The death penalty is always going to be a “hot topic” in today’s society. The Eighth Amendment guarantees a criminal’s rights against cruel and unusual punishment. The Eighth amendment was adopted in 1791, when beheading, burning at the stake and crucifixion was just a few of the ways to execute a criminal. Now in current times, the lethal injection has been on trial as cruel and unusual punishment. In 2008,the Supreme Court upheld the constitutionality of lethal injection. Clayton Lockett was a convicted murderer of a teenage girl, that he kidnapped, shot and buried alive. He received the death penalty.
