Sexual Harassment in the Work Place
I. Definition
Sexual harassment is a form of sex discrimination that violates Title VII of the Civil Rights Act of 1964. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitutes sexual harassment when submission to or rejection of this conduct explicitly or implicitly affects an individual’s employment, unreasonably interferes with an individual’s work performance or creates an intimidating, hostile or offensive work environment.
Sexual harassment can occur in a variety of circumstances, including but not limited to the following:
The victim as well as the harasser may be a woman or a man. The victim does not have to be of the opposite sex. In Oncale v. Sundowner, the US Supreme Court decided just this month unanimously ruling that same sex complaints are covered by the law.
The harasser can be the victim’s supervisor, an agent of the employer, a supervisor in another area, a co-worker, or a non-employee.
The victim does not have to be the person harassed but could be anyone affected by the offensive conduct.
¨ Unlawful sexual harassment may occur without economic injury to or discharge of the victim.
The harasser’s conduct must be unwelcome.
It is becoming increasingly rare to find the traditional “quid pro quo” claim of sexual harassment. The current trend is that of a “hostile work environment” which can be much more difficult for the employer to address. The EEOC considers the following factors in determining whether or not an environment is sexually hostile:
Whether the conduct was verbal or physical or both
How frequently it was repeated
Whether the conduct was hostile or patently offensive
Whether the alleged harasser was a co-worker or supervisor
Whether others joined in perpetrating the harassment, and
whether the harassment was directed at more than one individual.
No one factor controls but an assessment is made based upon the totality of circumstances.
II. Regarding Employees

These are complicated issues and there are no cut and dry answers. Relationships develop in work areas all the time and always will. On a personal level, before you become involved with someone at work, there are consequences that should be considered. Once more, there have been many successful marriages so it is not necessarily taboo. If you are in a management position, you should be prepared to handle the complications that may result when one of these relationships go bad and effect work performance. For example, Michael’s boss could have handled the situation better. He actually made the decision to transfer Mary. Michael only recommended the transfer. Maybe he should have told Michael he needed to be the one to go.
As the political make up of the US Supreme Court changes, and the decisions that determine what constitutes sexual harassment change, Human Resource Managers need to be ready to adapt and change with those swings. Sexual harassment is just one of a myriad of issues that have to be dealt with.
Shaw describes two types of sexual harassment, “quid pro quo” and “hostile work environment” in both cases the victim can be a man or a woman and in both cases sexual harassment is illegal.
Warped Tour each day last about 12 ½ hours. It will always be held outside. It goes on rain or shine. The aftermath of Warped is when it’s done in one place it will always move to another (unless of course it’s over). The Equal Employment Opportunity Commission (EEOC), under Title VII of the Civil Rights Act of 1964, defines sexual harassment as a behavior of a sexual nature that affects an individual’s terms of employment or creates a hostile and intimidating work environment. According to the EEOC, it is “unlawful to harass a person, an applicant, or employee because of that person’s sex.” (Sexual Harassment) The term “sexual harassment” can be a bit misleading as other forms of work related harassment can take place that have nothing to do with ‘sex’ but do however, fall under the same umbrella. We will look to identify the different types of sexual harassment in the workplace, specifically, ‘Quid Pro Quo’ and what it’s like to work in a ‘Hostile Work Environment’. This paper will focus on the law, woman’s rights in the workplace, and discuss an example from the Supreme Court Case of: Meritor Savings Bank, FSB v. Vinson, 477 U.S. 57 (1986).
Each year many people first become aware of sexual harassment when they are harassed in the workplace. Today in the United States there still seems to be a need for general information about sexual harassment. Many people are unaware of exactly what sexual harassment is, how it affects its victims, where it happens, and what to do if it happens to them. There are many laws that protect people from sexual harassment and provide them with information about what to do if you should ever be in this situation (Wyatt, 2000).

His various reasons for delay in seeking revenge is that he wants to make sure his uncle Claudius is one hundred percent guilty and at the same time does not want to hurt his mother. He has too much Oedipus complex, love for his mother.
“Statistical research by Catalyst demonstrate that women account for 46.7 percent of the U.S. labor force” (Evans, 2011, p.62), but gender bias continues to distort employers hiring decisions intensifying the challenges women endure in the workforce. Controlling bias has been a goal of American society resulting in federal, state, and local laws preventing hiring discrimination in the workplace. There is a natural tendency for superiors to prefer to work together with members of the same sex or hire applicants close to their age. Male leaders are likely to hold stereotypes about women that influence employment decisions not based on an applicant’s ability, but rather categorization. Management often perceives male applicants as the only candidate or the best fit for the job, even though the position does not require masculine characteristics. Koch et al. (2015) highlighted that highly qualified women are seen “just as competent as men” however; these women are still unlikely to be hired over their less qualified male counterparts. Laws prohibit prospective employers from asking women about family responsibilities outright, nevertheless this subject often surfaces during the interview process. In today’s workplace, sexual harassment is a growing problem. The legal definition of sexual harassment is any unwelcome sexual advance or conduct on the job that creates an intimidating, hostile or offensive working environment. Another definition is the making of unwanted and offensive sexual advances or of sexually offensive remarks or acts, especially by one in a superior or supervisory position. Women and men of all ages, backgrounds, races and experience are harassed on the job. Sexual harassment encountered in workplaces is a hazard across the world that reduces the quality of working life, jeopardizes the well-being of women and men, undermines gender equality and imposes costs on firms and organizations.
