THESIS STATEMENT: The Great and General Court of Massachusetts has erred in reforming the juvenile justice system by implementing policies and procedures that will harm juveniles and place society at risk.
On July 23, 1995, an intruder brutally attacked and stabbed Janet
Downing approximately 100 times in her Somerville home. The revolting
Downing murder and ensuing arrest of Edward O'Brien Jr., a 15-year-old juvenile whom prosecutors say committed the heinous crime, sent shockwaves through the state. When Somerville District Court Judge Paul
P. Hefferman ruled that the Commonwealth try Mr. O'Brien as a juvenile, those shockwaves grew in intensity, and the citizens of Massachusetts, fed up with increasing youth violence and perceptions of an ineffective juvenile justice system, demanded the enactment of tough new laws to deal with repeat and violent juvenile offenders. The Great and General
Court of Massachusetts headed these demands for reform of the juvenile justice system and enacted legislation that, among other things, abolishes the trial de novo system in the juvenile courts, requires the trial of juveniles charged with murder, manslaughter, aggravated rape, forcible rape of a child, kidnaping, assault with intent to rob or murder and armed burglary in adult court and permits prosecutors to open to the public juvenile proceedings when they seek an adult sentence.
Although proponents tout these measures as a sagacious solution for the vexatious problem of juvenile delinquency, abolishing the trial de novo system, providing for automatic adult trials and opening juvenile proceedings to the public when prosecutors seek an adult sentence works to the detriment, not the benefit, of juveniles and society. Therefore, the policy makers of Massachusetts should repeal most sections of the
Juvenile Justice Reform Act and develop other policies to deal with the rising problem of juvenile crime.
I. A SINGLE TRIAL SYSTEM PREVENTS COURTS FROM PROVIDING RAPID ASSISTANCE
TO JUVENILES IN NEED, DOES LITTLE TO SERVE JUDICIAL ECONOMY AND PLACES A
SIMILAR BURDEN AS THE DE NOVO SYSTEM ON VICTIMS AND WITNESSES.
Proponents of a single trial system for juveniles argue that the trial de novo system wastes judicial resources by giving defendants a second bite at the apple and traumatizes victims and witnesses by forcing them to testify at two proceedings. However, these proponents fail to acknowledge that the de novo system allows judges to quickly provide juveniles with the rehabilitative help they need. The proponents, unsurprisingly, also fail to acknowledge that a single trial system may place a greater burden on judicial resources and a similar burden on victims and witnesses.

The Juvenile Justice system, since its conception over a century ago, has been one at conflict with itself. Originally conceived as a fatherly entity intervening into the lives of the troubled urban youths, it has since been transformed into a rigid and adversarial arena restrained by the demands of personal liberty and due process. The nature of a juvenile's experience within the juvenile justice system has come almost full circle from being treated as an adult, then as an unaccountable child, now almost as an adult once more.

