Good morning Minister of the Families I am Juliet and I will be your consultant for today. I will be outlining the aspects of the law of Domestic and family violence that has a flaw in society. I will be analysing the current laws, evaluating the effectiveness of the law, comparing these laws, making recommendations for changes in the law and justifying how the proposed changes adequately address the needs of the Australian society. Domestic violence is a violent or aggressive behaviour within the home, typically involving the violent of a spouse or partner. Domestic violence in Australia occurs in the privacy of people’s homes and it is mostly upon women that are disadvantaged.
In the article Shwadyer explores the term homophobia and homosexual in society and its definition. She also examines the aspects of domestic violence and its toll on the relationship, survivor empowerment, violence statistics, and the changing views in politics/laws. But, Shwadyer does point out that data on same sex partner abuse is significantly low to that of heterosexual couples. With recent debates on same sex marriages psychologists and researchers have provided more data on same sex domestic violence. Even though they researchers and advocates provide some resources on the LGBT community, the majority of the information is too narrow to relate to its victims. Therefore, states and violence shelters need to urge same sex partners to speak up and mentor the LGBT’s in their population (Joyful heart foundation. 2013).
Sexual assault is the act of sexual intercourse without consent of the other person according to New South Wales Consolidation Act of 1900 (Austlii 2011) and is also described by the Australian Standard Offence Classification as ‘non-consensual’ acts or intents of sexual nature (ASOC 2008, p. 31) has become one of the most predominate crimes creating social harm in Australia. Social harm is defined as the negative influence through consequences impacting from the individual to the living conditions of the surrounding public (Cain & Howe 2008, p. 26). Sexual assault poses a social threat to all aspects of community, spreading insecurity in the 9000 victims across Australia and 1900 victims in NSW alone as indicated in the Australian Bureau of Statistics Crime Victimisation Report (ABS 2011, p. 40). This is supported by the victimization rate of all sexually assaulted victims between ages 10 to 14 being 4 times greater than all the other age groups (ABS 2010). Another major issue within the boundaries of sexual assault is that it holds one of the lowest prosecution rates with only 1 in 10 incidents able to prosecute the offender as guilty (Fitzgerald 2006, Pg. 1). The abundance of statistics and reports conducted all imply that sexual assault is still a predominate issue of crime within Australia.
For young girls in Australia it has been said that ‘one barometer of the health of society is the measure of mental health of our children and young people’. This measure does not bring us good news. Evidence indicates that exposure to ideals of sexual attractiveness in the media is associated with greater body dissatisfaction among girls and young women, leaving girls feeling ‘ugly’ and ‘gross’. Body image is not the only side effect of sexualisation. The increase in sexual activity among adolescents is at an alarming rate, and the age of sexual activity is ever decreasing. Domestic violence is a terrible curse to all those involved. It inflicts harm on the victim, the perpetrator and witnesses, whether they be children or not. While support services have long been available to assist women and/or children overcome any issues that arise as a result of domestic violence, these services have left out a significant portion of victims, those that are male. In 2012 The Australian Bureau of Statistics found “That 33.3 per cent of victims of current partner violence during the last 12 months were male” (ABS, 2012) and “37.1 per cent of victims of emotional abuse by a partner during the last 12 months were male” (ABS, 2012). This shows the amount of victims that are being left behind by domestic violence support networks in their current state, despite their good intentions. For such a painful and difficult time it is not adequate to leave one third of those suffering behind.
