ISSUES AND CHALLENGES IN ISLAMIC INHERITANCE
INTRODUCTION
Islamic inheritance is one of the most important thing in islamic law. In legal terminology, it means inheritance must be divided from the property of the deceased among his successors. Inheritance also prominently dealt with in the quran and its often called ‘mirath’. All muslims are expected to follow and implement the rules of islamic inheritance. As we know islamic inheritance has been pre-ordained by Allah s.w.t in a wise and gradual manner in order to allow for its evenness with the judiciary and human nature which it can make difficult to change their normal practice.
In addition, the system of inheritance had been continued in zaman jahiliyyah based on kinship and hijrah but the system of inheritance had been replaced by will distribution (wasiyyah) to parents and kins folk based on verse 180 in surah al-baqarah. Finally, in final stage all of the system was abolished and then its replaced by current islamic inheritance law. These law also derived from Allah based on mawarith verses which are verses 11, 12, and 176 from surah an-nisa’. Allah s.w.t has been determined with that rulings and method to distribute inheritance to all beneficiaries is just to be fairly to all level and don’t want conflict or contradiction among the beneficiaries. In al mawarith verse, allah had explained in detail the beneficiaries and the portions in the inheritance meaning. While islamic inheritance law is the responsibilities that must be fulfilled by beneficiaries before it can be apportioned by faraid distribution.

The civil courts have been established under the Malaysian Constitution and command a larger share of the constitution, so that all Malaysians are subject to this jurisdiction. Instead, the Islamic courts were established by States and this court administering Islamic law only to Muslims. Federal Constitution can not be used to determine Sharia court's power to issue judgment. However, there is no provision in State law to give consideration to a number of cases, with the Sharia courts can not function properly implemented, such as cases involving non-Muslims. Because of this, the customer needs to process their inheritance cases through both the civil and Syariah Court will cost time and money.
Since the beginning of time, mankind began to expand on traditions of life out of which family and societal life surfaced. These traditions of life have been passed down over generations and centuries. Some of these kin and their interdependent ways of life have been upheld among particular people, and are known to contain key pieces of some civilizations.
In conclusion, Carnegie has proposed solution of distribution of money to community and ambitious poor people, which could successfully implemented in his times, however, in present time, somehow it may be hard for riches to implement this solution in the changed economy where competition has increased, businessmen tends to develop their business permanently and old people is being aged creating new factor for social tension. Nevertheless, this does not mean that Carnegie’s solution could not be implemented at all. Rich man, who has high morality, will always manage to share his money to community.
But irrespective of the different manifestations and different practices, finally all streams of Islam find their mission and identity in their beloved prophet, religious history and sacred texts As it is such sources that will finally define and guide Islam of the future as it goes on spreading around the world, we must consider them as seriously as a serious Muslim does (Wilson). We should understand what is there in Islamic texts and instances and life of their prophet for understanding the growth and nature of Islam. On such historical-theological foundation, then we can best understand and contrast the objectives and state of Islam in today’s world for its true mandates and motivations.

The conflict discussed in this paper revolves around a custody dispute in which the disputing parties are a divorcing couple who are having conflict over the cultural difference in which each parent would like their daughter raised. The father is of Arabic descent that was raised with Islamic values and significantly embraces his culture in every facet of his life. The truth is, Islamic culture is highly misunderstood, and the customs within Islam are often misinterpreted by Westerners. Often we point to the Arab world as an example of poor treatment of women, without evaluating our own laws and practices. In an article in the Start Tribune published in 1989, Dr. Fatma Reda, a scholar from Egypt who came to the U.S. with her husband the year before, experienced some of the Western stumbling blocks for women and longed for her Islamic country. She decided to buy a parcel of land for herself, but in the U.S., she needed a co-signature of her husband. She had been used to more equality in Egypt between men and women. “Under Islamic law, women can own property independently of their husbands… in Islamic teaching, women are entirely equal to men… many times Muslim women make choices that look on the surface like we don’t have as much freedom, but it is just different” (p. 1).
There is a collective existence of different forms legal systems, because of the country’s diversity in culture, language and religion. This diversity is able to flourish in India only because of representation of different communities. Diversity and pluralism are acknowledged in India which safeguards the interests of different social groups and communities. This led to law being seen as necessarily pluralistic. However, after colonisation there was an effort made by the British to make law uniform, an essential condition in what was seen as ‘modern law’. Nonetheless, after independence an effort was made to have a pluralistic legal system as this would lead to better representation of different communities. This is how the Panchayati Raj system, a form of local self-government came about. Panchayats were reintroduced in 1992 after the British rule, and there a panchayat in every town of village. The people of the village elect the members of the ‘panch’, whose responsibility is the local administration of the village. In many places, gram panchayats are also known as gram sabhas. In this manner, different forms of legal pluralism shape everyday ordering and disputing in rural and urban India. They relate to formal law as well as customary legal orders equally. Family is the important base to the entire of human in their life. There are several principles of moral and ethics that should be applied in family. Firstly, it’s all about love among the family members. Love is an emotion that felt by an individual which is unconditionally given by one individual to another individual. Secondly, giving and receiving among the family members. Giving and receiving make the love flows highly in family whereas giving is an ethics that should been applied among family members.
