As the result of a colleague’s sudden serious illness, a clinical psychologist is asked to teach a physiological psychology course, which is definitely outside his area of expertise. The course begins in one week. The department chair recognizes that the psychologist is not competent is this area, but he is as qualified as anyone else in the department and is the only person whose schedule can accommodate the course. The course is required for graduation, and several seniors will not graduate at the end of the semester if they do not take the course now.
What should the faculty member do?
This clinical psychologist is faced to ethical dilemmas of teaching a class that he is not competent in teaching, as well as a conflict of interest with the department chair that understands his dilemma, but wants him to abandon his principles and compromise ethics. American Psychologist Association (APA) developed ethical principles and codes to assist psychologist when they are faced with ethical dilemmas. Utilitarianism and Kant’s Formalist Theory are two models of ethical reasoning the psychologist can concerned in determine how to this dilemma as well. Gary Ford has also written an ethical decision making process that can guide psychologist in gathering information to their ethical dilemmas.
APA Ethical Principles of Psychologists and Code of Conduct have established regulations to guide psychologist in conducting ethical behavior, while protecting their clients. However, ethical standards doe not state the consequences of an action. APA ethical principle C discusses the psychologist need for integrity. The field of clinical mental health is one of great reward, but also one of grave responsibility. It is the duty of the counselor to provide the client with a safe environment and an open mind, in order to foster a healthy therapeutic relationship. The majority of mental health counselors would never intentionally harm their clients; however; good intentions are not enough to ensure that wrong will not occur. The ethical expectations and boundaries are regulated by both laws and professional codes. When discussing ethics, one must realize there are two categories, mandatory and aspirational. (Corey, Corey & Callanan, 2007)
Ethics in the counselling and psychotherapy protects the client and the therapist involved in the therapeutic relationship and the therapeutic process as a whole; with the concepts that act as a guide for the therapists in provision of good practice and care for the client. The framework is built on values of counselling and psychotherapy; principles of trustworthiness, autonomy, fidelity, justice, beneficence, non-maleficence and self-respect, and provides standards of good practice and care for the practitioner (BACP, 2010). Ethical framework contributes to the development of the therapeutic relationship and process by assisting therapist’s decisions, and guides their behaviour and proceedings within their legal rights and duties. The ethical frame is structured on the boundaries of the therapeutic relationship and the therapists should be aware of their categories and be responsible for their forms. Monitoring and being aware of what goes on in and out of the room physically, emotionally and psychologically is primarily the duty of the therapist.
Mumford would be called to a meeting after the board of directors and I had met initially to discuss the unethical practice that he been performing. Although it appeared to all that the patients that he counselled or diagnosed became healthier in their actions but the facts remain that he did not follow any ethical standards for psychologists. During the board meeting, we would discuss the competence and responsibility of the professional ethics guideline on Mumford. “It is hoped that these guidelines will be of assistance when human service professionals and educators are challenged by difficult ethical dilemmas” (Woodside and McClam, 2011, p. 276). After the board members reached a mutual agreement, the meeting with Mumford would begin. In the meeting with Mumford, the board of directors would discuss his unethical act of practicing psychology without a license. According to our textbook, “psychologists provide services, teach, and conduct research with populations and in areas only within the boundaries of their competence, based on their education, training, supervised experience, consultation, study or professional experience” (Woodside, 2011, p. 276). Although Mumford attended college, he did not have enough credentials to hold a position as a psychologist. Understanding the American Counseling Association (ACA) and the American Mental Health Counselors Association (AMHCA) ethical codes is an important aspect of developing one’s professional identity as a mental health counselor. More specifically, in order for a counselor to be professionally competent and ensure he/she is able to uphold ethical boundaries, it is essential that one becomes familiar with the codes. Furthermore, both ethical codes share a multitude of similarities as well as differences, including that the AMHCA code of ethics profoundly draws from the ACA code of ethics. The primary weakness of the APA is that it only applies to professional conduct and not private life. According to Pipes, Holstein, and Aguirre (2005), "APA codes apply within their role as psychologists...they may, with impunity from the Code, demean individuals of a particular gender or a particular religion with whom they interact only on a personal basis" (p. 326). While the APA has enforceable standards, the preamble and general principles are aspirational and seek to create individuals whose professional character will successfully integrate into their personal lives. The Ethical Decision Making Model is an ethical guideline that is useful in ethical dilemmas and what course of action to take. It’s a framework that allows professionals to analyze and make ethical decisions to the best of their ability. It gives counselors a protocol to determine the appropriate course of action when faced difficult challenge. These decisions are taking into account; reflect a concern for the interests and the well-being of all clients concerns. Counselors should keep in mind the Golden Rule: “Do onto others as you would want onto you”.
Many ethical dilemmas are philosophical in nature, an ethical issue can be described as a problem with no clear resolution. In order to solve the issue or dilemma a consensus between the parties involved must be reached. There are several reasons to come to an agreement over an ethical dilemma, it is the basis for all aspects of personal and professional dealings. Ethical issues in a counseling practice lay the foundation of a therapist in practice. Ethics are at the center of how the counseling process functions and operates in a successful manner for the clients who seek help in such a setting. In order for the counseling profession to be ethical and hold professional recognition, there are many facets that need to be examined and outlined to make sure all counselors and practitioners are functioning at the highest level and withholding their duties required by the counseling profession. The first introduction so to speak of the area of ethics also happens to be one of the first steps in counseling, which is the informed consent. The informed consent provides the basis of what happens or will be happening in a counseling setting and serves to inform the client to their rights, responsibilities, and what to expect. Most importantly, the informed consent is in place for the client’s benefit. It also is important to understand that culture and environment play a role in the treatment of a client and how theories can positively or negatively impact this treatment. Therapists need to understand how to work within the context of a theory while being able to understand the individual in their own environment. Although theories are put into place to serve as a framework, there are also alternative ways to approach counseling, one example being evidence-based practice. Maureen H. Miner recommends in his article that any training in ethics will be judged by the quality of ethical choices made by those who complete it. If psychologists are to be recognized as professionals who are committed to best practice, then we should take ethical training very seriously. (Miner, 2005)
This week’s readings cover clinical supervision. Although the school psychology ethics and laws usually go hand in hand, it is important to understand that they are not that same concept.
