In this paper, I argue that same-sex marriage should be maintained legal in Florida. Furthermore, same-sex couples should have the ability to adopt children and have parenthood privileges. I argue that marriage is a civil right reflected in the United States Constitution and that the quality of parenting should not be determined according to sexual orientation.
Same-sex marriage critics claim that SSM is against Christian religious beliefs and should be maintained as the union between a man and a woman. They argue that procreation is a biological nature only heterosexual couples have and because of that, married same-sex couples should not be allowed to have children. Likewise, critics believe that married same-sex couples raising children will also affect the child’s behavior and mental health.
Same Sex marriage advocates support the legal union of homosexual and their partnership privileges. Same sex marriage is a debating issue at the Supreme Court; however, advocates claim that the Unites States Constitution and the Bill of Rights protect people from choosing their partnership freely. They argue that marriage is the union between two people in love, regardless of their gender, color or religion. The Supreme Court decision in 1857 prohibited African Americans from being recognized citizens, which deprived them of their rights. Similarly, denying same-sex couples the right to marriage eliminates their civil rights. The Fourteenth Amendment explicitly protects people’s rights to life, liberty and the pursuit of happiness. Justice Anthony Kennedy explains that “the reasons marriage is fundamental under the Constitution apply with equal force to same-sex couples” (Bier). Nonetheless, a comprehensive, organized and responsible person does not necessarily need to be heterosexual. The quality of a parent should be measured by how well are the parents prepared to take care of the child and the social environment in which they will be raised.
In conclusion, sexual orientation should not be a constraint for the person to be married or form a family. Children benefit from unions in which the parents are loving and care to provide for them a safe environment. The parents’ sexual orientation does not interfere with these parameters and society should not restrict or discriminate them for being different. All of the research to date has come to the same conclusion about lesbian and gay parenting. “The children of lesbian and gay parents grow up as successfully as the children of heterosexual parents. In fact, not a single study has found the children of lesbian or gay parents to be disadvantaged because of their parent’s sexual orientation” (American Civil Liberties Union, 1999, p.2). Other findings show that there is no evidence to state that lesbians and gay men are unfit to be parents. Home environments of lesbian and gay parents support their child’s development just as heterosexual parents. Good parenting is influence by a parent’s ability to create a loving and nurturing home. Finally, children of lesbian and gay parents grow up as happy and healthy as children of heterosexual parents. In addition, the lesbian and gay “baby boom” will have a tremendous effect on the next generation. Since the early 1900s, homosexual people have become increasingly popular and greatly resisted. People that are homosexual face barriers placed upon them by the political system and society. Due to these challenges, homosexuals fought to have the same marital and parental rights as heterosexual people. Same-sex adoption is not prohibited in most states in the United States of America and many places worldwide. Family is not determined solely on blood relations and should be legalized in all parts of the world; because homosexual parents are just as good as heterosexual parents, if not better, and can provide an enriching second chance for many children waiting to be adopted.

However a recent debate over same-sex marriage has stirred a nationwide debate reverberating in the halls of Congress, at the White House, in dozens of state courtrooms and legislatures, and is also becoming a speech-making topic for election campaigns at both the national and state levels. As the debate for this controversial topic rages on, the American religious community view on the topic remains deeply divided over the matter and over the morality of homosexuality in general. My approach to this controversial topic of gay parenting will be that of attempting to analyze the Pro side first. Gays and lesbians deserve equal rights in our society. Society has to realize that the modern family has transformed into many different forms in recent years in that the "nuclear family" is not necessarily the best.
Gay marriages should be banned because God did not intend women to sleep with each other, nor men with men. It is a major sin. Plus, children should not be taught that same sex relationships are permitted. The effects on young children being subjected to gay marriages is the major problem. The effects will vary in children with has parents who are gay. Many children become confused and will not understand why they have two parents of the same sex, and when all the other children have one of each. This is when other children begin to ask questions, and once an adult explains to a child, the teasing comes into play. A child whose parents are gay will be taunted in school or some of the children may not understand and think that that child’s family is wired and become scared. This could bring child self-esteem down and their confidence. These are just some reasons why gay marriages should be banned.

In the case US vs. Windsor, the legal question: “Does the Defense of Marriage Act [...] deprive same-sex couples who are legally married under state laws of their Fifth Amendment rights to equal protection under federal law?” The Defense of Marriage Act (DOMA) defines the term “marriage” under federal law as a “legal union between one man and one woman”. The ultimate ruling of the case US v. Windsor declared that Section Three of the Defense of Marriage Act was unconstitutional. The social and economic effects of the decision was not universal in effect, and unfortunately, since states retain power to allow or deny same-sex marriages, over nine-million Americans are still being stripped of their rights.

Many people think that a child raised by same-sex parents is going to grow up troubled and turn out like their parents. That is not always the case however. According to one book, studies have found that there is a large absence of distinguishing characteristics among the lifestyles, child-rearing practices, and general demographic data of homosexual and heterosexual parents. There has not been any study which has found children of homosexual parents to be disadvantaged in any way compared to heterosexual couples children. In fact, the evidence suggests that the home environment of homosexuals are as likely as those provided by heterosexual parents to support and enable children’s psychosocial growth (Minter 70). In other words, this is saying that children with gay parents turn out just the same as children of heterosexual couples. Some sources suggest that children of homosexual couples grow up to be even more successful than those of heterosexual ones. One site says that there are, in fact, many advantages to being raised by same-sex couples. Some of these advantages are that girls raised by homosexual couples are more likely to seek professions outside of the feminine norm, and boys with homosexual parents are more likely to show affection and nurturing qualities towards others. There are many opponents of gay people as it is, and they all have their reasons to dislike the idea of permitting them get married. One of the main reasons is that the primary purpose of marriage is procreation. Because gay couples are unable to have children, they should not be allowed to marry (Schiffen 495). Another main argument is that the word marriage means the union of one man and one woman. This is a long-standing theme of most major Western religions. Under a proposed bill known as the Defense of Marriage act, marriage is defined as “a legal union between one man and one woman as husband and wife.” Furthermore, it defines a spouse as “ a person of the opposite sex who is a husband or wife” (What 1). Under these guidelines, it is quite obvious that gay couples would not be eligible for marriage. People against homosexual marriage also say that it is a person’s choice to be gay. Since the individual chooses to be a homosexual, they should not be given special privileges. Another argument that you hear is that these couples should not get married simply because of the torment and ridicule they would be faced with in their everyday lives. There are news reports from across America telling about how a gay person was beaten or killed just because they were looked at as different. Some of these people would end up the target of verbal abuse and maybe even physical abuse, just because some heterosexual people see them as different.