The Family Law Act was first considered for change as the Government felt that the original act did not deal well with family violence, this led to a National Plan being developed to reduce violence against women and their children . Their lives have not always been easy, because they have been persecuted and sometimes even forced to go through a psychiatric evaluation. At the same time, in order to gain their rights and dignity, they had to take their fight to the legal system because as George Chauncey, a professor of history at Yale University mentioned, “although most people recognize that gay life was difficult before growth of the gay movement in the 1970s, they often have only the vaguest sense of why: that gay people were scorned and ridiculed, made to feel ashamed, afraid, and alone” (290). Intimate partner violence is still a common issue that affects women from all walks of life. It is an issue that is too often ignored until the violence has become deadly. In the book “Women: Images and Realities a Multicultural Anthology,” chapter seven entitled “Violence Against Women” includes pieces that cover the issue of intimate partner violence. In Michele McKeon’s piece “Understanding Intimate Partner Violence” she states that “In 1994 the Violence Against Women Act was passed, revolutionizing programs, services, and funding for individuals affected by intimate partner violence and their families” (McKeon 497). Yet the revolutionized programs, which McKeon speaks of, haven’t changed the fact that the violence continues and in my opinion, it is not enough to just deal with the aftermath of the violence, the prevention of intimate partner violence is something that society needs to address. Many think that it is their fault because they think they’ve done something wrong to cause their spouse attack them. In today’s world, as humankind is still in progress, we have a much more liberated world compared to past. In terms of politics, we learned discrimination is not a honourable case to be involved in and we tried to minimize constraints reflected on “other” races, “other” nationalities, in short all of the others that are not similar to “us”. “Us” is, without doubt, white, Western man. Despite all the back-drawed prejudices of others in the name of liberation, respect and equality, it does not seem to be the situation for non-heteronormatives to live in a peaceful environment. Since I came to Amsterdam as an exchange student this term, I had the opportunity to experience daily-life with all the people from different sexes, genders not considered “normal” which is rarely the case in Turkey. Amsterdam made me face non-heterosexual world and I realized that these people do suffer from unequal rights mostly in other parts of the world. I questioned myself as being far away from that topic in the past and it really made sense to me to investigate about supremacy of heterosexuals.
This article shows a research about harassment and discrimination towards the young gay associated with their mental health. In the article, first, the authors record gay men from different cities six months incidence about their experience about harassment, discrimination and physical violence. Second, the article draws a table to show that the harassment, discrimination and victimization give lots of stress in their life. The author compares and contrasts the co-relation between the self-esteem and suicidal ideation to verbal harassment, discrimination and physical violence. Even up until now, the controversial issue of homosexuality is still apparent and widely discussed in many countries all over the world. Although many people are becoming more open minded and less skeptical about homosexuality, many more are still reluctant to accept the LGBT (lesbian, gay, bisexual and transgender) communities as equals. Whilst many may argue that their religion absolutely forbids same sex marriages, thus, rejecting the idea of homosexual relationship, many of them feels it is their right to make the gays and lesbians straight again. For instance, in South Africa, many males practice corrective rape. It is a form of hate crime towards lesbians in order to ‘cure’ them of their homosexuality in order to change them into heterosexuals (Strudwick, 2014). This proves how sick and twisted the minds of homophobes are. As a Catholic myself, even though I was taught that same sex relationship is wrong and not natural, I do not condemn homosexuals or look down on them. In fact, I even have friends that are gay or bisexual. It is good that more countries have now implemented new laws to protect the LGBT community. This ensures the lower crime rate and discrimination of the LGBTs. Despite the fact that a few European countries and several others have legalized same sex marriages, there are still rejection and objection from some parties particularly from the Roman Catholic Church (Bingham, 2005). Why does the Church have such strong objections? Through my research, I will discuss on the views and teachings of the Catholic Church on homosexuality and same sex marriage.
Homosexuality has been the topic of constant conflict today. Homosexuality is defined as, a romantic attraction, sexual attraction or sexual behavior between members of the same sex or gender. In addition, homosexuality has been accepted more today, however, it is still frowned upon by many. Consequently, there are many challenges on the views of homosexuality. Some may think that this is an abnormal behavior, to have an attraction to the same sex. Gender and sexuality can be comprehended through social science. Social science is “the study of human society and of individual relationships in and to society” (free dictionary, 2009). The study of social science deals with different aspects of society such as politics, economics, and the social aspects of society. Gender identity is closely interlinked with social science as it is based on an identity of an individual in the society. Sexuality is “the condition of being characterized and distinguished by sex” (free dictionary, 2009). There are different gender identities such as male, female, gay, lesbian, transgender, and bisexual that exists all around the world. The three different areas will be compared by the two different societies to understand how much changes has occurred and whether or not anything has really changed. In general a traditional society is more conservative where as a modern society is fundamentally liberal. This is to say that a traditional society lists certain roles depending on the gender and there are stereotypes that are connected with the genders. One must obey the one that is dominant and make decisions. On the other hand, a modern society is lenient, It accepts the individual’s identity and sexuality.
