An analysis of freedom would be incomplete if it failed to scrutinize the laws of a society that are meant to enhance and promote freedom and equality. Such analyses were undertaken by Catharine MacKinnon (Difference and Dominance: On Sex Discrimination) and Michael Warner (The Trouble with Normal: Sex, Politics, and the Ethics of Queer Life). Their works highlight the patterns of dominance over certain groups (namely women and homosexuals) exercised within the legal structures of society presiding over everything from the military to jobs and marriage. Both authors challenge their readers to think in a way that defies convention, and perhaps become equipped to help make the world a better, freer place. As MacKinnon notes, sameness doctrine makes no distinction between sexes, thus allowing men to take advantage and gain “the benefit of those few things that women have historically had.” MacKinnon lists child custody and alimony under divorce law as two areas where men have “gained” equality. This equality has come at women’s expense, specifically in the instance of child custody, as any objective, genderless standard for good parenting will inherently favor men (level of income and apparent ability to start a family). Essentially, sameness doctrine favors men by making the few avenues historically reserved for women, like child custody, readily available to men, while failing to open up to women those avenues, like war, which have historically been men’s territory. Warner’s argument hinges on the distinction between shame and stigma, the former focused on the deed and the latter focused on the doer. Specifically, as Warner puts it, “shame affects one’s biographical identity,” and given enough time, it, like the memory of the deed it was tied to, will pass; stigma, on the other hand, “identif[ies] a person permanently with his or her disgrace,” and stays with the person “like a brand or a tattoo.” (Warner 27-8) Throughout his work, Warner continues to hammer home the point that stigma is for life, and its negative impact on the lives of those it touches is necessarily unavoidable. In an effort to legitimize all subcategories of sexuality considered deviant of heterosexual normatively, queer theory acknowledges nontraditional sexual identities by rejecting the rigid notion of stabilized sexuality. It shares the ideals of gender theory, applying to sexuality the idea that gender is a performative adherence to capitalist structures that inform society of what it means to be male, female, gay, and straight. An individual’s conformity to sexual or gendered expectations indicates both perpetration and victimization of the systemic oppression laid down by patriarchal foundations in the interest of maintaining power within a small group of people. Seeking to deconstruct the absolute nature of binary opposition, queer theory highlights and celebrates literary examples of gray areas specifically regarding sexual orientation, and questions those which solidify heterosexuality as the “norm”, and anything outside of it as the “other”.
The focus of the book helps understand the true importance of books like Gay New York, Coming Out Under Fire, and Men Like That by explaining the progress made in the United States regarding the acceptance of the gay community into society. Consisting of six chapters that cover many issues regarding the government, including the military, welfare, and immigration. Much like in Coming Out Under Fire, Canaday points out issues gay men and women faced following World War II. From the mid-1940s into the late 1960s, the state crafted tools to overtly target homosexuality (Canaday, 2009). Policies were enacted that explicitly used homosexuality to define who could serve in the military (Canaday, 2009). Much has changed since then, considering the infamous “don’t ask, don’t tell” policy was repealed. Canaday’s main argument in the book is that sexual citizenship was built into the federal bureaucracy as it was being created, and this needs to be more attended to by historians (Canaday, 2009). According to Canaday, the foundations of sexual citizenship are the reason the United States has such an issue with securing universal gay rights. For over a century, people have been fighting for basic human and civil rights. When the Europeans took over the US, it shifted the course of history. New government systems had formed which we now call our legal system that consists of Legislative, Judicial, and Executive branch. Society (heterosexual middle class men) started questioning who has these rights which created gaps, prejudice, and violence between people of color and gendered. Over the course of the semester, we discussed social contract by Carole Pateman, feminist waves (second wave) by Alma Garcia, and Queer Feminism by Dean Spades.
Margot Canaday’s Straight State is an examination about the relationship between homosexuality and the United States government’s legal definition of citizenship. She focuses on three areas; the immigration, welfare, and the military. On Earth, the world population has reached over 7 billion people who belong to over 5000 ethnicities. With over 7 billion people, you would think there are some major differences in us all, but the most prominent difference is our skin color. With the difference in skin color has come prejudice towards certain ethnic or racial minorities and from that has stemmed discrimination. Take the civil rights movement of the 1960’s for example. Even after 50 years and with the election of President Barack Obama, African Americans still feel underrepresented and discriminated against. Another example is the Women’s Rights Movement which started in 1840 and is still prominent today. Just over a year ago a ban was finally lifted which kept women from fighting in combat over-seas. And still today, women are oppressed in the workforce due to the glass ceiling, an invisible barrier that blocks the promotion of a qualified individual in a work environment because of the individual’s gender, race, or ethnicity. A further example and the one that serves as the basis to this paper is the Stonewall riots, the beginning of the LGBT movement and societies view towards homosexuality since then. “This Gay Liberation movement, initiated by the Stonewall Riots in New York, expressed the twin intentions of discrediting psychiatric and medical models of homosexuality, and of attempting a large-scale transformation of society” (Downing, 2011). By the mid-1970s, the LGBT movement helped to establish gay identity as a legitimate minority group – the gay community.

Gender identity is closely interlinked with social science as it is based on an identity of an individual in the society. In general a traditional society is more conservative where as a modern society is fundamentally liberal. This is to say that a traditional society lists certain roles depending on the gender and there are stereotypes that are connected with the genders.
