Analyzing the Problem
Jail overcrowding is a concurring problem within our criminal justice system. As one of the biggest single problems within the prison system. There are many presumed causes that have been attributed to overcrowding of prisons, yet there is no set cause. Many attributed the cause to the war on drugs, penal code, recidivism rates and harsher sentencing laws.
History of the Problem “Well over 2 million individuals are confined in jails, with inmate populations rested at 95% of the facilities capacity in states such as Alabama and California in 2004”. The United States Sentencing Commission focuses on modifying and improving crime policy and sentencing guidelines. It seeks to acknowledge proportionality in sentencing guidelines. Not only has the United States Sentencing Commission stated the need for change it has opted to making changes. It made recommendations which stated the following “Congress should consider expanding the so-called “safety valve” at 18 U.S.C. § 3553(f) to allow a greater number of non-violent, low-level drug offenders drug offenders to be sentenced below the mandatory minimum penalties”.
System Analysis
According to the text, “Jails interact extensively with law enforcement agencies, courts, probation, and local government (Walter& Welsh, 2013)”. A police officer’s discretion is used to make a decision whether or not make an arrest. And district attorney’s influence on how suspect are processed into the criminal justice system depending on their age. Each of these law enforcement agencies influence who is going in and out of the criminal justice system. Each of these agencies greatly influence how interventions can be shaped in order to combat the reoccurring problems.

Over the past couple of decades the UK’s prison population has exploded, causing an overcrowding crisis. Statistics show that intake has doubled since 1993 and the UK now has the largest population of prison inmates in Western Europe at 85,108. The Certified Normal Accommodation (CAN) for UK prisons is 75,440, so ‘the prison estate is currently holding just under 10,000 more people than it was designed to’ as reported by the Prison Reform Trust. Their research shows that ‘the 30 most overcrowded prisons in England and Wales are twice as likely to be rated as failing by the prison service’. Overcrowding is having a negative impact on the effectiveness and safety of the prisons which has been amplified by ‘cuts of more than 20% to the prison budget’ and ‘reformers argue that the best way to improve the system is to reduce both the number of people sent to prison and the amount of time they spend there’. After viewing the documentary: America's War on Drugs - The Prison Industrial Complex, it is clear that the Criminal Justice System is in desperate need of reconstruction and repair with policies such as the mandatory minimum sentencing act which has proven to be unsuccessful and unjust in its efforts to deter 'criminals from committing illegal acts' as seen with the increase of incarcerations of the American people and the devastating effect it has had on those in prison and the family members of those incarcerated.
As offenders are diverted to community residential treatment centers, work release programs and study release centers, the system sees a decrease or stabilization of the jail population. While the alleviation of overcrowding is a benefit it is not the only purpose of diversion. A large majority of crimes are committed while under the influence of drugs or alcohol. Studies have shown that more than half of all individuals arrested in the United States will test positive for illegal substances (NCVC, 2008). Efforts to reduce crime through incarceration usually fail because incarceration does not address the main problem, the offender’s substance abuse.
In recent years, there has been controversy over mass incarceration rates within the United States. In the past, the imprisonment of criminals was seen as the most efficient way to protect citizens. However, as time has gone on, crime rates have continued to increase exponentially. Because of this, many people have begun to propose alternatives that will effectively prevent criminals from merely repeating their illegal actions. Some contend that diversion programs, such as rehabilitation treatment for drug offenders, is a more practical solution than placing mentally unstable individuals into prison.

