Navajo-Hopi Lande Dispute
When first considering the Navajo-Hopi land dispute as a topic of research, I anticipated a relatively light research paper discussing the local skirmishes between the two tribes. However, my research has yielded innumerable volumes of facts, figures and varying viewpoints on a struggle that has dominated the two tribes for over 100 years. The story is an ever-changing one, evolving from local conflict to forcible relocation to big business interests. The incredible breadth of the dispute's history makes it impossible to objectively cover the entire progression from all viewpoints. I will therefore focus on current issues - and their historical causes - facing the two tribes as they mutually approach a "common ground" on problems now facing both sides. I will also offer my own insight on the current state of affairs and the possible resolution to the dilemma plaguing 5 generations.
The recent history of the land dispute has its origins in 1882 when President Chester A. Arthur issued an executive order creating the ̃3.5 million acre Hopi reservation; one degree latitude by one degree longitude, hence its original square shape. The executive order was intended to alleviate local land conflicts among the tribes and to establish a protected homeland for the Hopi. Instead, it effectively set the stage for a convoluted century-long dispute.
From 1882 on, no real problems occurred until one of the world's densest deposits of accessible coal - representing about $10 billion in revenue - was discovered in the 1950s beneath land occupied by both tribes (Wood 1999), an area later established as the "joint-use area" (JUA) in 1962. For several hundred years people have sought answers to the Indian problems, who are the Indians, and what rights do they have? These questions may seem simple, but the answers themselves present a difficult number of further questions and answers. State and Federal governments have tried to provide some order with a number of laws and policies, sometimes resulting in state and federal conflicts. The Federal Government's attempt to deal with Indian tribes can be easily understood by following the history of Federal Indian Policy. Indians all over the United States fought policies which threatened to destroy their familial bonds and traditions. The Passamaquoddy Indian Tribe of Maine, resisted no less than these other tribes, however, thereby also suffering a hostile anti-Indian environment from the Federal Government and their own State, Maine. But because the Passamaquoddy Tribe was located in such a remote area, they escaped many federal Indian policies.
Nevertheless, in the author’s note, Dunbar-Ortiz promises to provide a unique perspective that she did not gain from secondary texts, sources, or even her own formal education but rather from outside the academy. Furthermore, in her introduction, she claims her work to “be a history of the United States from an Indigenous peoples’ perspective but there is no such thing as a collective Indigenous peoples’ perspective (13).” She states in the next paragraph that her focus is to discuss the colonist settler state, but the previous statement raises flags for how and why she attempts to write it through an Indigenous perspective. Dunbar-Ortiz appears to anchor herself in this Indian identity but at the same time raises question about Indigenous perspective. Dunbar-Ortiz must be careful not to assume that just because her mother was “most likely Cherokee,” her voice automatically resonates and serves as an Indigenous perspective. These confusing and contradictory statements do raise interesting questions about Indigenous identity that Dunbar-Ortiz should have further examined. Are

With hope that they could even out an agreement with the Government during the progressive era Indian continued to practice their religious beliefs and peacefully protest while waiting for their propositions to be respected. During Roosevelt’s presidency, a tribe leader who went by as No Shirt traveled to the capital to confront them about the mistreatment government had been doing to his people. Roosevelt refused to see him but instead wrote a letter implying his philosophical theory on the approach the natives should take “if the red people would prosper, they must follow the mode of life which has made the white people so strong, and that is only right that the white people should show the red people what to do and how to live right”.1 Roosevelt continued to dismiss his policies with the Indians and encouraged them to just conform into the white’s life style. The destruction of their acres of land kept being taken over by the whites, which also meant the destruction of their cultural backgrounds. Natives attempted to strain from the white’s ideology of living, they continued to attempt with the idea of making acts with the government to protect their land however they never seemed successfully. As their land later became white’s new territory, Indians were “forced to accept an ‘agreement’” by complying to change their approach on life style.2 Oklahoma was one of last places Natives had still identity of their own, it wasn’t shortly after that they were taken over and “broken by whites”, the union at the time didn’t see the destruction of Indian tribes as a “product of broken promises but as a triumph for American civilization”.3 The anger and disrespect that Native tribes felt has yet been forgotten, white supremacy was growing during the time of their invasion and the governments corruption only aid their ego doing absolutely nothing for the Indians.
The systematic racism and discrimination in America has long lasting effects that began back when Europeans first stepped foot on American soil is still visible today but only not written into the law. This racism has lead to very specific consequences on the Native people in today’s modern world, and while the racism is maybe not as obvious it is still very present. These modern Native peoples fight against the feeling of community as a Native person, and feeling entirely alone and not a part of it. The poem “The Reservation” by Susan Cloud and “The Real Indian Leans Against” by Chrystos examine the different effects and different settings of how their cultures survived but also how so much was lost for them within their own identity.
The first tensions began on the Klamath Reservation when the Modocs signed a treaty to quarter alongside their neighboring Klamath tribe in 1864. In 1850, Native Americans inhabited areas from Kansas to some parts of Oregon, and almost all the land between. Once the Americans were swayed with the philosophy of Manifest Destiny, they rushed to the West seeking land, money, or salvation. Land issues arose when the Americans and Indians met. Whether it was solved with conflict or compromise, it still ended up in hostility. Battles such as The Sand Creek Massacre of 1864 had no sign of negotiation at all, just warfare. When treaties were “passed”, or forced, they would be insignificant because it always tended to be one-sided by the Americans, and it was common for them to not uphold the treaty. After enraging the Indians, more fights would break out. Americans showed no mercy for the Natives at all. They force Indians to give away land and then restrict them into small reservations, where they would have to give up all their customs and traditions and follow the lifesty...

Indian policy gradually shifted from this aggressive mindset to a more peaceable and soft line policy. The Indian Wars ended in 1980 with the Battle of Wounded Knee. The battle resulted in over 200 deaths, but also, almost officially, marked a change in Indian policy. Although the change had subtly began before then, policies then became more kind. The Peace Commission created the reservation policy, although this was created 27 years before the Battle at Wounded Knee. The Dawes Severalty Act of 1887 was the greatest of reform efforts. The Act provided the granting of landholding to individual Native Americans, replacing communal tribal holdings. Another policy, the Burke Act of 1906, allowed Indians to become citizens if they left their tribes. Citizenship was eventually granted to all Native Americans in the 1920s.

Throughout history the attacks on Native American sovereignty proved to be too much and eventually tribes had to submit. The problems Native American tribes faced when fighting for and dealing with sovereignty in the 18th century are identical to the problems they are facing today. These
The movement westward during the late 1800’s created new tensions among already strained relations with current Native American inhabitants. Their lands, which were guaranteed to them via treaty with the United States, were now beginning to be intruded upon by the massive influx of people migrating from the east. This intrusion was not taken too kindly, as Native American lands had already been significantly reduced due to previous westward conquest. Growing resentment for the federal government’s Reservation movement could be felt among the native population. One Kiowa chief’s thoughts on this matter summarize the general feeling of the native populace. “All the land south of the Arkansas belongs to the Kiowas and Comanches, and I don’t want to give away any of it” (Edwards, 203). His words, “I don’t want to give away any of it”, seemed to a mantra among the Native Americans, and this thought would resound among them as the mounting tensions reached breaking point.
