I disagree with Martin Luther King Jr. when he says in his “Letter from Birmingham Jail” “… Socrates practiced civil disobedience.” I will use background information to set the stage, definitions of terms, and evidence drawn from King’s “Letter from Birmingham Jail”, Plato’s “Apology”, and Plato’s “Crito” to show that, while Socrates’ actions were similar to and may have inspired civil disobedience, he did not actually practice it. Socrates was born around 470 BCE in Athens, Greece. He was a soldier in his early life and then devoted himself to the search of truth. Because of this search, Socrates’ friend Chaerephon went to the Oracle of Delphi and she told him that nobody was wiser than Socrates. When Chaerephon told Socrates this, Socrates There are five main points. First, “Nonviolent direct action [i.e. civil disobedience] seeks to create such a crisis and foster such a tension that a community which has constantly refused to negotiate is forced to confront the issue.” (King, 37). Second, the action must also break a law or social code “openly, lovingly, and with willingness to accept the penalty” (King, 40). Third, you must have a defendable reason for taking the action. Fourth, all of your actions must be done with an intent of changing the issue. Lastly, negotiation must be tried first. Civil disobedience is a last resort option (King, 36-37) to force negotiation on an otherwise unwilling community or Socrates did not try to negotiate first, since there was nobody to negotiate with. King clearly states that you must try to negotiate first, because nonviolent direct action is a last resort strategy. Let’s examine another point. Socrates started talking to people as a result of the Oracle of Delphi’s prophesy. His talks that caused all this animosity toward him started, not because of a want to change the status quo, but because he wanted to prove the gods wrong. He wanted to show he was not the wisest, and so he ended up making tension. In his trail, he says to Meletus “If my offence is unintentional… you ought to have taken me privately, and warned and admonished me… I should have left off doing what I only did unintentionally - no doubt I should…” (“Apology”, 8). He is saying that if someone had just told him what was going on, he would have stopped. He isn’t “seeking to create such a crisis… that a community… is forced to confront the issue” (King, 37) he just wants to find his answers and teach some people to think in a new way. Since, in order for it to be civil disobedience, the actions must be done with the intent to change the issue, Socrates does not fit that
Crito on the other hand believes civil disobedience is sometimes morally legitimate in certain cases. He states “Your present situation itself shows clearly that the majority can do not just minor harms but very worst things to someone who’s been slandered in front of them” (pg.79) Crito tries to reason with Socrates by telling him how by abiding to these “just” laws is what got him in prison in the first place, and how he is going to be unjustly prosecuted because of it. He goes on by trying to persuade him that by escaping prison it wouldn’t classify as civil disobedience since he wouldn’t be harming anyone. Martin Luther King, Jr. defines “civil disobedience” as a way to show others what to do when a law is unjust and unreasonable. King is most famous for his role in leading the African American Civil Rights Movement and using non-violent civil disobedience to promote his beliefs. Plato's The Apology is an account of the speech. Socrates makes at the trial in which he is charged with not recognizing the gods recognized by the state, inventing new gods, and corrupting the youth of Athens. For the most part, Socrates speaks in a very plain, conversational manner. He explains that he has no experience with the law courts and that he will instead speak in the manner to which he is accustomed with honesty and directness. Socrates then proceeds to interrogate Meletus, the man primarily responsible for bringing Socrates before the jury. He strongly attacks Meletus for wasting the court¡¦s time on such absurd charges. He then argues that if he corrupted the young he did so unknowingly since Socrates believes that one never deliberately acts wrongly. If Socrates neither did not corrupt the young nor did so unknowingly, then in both cases he should not be brought to trial. The other charge is the charge of impiety. This is when Socrates finds an inconsistency in Meletus¡¦ belief that Socrates is impious. If he didn¡¦t believe in any gods then it would be inconsistent to say that he believed in spiritual things, as gods are a form of a spiritual thing. He continues to argue against the charges, often asking and answering his own questions as if he were speaking in a conversation with one of his friends. He says that once a man has found his passion in life it would be wrong of him to take into account the risk of life or death that such a passion might involve.
Socrates was wise men, who question everything, he was found to be the wise man in Athens by the oracle. Although he was consider of being the wises man alive in those days, Socrates never consider himself wise, therefore he question everything in order to learned more. Socrates lived a poor life, he used to go to the markets and preach in Athens he never harm anyone, or disobey any of the laws in Athens, yet he was found guilty of all charges and sentence to die.
