This article explains how in Texas, a judge has gone around Obama’s ruling that schools must allow transgender students to use the bathroom and locker room or their choice. Judge Reed O’Connor’s ruling exceeded ruling went above his authority, however he used Title IX of the Education Amendments of 1972 to get his ruling passed. This amendment states that a restroom or any other facility made for a certain gender is for that gender and that gender only. The judge went on to explain that this law is to protect people’s privacy while members of the opposite sex are around. He then went to explain how other states do not have to conform to the laws Obama is trying to implement based on Title IX. Transgender rights are taking multiple steps back to this ruling and also when a judge in Detroit let a funeral home owner get away with firing a transgender employee because transgender people are not protected under the anti-discrimination laws. The article then went back to the topic at hand, the ruling against Obama’s transgender bathroom laws in schools. The Obama Administration has threatened to cut back or withhold federal education funds to schools that refuse to let students use the bathroom that corresponds with their gender identity or use the proper pronouns. However, Texas General Attorney Ken Paxton has spoken out that this threat is illegal federal overreach. He agrees with the Texas judge 's ruling because he feels that he is correcting this. The article then continues to go on and interview a Dallas attorney for a gay rights group. In this case, the judge has shown the disrespectful opinion on a very controversial topic. The cause that he is going against has no impact whatsoever on his life. Everybody deserves to have the same rights and liberties in this country. These rights have been taken away from certain groups because do not “understand” them; if one cannot understand something, why would they go along with it? The answer should be obvious; they should go along with it because it does not affect them. They should go along with it because everybody deserves equality. This article goes to show that people have not taken very many steps in the right direction of this concept. A transgender, 25 year old woman named Avery Edison travelling from London, England was detained at Pearson Airport by Canada Border Service Agency. According to her, the reason for her detention was due to an immigration issue involving her overstaying a previous student visa. Despite being identified as a female on her passport, Avery had male genitalia. Avery tweeted that she would be assessed by a nurse before being placed in a male or female cell. However, the fact that she had male genitalia resulted in her being sent to Maplehurst, Correctional Centre in Milton, Ontario which is a prison for males where Avery stayed for one night. The United States Equal Employment Opportunity Commission (EEOC) notes, “Discrimination against an individual because that person is transgender is discrimination because of sex in violation of Title VII. This is also known as gender identity discrimination” ("EEOC - Sex," n.d., para. 3). According to Canas and Sondak (2014), many states have adopted legislation that supports transgender people as a protected class. Colorado passed legislation extending protection to transgender people in 2008 (Brinker & Maza, 2014). However, one of the biggest controversies surrounding transgender individuals is which bathroom should they use? Zanin (2009) notes, “bathrooms remain one of the most acceptable gender-segregated spaces in cities which can present problems to those who do not conform to gender norms…” (para. 1). The question, then, is should transgender people use the bathroom that most closely mirrors their biological gender or the gender they identify with? While individual beliefs may vary greatly, legally, there is less of a gray area. This paper will address the recently decided Colorado case involving a transgender six year old child, Coy Mathis, and her fight to use the girls’ bathroom at school. In addition to this, legal issues and implications employers should be aware of will also be discussed.

According, to Human Rights Campaign transgender is an umbrella term for individuals whose gender identity differs from what was assigned to them at birth it is about their gender identity. Transgender deals with gender identity; being born female or male at birth, but identifying with the opposite gender assigned at birth. The acts of violence against transgender individuals are extreme and hard breaking. People of trans continue to face discrimination and oppression on a daily basis. People of trans are often neglected by society and sometimes even by their own loved ones. Additionally, the suicide rate among the trans community is very high due to bullying and rejection they face.
Florida’s, Texas’s and Kentucky’s new proposed bathroom laws have “caused fear and dismay among transgender people around the country” (Tannehill). Kentucky laws are more focused on the school systems but Florida 's and Texas’s laws treat transgenders as if they were criminals. Both of these states have regulations that will give transgenders civil and or criminal charges for using the bathroom they identify with (Tannehill). A transgender could be charged a fine for using the wrong bathroom and “people who report a transgender people in the bathroom to claim civil damages, for example a bounty” (Tannehill). Florida and Texas are trying to look out for the best interest of the majority population, however, “we all have to use the bathroom, but these laws would seemingly force transgender people to choose between fines and jail, risking horrific violence or leaving the state” (Tannehill). These laws have been seen as unreasonable to the transgender community and have been fought by the ACLU lawyer Joshua Block, “We’re talking about people who also have their sense of privacy and modesty, and who are not going to want to have everyone see an anatomical part of themselves that they feel should never have been there in the first place,” (Marcus).
