Some believe that, as it is the job of a court to protect society, therefore, sending a child to an adult prison is only right for offenders so that they are out the way of society. Minors who spend time in adult penitentiaries are presumed to have changed the way they act and no longer commit crimes once they have completed their prison sentence and are back in the free world. It is also thought to be unjust that a seventeen year old receives a more lenient sentence to an eighteen year old, even if the latter is only a few months older. Those who oppose this point believe that a crime is a crime, no matter the age of the offender. Also consider the fact that juveniles need to be imprisoned in order to make the necessary changes to their life, forcing them to realise their errors that lead to their punishment.
In the late 1980’s California and other states passed laws aimed at reducing what states saw as an epidemic of gang-related crimes by youths. Most parental responsibility punishes parents for what they haven’t done. The laws make parents criminally reliable because of them not fulfilling their parental duties of keeping their children from breaking the law. Parental responsibility laws are one vehicle by which parents are held accountable for at least a minimal amount of damage caused by their children as a result of intentional acts or vandalism. When each state imposes legal responsibility on parents and legal guardians for the delinquent and criminal acts of minors in their charge.
By this the state has the best interest for the child and will act in whatever manner necessary to accomplish this. Although the State does understand that juveniles should be treated as if they are less to blame for a crime than an adult, there have been many counts of juvenile cases that raise questions about current laws. When a juvenile commits a crime that would normally see an adult face serious time in prison, the sentencing process falls nowhere in the same category. This is because of the certain rules and regulations for courts in the Juvenile System that limit the juvenile sentencing drastically. Just for the reasoning that a juvenile is a growing human being with an undeveloped brain, does not condone a juvenile to commit gruesome crimes that will conclude in no way near the punishment deserved.
It is impossible to deny the emotional and physiological differences between adolescents and adults. However, I think that despite these natural changes we go through as humans, occasionally there are deformities that can be the cause of some to deviate from this natural pattern of progression. I believe in some cases, once a juvenile has crossed the line of murder and victimization, there is very little anyone can do to prevent it from happening again. Because of this, I support JLWOP sentencing when the psychological stability of the juvenile is compromised. The JLWOP sentence is a sentencing guideline that is being debated by the Supreme Court following the ruling against children receiving the death sentence in 2003.
If they committed adult crimes there shouldn’t be any reason why they don’t deserve to be in adult prison. According to Gabriella’s blog, “The Pro side argues that a crime is a crime, no matter what the age is. Only because a child commits a crime it does not mean that the victim didn 't suffer” (Canada). The crimes of juvenile have been rising up so is it times to stop them by putting them in adult prison with the rest of the adult criminals? The Juveniles are mature enough to know what is right and wrong.
Another reason why I think juvenile offenders should not be tried as adults is because many of these juveniles come from an unfit home that can lead them to call out for attention by committing a crime and see if anyone would care.
