into effect. African-Americans were excluded from hotels, restaurants, theatres and schools. Black Status: Post Civil War America. After the emancipation of slaves in 1862, the status of African-Americans in post-civil war America up until the beginning of the twentieth century did not go through a great deal of change. Much legislation was passed to help blacks during this period. The Civil Rights Act of 1875 prohibited segregation in public facilities and various government amendments gave African-Americans even more guaranteed rights.
The Jim Crow system was a post-Reconstruction series of legislation that established legally authorized racial segregation of the African American population of the South soon after the Civil War. The Jim Crow system ended in the 1950s with the beginning of the Civil Rights Movement. As Hewitt and Lawson note, “these new statutes denied African Americans equal access to public facilities and ensured that blacks lived apart from whites.”
Although the 13th Amendment ended slavery, it did not solve the problem of unjust treatment towards African Americans. “Jim Crow Laws were laws in the South based on race. These laws promoted the idea of “separate but equal”. “The name "Jim Crow" comes from an African-American character in a song from 1832. After the song came out, the term "Jim Crow" was often used to refer to African-Americans and soon the segregation laws became known as "Jim Crow" Laws” (“Civil Rights for Kids”). These laws created segregation and made white Americans superior to all other races. The laws were in place for 77 years, but the harsh effects lasted for many years to come.

Toward the end of the Progressive Era American social inequality had stripped African Americans of their rights on a local and national level. In the 1896 Supreme Court case of Plessey vs. Ferguson, the Supreme Court sided with a Louisiana state law declaring segregation constitutional as long as facilities remain separate but equal. Segregation increased as legal discriminatory laws became enacted by each state but segregated facilities for whites were far superior to those provided for blacks; especially prevalent in the South were discriminatory laws known as Jim Crow laws which surged after the ruling. Such laws allowed for segregation in places such as restaurants, hospitals, parks, recreational areas, bathrooms, schools, transportation, housing, hotels, etc. Measures were taken to disenfranchise African Americans by using intimidation, violence, putting poll taxes, and literacy tests. This nearly eliminated the black vote and its political interests as 90% of the nine million blacks in America lived in the South and 1/3 were illiterate as shown in Ray Stannard Baker’s Following the Color Line (Bailey 667). While the Emancipation Proclamation marked the end of slavery in the U.S., it did little to address the racism that remained. Left unchecked, that racism, like a weed, grew and its roots permeated almost all sectors of American culture spreading from the southern white population throughout the local and state governments south of the Mason-Dixon Line. Jim Crow laws provided legal loopholes that skirted the spirit of the Emancipation Proclamation and they gave legal cover to those who longed for the pre-Civil War/Reconstruction era. The insidious nature of Jim Crow easily converted bigotry and intolerance from vile vices to prized virtues. Although Jim Crow laws were settled by the 1954 court case, Brown v. Board of Education of Topeka, where all laws and public policy based on the theory of "separate but equal" were deemed unconstitutional; they were not fully eliminated until the mid 1960's, almost one hundred years after the end of U.S. Civil War and the beginning of Radical Reconstruction.
Being a resident of South Carolina, African-American Culture was chosen as part of the applied learning project for the Intercultural Nursing class, because African-Americans make up more than a quarter of this state’s population. According to the 2010 United States Census Bureau, the total population for South Carolina (S.C.) is 4,625,364, with 27.9% being of African-American descent. The purpose of this paper is to develop an understanding and sensitivity to issues and cultural variances or phenomena that are unique to the African-American Culture. Another goal is to identify nursing interventions that are important for the nurse to consider in caring for this population. These phenomena’s include variances in social organization, communication, space, perception of time, environmental control, and biological variations associated with the African-American culture. In From Slavery to Freedom (2007), it was said that “the transition from slavery to freedom represents one of the major themes in the history of African Diaspora in the Americas” (para. 1). African American history plays an important role in American history not only because the Civil Rights Movement, but because of the strength and courage of Afro-Americans struggling to live a good life in America. Afro-Americans have been present in this country since the early 1600’s, and have been making history since. We as Americans have studied American history all throughout school, and took one Month out of the year to studied African American history. Of course we learn some things about the important people and events in African American history, but some of the most important things remain untold which will take more than a month to learn about.