Pit bulls are targeted in this ineffective solution to dog attacks. Perhaps the reason why pit bulls are feared by society because we are afraid of what they are associated with. Pit bulls are often thought of as a gangster’s pet; a role in violent and illegal activities. People stereotype this breed because of the unfortunate acts of few. In contrast, society needs to understand that they are being racist towards a breed of dog. Denver’s systematic killing of pit bulls could be compared to the actions of the Nazis during the holocaust. Although BLS is not even close to being on the same scale as the Holocaust, it is targeting and killing a specific group of living beings. Breed Specific Legislation is genocide of this breed. Denver alone has killed at least 3,500 pit bulls. It’s heart wrenching to think about how many families lost their steadfast companions because of the ignorance of others. A common phrase among pit bull supporters is, “Judge the deed: not the breed”. This rings true; if we are to bring justice to the breed, then we need to abolish BSL. What do you think of when I say the word pitbull? Do you picture a cute happy dog, wagging its tail happy to see you? Or do you see a mad dog, foaming mouth lunging at small child? If you are a owner of a pitbull then you probably see the happy cute dog. But if you don't own one then chances are you see pitbulls as mean dogs who are a threat to society. The media has painted a picture in our heads that it's in a pitbulls blood to be aggressive. Due to this false accusation, certain cities have banned breeds labeled as “aggressive”. If someone is caught owning a banned breed, the dog is usually euthanized. This is known as Breed Specific Laws or otherwise known as BSL.
A growing number of probation officers, judges, prosecutors as well as other juvenile professionals are advocating for a juvenile justice system which is greatly based on restorative justice. These groups of people have been frustrated by the policy uncertainty between retribution and treatment as well as unrealistic and unclear public expectations. As a primary mission, the balanced approach or policy allows juvenile justice systems together with its agencies to improve in their capacity of protecting the community and ensuring accountability of the system and the offenders . It enables the youths to become productive and competent citizens. This guiding philosophical framework for this policy is restorative justice as it promotes the maximum involvement of the community, victim, and the offender in the justice process. Restorative justice also presents a viable alternative to sanctions as well as interventions that are based on traditional or retributive treatment assumptions. In the policy proposal for restorative justice, the balanced approach mission assists juvenile justice system in becoming more responsive to the needs of the community, victims, and the offenders . Therefore, this paper considers how restorative justice reduces referrals of juveniles to criminal and juvenile justice systems and gives a proposal on the implementation of restorative justice in the community together with a number of recommendations. For instance, preliminary research reveals that application of restorative justice in schools significantly reduces school expulsions, suspensions, and referrals to the criminal justice systems. Restorative justice programs are an alternative for zero-tolerance policies for juveniles or youths .

The goals of juvenile corrections are to deter, rehabilitate and reintegrate, prevent, punish and reattribute, as well as isolate and control youth offenders and offenses. Each different goal comes with its own challenges.
Girls become delinquent for many different reasons then boys based on biological, social and cultural differences in each gender. From hormones and brain development, to the child’s upbringing by families, to the way girls are expected to act in public compared to boys; a different set of circumstances exists for the reasons why girls become delinquent compared to boys. Siegel, (2007, p.174) explains this by stating. “There are indications that gender differences in socialization and development do exist and that they may have an effect on juvenile offending patterns.”
Introduction: Recidivism or, habitual relapses into crime, has time and time again proven to be an issue among delinquents, which thereby increases the overall juvenile prison population. This issue has become more prevalent than what we realize. Unless a unit for measuring a juvenile’s risk of recidivism is enacted and used to determine a system to promote effective prevention, than the juvenile prison population will continue to increase. Our court system should not only focus on punishing the said juvenile but also enforce a program or policy that will allow for prevention of recidivism. So the question remains, how can recidivism in the juvenile prison population be prevented so that it is no longer the central cause for increased juvenile delinquency? Simply put, we must create a means of measuring juvenile’s level of risk and in turn, form an effective rehabilitation program that will decrease their risk level for future recidivism.

Ethos, pathos, and logos are ways that an artist or an advertisement use in order to effectively persuade or convince readers to buy their product. Ethos is used to convince audiences that an ad is credibly and that people can believe what they reading. Pathos is when an artist or advertisement try to appeal to the consumer’s emotional state. Finally, logos is trying to convince buyers to purchase their product by using logic or reasoning. By analyzing the use of ethical, emotion, and logical appeal, we can compare and contrast a Pepsi ad and a Coca Cola advertisement.
The film Freedom Writers directed by Richard La Gravenese is an American film based on the story of a dedicated and idealistic teacher named Erin Gruwell, who inspires and teaches her class of belligerent students that there is hope for a life outside gang violence and death. Through unconventional teaching methods and devotion, Erin eventually teaches her pupils to appreciate and desire a proper education. The film itself inquiries into several concepts regarding significant and polemical matters, such as: acceptance, racial conflict, bravery, trust and respect. Perhaps one of the more concentrated concepts of the film, which is not listed above, is the importance and worth of education. This notion is distinctly displayed through the characters of Erin, Erin’s pupils, opposing teachers, Scott and numerous other characters in the film. It is also shown and developed through the usage of specific dialogue, environment, symbolism, and other film techniques.
