A Humboldt County courthouse judge on Thursday said a man facing murder charges for shooting down his wife’s lover will stand trial on separate charges that allege he assaulted his wife with a firearm.
Judge John Feeney scheduled a May 11 arraignment on information date after finding Jon Goldberg, 36, of Fortuna, after finding there was enough evidence to hold him to answer on a count of assault with a firearm with a special allegation he used a revolver to commit the crime and a second count of battery. Feeney did not rule he be held to answer on a count of brandishing a concealable firearm in public.
Goldberg is facing separate charges for the murder of Timothy Smith, 37.

Rachel Goldberg got in the car with her child and the mothers drove around to look for a place to Rachel Goldberg to stay.
Frida Smith said they picked up her daughter and at one point Rachel Goldberg received a call from her husband.
She recalled hearing him say in a loud voice over the phone that “it’s not OK for another man” to be engaged in an affair with his wife before hanging up.
After some time driving around, they eventually decided to drive past Timothy Smith’s house but were stopped by a roadblock that had been set up by police. When someone from the car asked an officer if a traffic accident was causing the delay the officer responded by saying there had been a “people accident,” Frida Smith said.
Rachel Goldberg was mortified by the statement, according to Smith but the two did not learn the altercation was fatal until sometime after. The mothers made their way to the police station where Frida Smith told Rachel Goldberg she ought to speak with police.
After she did give a statement to police she allegedly to Frida Smith that her husband had also assaulted her earlier that day.
“She told me Jon had been shooting around her that morning,” Frida Smith said.