The proliferation of prison overcrowding has been a rising concern for the U.S. The growing prison population poses considerable health and safety risks to prison staffs and employees, as well as to inmates themselves. The risks will continue to increase if no immediate actions are taken. Whereas fighting proliferation is fundamentally the duty of the U.S. government, prison overcrowding has exposed that the U.S. government will need to take measures to combat the flaws in the prison and criminal justice system. Restructuring the government to combat the danger of prison overcrowding, specifically in California, thus requires reforms that reestablishes the penal codes, increases the state’s budget, and develops opportunities for paroles to prevent their return to prison. The following context will examine and discuss the different approaches to reduce the population of state prisons in California in order to avoid prison overcrowding.
Today, half of state prisoners are serving time for nonviolent crimes. Over half of federal prisoners are serving time for drug crimes. Mass incarceration seems to be extremely expensive and a waste of money. It is believed to be a massive failure. Increased punishments and jailing have been declining in effectiveness for more than thirty years. Violent crime rates fell by more than fifty percent between 1991 and 2013, while property crime declined by forty-six percent, according to FBI statistics. While jailing may have at first had a positive result on the crime rate, it has reached a point of being less and less worth all the effort. Income growth and an aging population each had a greater effect on the decline in national crime rates than jailing. To begin, Mandatory minimum sentences result in prison overcrowding, and based on several studies, it does not alleviate crime, for example crimes such as shoplifting or solicitation. These sentencing guidelines do not allow a judge to take into consideration the first time offender, differentiate the deviance level of the offender, and it does not allow for the judge to alter a punishment or judgment to each individual case. When mandatory sentencing came into effect, the drug lords they were trying to stop are not the ones being affected by the sentences. There are many pros and cons to trying to reducing the number of overcrowding of prisons in the United States. Many would be opposed to the early release of those who have committed even menial crimes without thought to the issue of overcrowding. The solution isn’t to keep building new prisons, but to have prisons, law makers and rehabilitative programs all work together for the main goal of public safety. In order to maintain public safety, certain measures need to be taken to make sure those who are being released are no threat and that those who would pose a risk, are kept behind bars. Elliott Currie, a professor in criminology and law, suggests that building more prisons, imposing longer sentences, and harsh punishment will not lower the incarceration rate. In his chapter on “Assessing the Prison Experiment”, he explained that the increase of crime rate is not the sole reason that mass incarceration occurs, it was also because courts and legislature did indeed get ‘tougher” on offenders (Currie 14). Under the circumstance of the war on drugs, which was launched by President Richard Nixon, the incarceration rate and sentence longevity were increased dramatically as Currie discussed in his chapter. Currie also pointed out that the war on drugs had a huge influence on the incarceration rate of African American inmates, “ between 1985 and 1995, the number of black state prison inmates sentenced for drug offences rose by more than 700 percent” (Currie 13). Some of these offenders were sentenced more than ten years without parole, which releases prisoners before the completion of their sentences. The government should reconsider the current sentencing laws and reform the correctional system to solve our current mass incarceration
For county jails, the problem of cost and recidivism is exacerbated by budgetary constraints and various state mandates. Due to the inability of incarceration to satisfy long-term criminal justice objectives and the very high expenditures associated with the sanction, policy makers at various levels of government have sought to identify appropriate alternatives (Luna-Firebaugh, 2003, p.51-66). I. Alternatives to incarceration give courts more options. For example, it’s ridiculous that the majority of the growth in our prison populations in this country is due to people being slamming in jail just because they were caught using drugs. So much of the crime on the streets of our country is drug-related.
Overcrowding in our state and federal jails today has become a big issue. Back in the 20th century, prison rates in the U.S were fairly low. During the years later due to economic and political factors, that rate began to rise. According to the Bureau of justice statistics, the amount of people in prison went from 139 per 100,000 inmates to 502 per 100,000 inmates from 1980 to 2009. That is nearly 261%. Over 2.1 million Americans are incarcerated and 7.2 million are either incarcerated or under parole. According to these statistics, the U.S has 25% of the world’s prisoners. (Rick Wilson pg.1) Our prison systems simply have too many people. To try and help fix this problem, there needs to be shorter sentences for smaller crimes. Based on the many people in jail at the moment, funding for prison has dropped tremendously.

The “Tough on Crime” and “War on Drugs” policies of the 1970s – 1980s have caused an over populated prison system where incarceration is policy and assistance for prevention was placed on the back burner. As of 2005, a little fewer than 2,000 prisoners are being released every day. These individuals have not gone through treatment or been properly assisted in reentering society. This has caused individuals to reenter the prison system after only a year of being release and this problem will not go away, but will get worst if current thinking does not change. This change must be bigger than putting in place some under funded programs that do not provide support. As the current cost of incarceration is around $30,000 a year per inmate, change to the system/procedure must prevent recidivism and the current problem of over-crowed prisons.
There are many different alternatives to end prison overcrowding in prisons. The system of parole is one way that contributes the this issue. When individuals are release on parole it creates growth with in expensesand resources. Supivisors continue to establish new ways to control these issues. Many would agree that some incarcerated individuals should have stricter conditions and around the clock supervision.
