Topic 3- Summary of the chosen Act (Annotation)
Beginning on January 25, 1988 the 100th
finally complete October 22, 1988. This bill official introduction titled; “A bill to amend title 17, United
States Code, to implement the Berne Convention of the Protection of Literary and Artistic Works, as
revised at Paris on July 24, 1971, and other purposes. The “Berne Convention Implementation Act of
1988” ( hereafter referred to as “Berne Act” throughout this report) was approved October 31, 1988 and
went into force in the United States on March 1, 1989 as Public Law 100-568-Oct. 31, 1988. The “Berne
Act” was created to protect Literary and Artistic work outline by the “Berne Convention for the
Protection of Literary and Artistic Works” (hereafter referred to as Berne Convention throughout this
report). The “Berne Convention” was formed September 9, 1886 in Berne, Switzerland to protect the
International Copyright Laws. According to the U.S Copyright Office document FL-100 there is no such
idea of “international copyright”. Individuals are protect by illegal copyright based on the Laws in the
nations that they reside. Since authors, artists, musicians, religious speakers, and others may have their
work distributed beyond the boundaries of their country or their country may not offer such Laws, what
can be done to protect their works? This is where conventions and copyright treaties are put in place to
protect these types of situation, there are two main convention that help protect individuals works
under copyright infringement, the Berne Convention and the Universal Copyright Convention (UCC).

Kastenmeier was a much decorated and intelligent man that was very qualified to be a great
Congressman. Throughout his stint in office Rep Kastenmeier work on many bills and laws including his
great influence in the Copyright Act 0f 1976, more than qualified him to sponsor the Berne Act.ii

Harry E Claiborne was the first federal judge to be sent to prison after being impeached from his seat as U.S
District Court judge for Nevada. In 1979 Mr. Claiborne failed to file more than $170,000 on his taxes and in 1986
was impeached on tax evasion. In 2004 Mr. Claiborne killed himself with a single gunshot wound at the age of 86.

But how much changes do we have to make to appropriate an art piece, for it to be considered complying with the copyright law. The copyright law protects an artist’s exclusive right to reproduce or authorize others to reproduce the artist’s work. But the copyright law isn’t as strict as we look at it to be because there isn’t such a thing as international copyright law because in different countries, there are different agreements on what a copyright law should be about.
