Quite often people ask the question, why should gay marriage be legalized? However, what they should really be asking is: why should other people be able to decide who one can or can not marry? When a marriage occurs between a man and a woman, society does not seem to care. Yet, when two men or two women decide to marry, society acts like it is completely absurd. People do not realize how beneficial legalizing same-sex marriage can be. Same-sex marriage should be legalized across the nation because it would benefit both individuals and society as a whole. There are two separate laws that protect married heterosexual couples; however, they do not help same-sex couples since they cannot legally marry in some states. Some of these laws are tort laws, which include wrongful death cases. Other examples of torts include assault, battery, conversion, fraud, false imprisonment, trespassing, and invasion of privacy. Tort laws protect individuals when either they or their loved ones are affected by the actions of someone else. When it comes to a wrongful death tort case, there are restrictions on who is able to sue. For example, if a person in a same-sex relationship dies, their partner is not allowed to sue because they are not legally married. It does not matter how long the couple has been together or how much they love each other, the living partner will not be paid any compensation. If a tort case occurs in a state where gay marriage is not legal, the law does not protect the partners, even if they were married in a state where gay marriage is legal. Making same-sex marriage legal in all fifty states would provide protection in a wrongful death case for gay couples.