Thoreau and Socrates start Civil Disobedience and Crito with basically the same premise. They both believe that humans are essentially moral beings. Thoreau says that people if left to their own ends will act justly, and should be treated accordingly by the law. Socrates says essentially the same thing, he says that "no one wants to commit injustice" for its own sake, many people end up doing so anyway. Socrates says that the citizens of a government have entered into an agreement to abide by its laws in exchange for protection. He also says that if one believes these laws to be unjust, one can always leave, but if one agrees to abide by the laws they have a duty to be subjected to punishment if they break these laws. Thoreau on the other hand says that it is the duty of the people not to abide by a law if they perceive it to be unjust, and if they claim to be opposed to it and nevertheless abide by it, they are a hypocrite.
In a democracy, people choose representatives to lead and govern them. However, these representatives might take unpopular steps. In such instances the people may show their disapproval of a policy and vent their grievances through acts of civil disobedience. Henry Thoreau said, “It is not desirable to cultivate a respect for the law, so much as for the right.” It is both the right and responsibility of a person to fight an unjust law, and civil disobedience allows one to convey his thoughts and ideas in a passive, nonviolent way. In Sophocles’ Antigone, written in 442 B.C., we find one of the earliest examples of civil disobedience. The play emphasizes the right of the individual to reject his government’s infringement on his freedom to perform a personal obligation and highlights the struggle that one faces in doing so. More importantly, it shows how such actions help further the cause of democracy. It strengthens the belief that each individual’s opinion is important in a democracy and makes a difference. Eventually, we see Creon realize his mistake – his stubbornness – which teaches him that he should have room for more than one opinion. Also, women at that time were not considered equal citizens, but Antigone’s actions left people to rethink the extent of the equality in Athenian democracy.

The word civil has several definitions. “The one that is intended in this case is "relating to citizens and their interrelations with one another or with the state", and so civil disobedience means "disobedience to the state". Sometimes people assume that civil in this case means "observing accepted social forms; polite" which would make civil disobedience something like polite, orderly disobedience. Although this is an acceptable dictionary definition of the word civil, it is not what is intended here. This misinterpretation is one reason the essay (by Henry David Thoreau that was first published in 1849) is sometimes considered to be an argument for pacifism or for exclusively nonviolent resistance”.
Civil Disobedience occurs when an individual or group of people are in violation of the law rather than a refusal of the system as a whole. The character of Socrates in Plato’s Republic is a curious one. Socrates is rarely satisfied with widely or casually accepted statements, and is fearless in taking on enormous topics for debate. One such topic that Socrates tackles early and often in the Republic is that of justice and the just life. It takes little time for Socrates to begin an attempt at demonstrating to two of his friends, Glaucon and Adeimantus, that in fact it pays to be just. After much debate and even the creation of a fictional city, a resolution of some kind is reached. Socrates does succeed in convincing his opposition that it pays to be just, however he does not demonstrate said fact. The difference is subtle, but profound.
History has encountered many different individuals whom have each impacted the 21 in one way or another; two important men whom have revolted against the government in order to achieve justice are Henry David Thoreau and Martin Luther King Jr. Both men impacted numerous individuals with their powerful words, their words carried the ability to inspire both men and women to do right by their morality and not follow unjust laws. “On the Duty of Civil Disobedience” by David Henry Thoreau along with King’s “Letter from Birmingham Jail”, allow the audience to understand what it means to protest for what is moral.
King viewed civil disobedience as an obligation if laws were unjust, especially if the proponents of the unjust laws were not willing to negotiate as well as compromise the laws and situations. King states “You are quite right in calling for negotiation.
Because even though each action action he took predicted his future, he took into consideration everything that would happen after he opens his mouth. Socrates said, “An unexamined life is not worth living.” And even though the result came down to Socrates being placed onto death row, he knew that everything that had occurred and that will happen was because God had planned it. He chose to live a life in which was just and righteous all the way to the end. Socrates understood that the only truth and wisdom could only come from one person and that was God. As stated before, Socrates explained that human wisdom was worth nothing and the wisest of all was God. That God was before all and knew everything before anything was created at all. In Antigone, Creon created an edict that states that nobody could bury Polynices’s body because he was a traitor to Thebes and his family. Under Martin Luther King’s definition of an unjust and a just law, Creon’s edict is unjust and degrades Polynices’ right to be buried because of lack of information and favoritism of one brother.

Socrates lived in the greatest and most exciting period of his country's history, when Athens developed from a mere city-state to be the head of an empire.
